HomeMy WebLinkAbout1994-16t 5/20/94 (ch.400_doc)Ow ORDINANCE 94- 16 AN ORDINANCE OF INDIAN RIVER COUNTY AMENDING CHAPTER 400 OF THE INDIAN RIVER COUNTY CODE WITH RESPECT TO CATEGORIES OF SKILLS REQUIRING A COMPETENCY CARD, ESTABLISHING A PREREQUISITE FOR ACTIONS AGAINST A REGISTERED CONTRACTOR, AND CREATING A PRESUMPTION OF WORKING FOR COMPENSATION. WHEREAS, experience has shown that certain procedures governing the regulation of contractors need to be modified, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that: SECTION 1. AMENDMENT. a) Section 400.01(1) which currently reads as follows: (1) No person shall engage in the business of construction, contracting or subcontracting as regulated by Florida Statutes or in a category as tested by Block and Associates without a valid certificate of competency issued by the Indian River County Building Department unless certified under Florida Statutes. is hereby amended to read as follows. (1) No person shall engage in the business of construction, contracting or subcontracting as regulated by Florida Statutes or in a categories listed in Appendix A to Ordinance No. 94- ± 6(copies of which are available in the Clerk's office and the Building officials office) without a valid certificate of competency issued by the Indian River County Building Department unless certified under Florida Statutes. b) Section 400.08. which currently read as follows: Any person may bring charges against a registered contractor. Such charges shall be made in writing and sworn to by the building official shall mail a copy of such charges to the accused within fifteen (15) days from the receipt therefor and shall serve notice upon the accused and upon all interested persons of the date fixed for a hearing on such charges before the building code board of adjustment and appeals. The accused shall have the right to appear personally or with counsel and to produce witnesses and evidence in defense. If after hearing the evidence the board determines that the accused is guilty of the charges brought against the accused, the appropriate board may suspend or cancel the contractor's registration. In lieu of suspension or revocation the board may provide for a fine. is hereby amended to reads as follows. Section 400.01. Certificate required. Any person, after having received a favorable decision in a court of competent jurisdiction against a registered contractor, may bring charges against said contractor. Such charges shall be made in writing and sworn to by said person. The building official shall mail a copy of such charges to the accused within fifteen (15) days from the receipt thereof and shall serve notice upon the accused and upon all interested persons of the date fixed for a hearing on such charges before the building code board of adjustment and appeals. The accused shall have the right to appear personally or with counsel and to produce witnesses and evidence in defense. If after hearing the evidence the board determines that the accused is guilty of the charges brought against the accused, the appropriate board may suspend or cancel the contractor's registration. The building official may bring charges under the procedures of paragraph 1 of this section without seeking a court determination . c) Section 400.03 which is "reserved" is hereby amended to read as follows Section 400.03. Presumption Working for Compensation. Any time a person is doing work for another person other than a family member, there is a rebuttable presumption that the work is being done for compensation. For the purposes of this section family means a member of the immediate family which includes spouse, children, parent, brother, sister, father-in-law, mother-in-law, grandmother, grandfather or legal guardian. SECTION 2. SEVERABILITY. If any section, or any sentence, paragraph, phrase, or word of this ordinance is for any reason held to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance, and it shall be construed to have been the legislative intent to pass the ordinance without such unconstitutional, invalid or inoperative part. SECTION 3. EFFECTIVE DATE. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 24 day of M a .y 1994 . law. BUILDING CONTRACTOR Limited to construction and remodeling of commercial buildings or multiple -dwelling residential buildings, not exceeding three stories in height. RESIDENTIAL CONTRACTOR Limited to construction, remodeling, repair or improvement of one, two or three-family residences not exceeding two stories in height. MASTER ELECTRICIAN (Also Commercial Elect., Electrical Cont.) Those who have the knowledge and skill to install, repair, alter, add to or change any electrical wires, fixtures, appliances, apparatus, raceways, conduit or any part thereof; which generates, transmits transforms or utilizes electrical energy in any form for light, heat, power or communications. JOURNEYMAN ELECTRICIAN Those qualified to perform work in the electrical trades while employed or supervised by a master electrician � A% • .,�..D�n kmso ommerctat Flumber, Plumbing Contractor) Those who have the knowledge and skill to install, maintain, repair, alter or extend plumbing, septic tanks, water supply systems, storm sewer and all fixtures; appliances; appurtenances, apparatus or equipment used in connection therewith, inside of; or attached to, any building, lot