The Board of County Commissioners in and for Indian River County, Florida, met at the Court House in Vero Beach at 5 o'clock P.M.Tuesday, ©ctober 29t12 lyEy, W:.W tine G following members of the Board present: Albert 0. Helseth, Chairman; T. W. LaBruce; i, T. D Yongue and T. T. P. Hamilton. Also present was the Clerk by the Deputy Clerk, The Chairran announced the special meeting was called for the purpose of discuss- ing the matter of the refusal of the Planning and 'Zoning Commission of the City of Ver Beach to permit the County to erect a Tail on the site selected by the Board. I After considerable discussion, it.was moved by Commissioner LaBruce that the Board's attorney confer with the City authorities, and if possible obtain a permit j for the erection of a jail on the site previously selected by the Board, and in the el such building permit cannot be obtained that the attorney be and he is hereby authori2 and directed to institute mandamus proceedings in the name of and on behalf of this Board against the proper city officials for the purpose of requiting such officials to issue such permit. The motion being seconded by Commissioner Hamilton, and being put to a vote all members present voting in favor of the motion. On motion made, seconded and carried the Board then adjourned. The Board of County Commissioners in and for Indian River County, Florida, met . at the Court House in Fero Beach, Florida, on Tuesday, November 5th 19299 with the following members of the Board presents J.D.Yongue; J.W.laBruce; J.J.P.Ha.milton and John H. Atkin. Absent Chairman, .Albert O.Helseth. Also present were Miles warren, Clerk and Clark S. Rices &ie rif f . rhe Chairman being absent, on motion made, seconded and carried John H.Atkin, was named Chairman pro tem for this meeting. The minutes of the previous meetings were read and approved. wi llie Powell, Colored, appeared with v.S.Buehingham requesting assistance in taking care of water on his place at Gifford, caused by reason of construction of roe to negro school house. it was ordered the matter be tabled until mid -month meeting and County Engineer zz be instructed to make estimate of probable cost in, connection therewith. County agent, W.E.Evens, filed his monthly report of activities. it was ordered that the board pay actual cost of attending to Aaron Johnson, negro, who has eye trouble and no funds with which to pay for same. it was ordered Mrs. Clara Huff, Roseland, be. placed on. the pauper list to receiz $14.00 per month. on motion made, seconded and carried the County Engineer was ordered to secure deed to right-of-way for Bridge across canal at M rth end of Royal Park in Vero Be It wa,s ordered. that deeds to five acres of land donated by J.M.Knight and asso- ciates be recorded by the Clerk of the circuit Court. it was ordered that the County Engineer make estimate on continuation of Ro se - land road to Methodist cliurch and then North to ka in Street and advise the Board. ,. R 1 u 1 1 1 A a M C On motion of Commissioner Hamilton, seconded by Commissioner Yongue it was ordered that the telephone bill of 018.80 for phone in county Judge's office be paid .and future bills for telephone in . that office be paid by the County for County purposes. And that this bill be turned back for itemized bill of same and all expense in conn- ection with County business be paid by the County. The following road petition was received, read and filedc ROAD PETITION. STATE OF FLORIDA ) s COUNTY OF INDIAN RIVER) To the Honorable Board of County Commissioners of said County. Gentlemen: Wes the undersigned, citizens of the County of Indian River, State of Flo - rids, respectfully represent that the necessities of the public require a County Road to be laid out as follows, to -wit: Commencing at a point where Road No. 12 (located in Fellemere Fauns Compagy's subdivision of Twp. 31 Range 37) intersects Tracts 1334 and 1338, running North from this point to a point where Road 7 intersects Tracts 834 and 835. `there is a road right-of-way over this route at present", fence lines having been established allowing for this road and considerable traffic now passes over the outh portion of it, this road right-of-way having been allowed by the pro- perty owners to the extent of 30 feet in width, some ten or twelve years ago, said road right-of-way is a continuation of a County Road, 30 feet in width, running from the North Boundary of City of Fellsmere to the point of beginning for the proposed road. Said road right-of-way to be not less than Thirty feet in widthe ae therefore petition your honorable body to cause to be laid out and opened a County Road as above described, and we, the owners of the land through which said road is sought to be laid out, in consideration of the sum of One dollar to us each and severally in hand paid by the said County of indian River, the receipt of which is hereby acknowledged, hereby agree to give the right-of-way through our lands, as shown by the plat accompanying this petition, and relinquish all claims for damage by reason thereof. Manager it w4s ordered that G.E.Barkoskie, H.H.Pennington and D.L.1eisher, be appointed a. Committee to view, mark and lay out the above road and report to this Board. The several bills and accounts' against t he County, having been audited, were ermined, and found to be correct were approved by a majority of the County Commiss- ioners present and ordered paid. The said bills and accounts being on file in the Clerk's office and by reference thereto is made a part of these minutes. The warrants so issued, from the respective funds, in settlement of such accounts being listed completely in the County Finance Record, as provided by law, and reference to said County Finance record is made a part of these minutes as fully and completely a:s if the said warrants were set out herein in detail. r The County Depositories filed their monthly statements of the various accounts of the County, showing receipts and disbursements, which having been checked were found to be correct.