or. premises. MASTER PLUMBER WITII GAS Those who are qualified to perform the work of a master plumber, and also install, maintain or repair gas piping, appliances, lines, laterals, tanks and other appurtenances in connection therewith. JOURNEYMAN PLUMBER Those qualified to perform work in the plumbing trades while employed or supervised by a master plumber. Those qualified to install, repair, alter, extend or design; central air conditioning, refrigeration, heating and ventilating, including ductwork and unfired pressure vessel systems, lift stations, gasoline tanks and pumps, fire sprinkler systems, fuel trans- mission lines, and all appurtenances, apparatus or equipment used in connection therewith. AIR CONDITIONING CLASS "A" (Also HARV "A") Those who are qualified to install, maintain, repair, fabricate, alter of extend; central air conditioning, refrigeration, heating and ventilating, including ductwork within i complete system unlimited in horsepower or tons, and all appurtenances, apparatus, piping vessels, ducts and insulation used in connection therewith. AIR CONDITIONING CLASS "B" (Also HARV "B") Those who are qualified to install, maintain, repair, fabricate, alter of extend; central air conditioning, refrigeration, heating and ventilating, including ductwork within a complete system limited to twenty-five tons cooling and five hundred thousand BTU heating, and all appurtenances, apparatus, piping vessels, ducts and insulation used 0n connection therewith. AIR CONDITIONING CLASS "C" (Also HARV "C", A/C Service) Those whose business is limited to servicing of air conditioning, heating or refrig- eration systems, including duct alterations on those systems. Those who are qualified to install; repair, alter or extend•any system of air conditioning and warm air heating and ventilation, unlimited in horsepower or tons, including any or all duct systems necessary to make complete and air conditioning system. HARV Those who are qualified to install, maintain, repair, alter or extend air conditioning, refrigeration, heating, ventilation, unlimited in horsepower or tons, including all duct systems, boiler and unfired pressure vessels systems, solarheating andcoohng systems and all appurtenances, apparatus or equipment used in connection therewith, also piping, duct work, insulation of pipes, vessels and ducts. JOURNEYMAN HARV.(Also Mechanical or Air Conditioning Journeyman) Those who are qualified to install, maintain, repair, fabricate, alter or extend; central air conditioning, refrigeration, heating and ventilating, including ductwork and all appurtenances, apparatus, piping vessels, ducts and insulation used in connection therewith while employed or supervised by an Air Conditioning Contractor. GENERAL ENGINEERING CONTRACTOR (CLASS I) Those who are qualified to do work such as , but not limited to: harbors, docks, excavating, filling and grading, pile driving, levees, pumping stations, and similar types of work in conjunction with waterpower, water control, waterworks and water supply, paving and sidewalks, curbs and gutter, streets and roads, bridges and overpasses and underpasses in streets, roads and public thoroughfares, underground sewage collection and disposal systems, bulkheading and underground utility line construction, both sanitay and storm sewer systems and similar work. Those who are qualified to install,. repair, alter.or extend any system of -air conditioning and warm air heating and ventilation in connection therewith, not to exceed five (5) tons cooling capacity per unit, including any and all duct systems necessary to make complete an air conditioning system serving one, two or three-family residences, not exceeding two stories in height. Those who are qualified to install, maintain or repair completely self-contained air-cooled air conditioning units, up to and including 3 tons cooling capacity, installed on or through an exterior wall or window and called a room air conditioning unit. This contractor shall not install any ductwork except wall sleeves attached to the unit. Any electrical installation will be performed by a licensed electrical contractor. ALUMINUM CONTRACTOR Those who are qualified to fabricate, install, maintain, repair, alter or extend accessories such as metal siding, soffits, gutters, awnings and prefabricated rooms. Those who are qualified to fabricate, install, maintain, repair, alter or extend accessories such as metal siding, soffits, gutters, awnings and prefabricated rooms. These contractors may form, place reinforcing steel and miscellaneous steel and pour, place and finish concrete incidental to an alu- minum accessory structure only, on grade only. ASPHALT SEALING & COATING CONTRACTOR Those who are qualified to coat an existing asphaltic paving material with a sealer, which may be applied by squeegee, broom or mechanical applicator. Those who are qualified to install, repair and service boilers and boiler piping, including the boiler auxiliary equipment, controls and actuated machinery and dryerrolls, but excluding comfort heating systems. BURGLAR ALARM CONTRACTOR (Also Burglar Alarm Limited) Those who are qualified to install, maintain, repair, alter or extend burglar alarm systems. Any electrical installation will be performed by a licensed electrical contractor. BURGLAR AND FIRE ALARM CONTRACTOR Those who are qualified to install, maintain, repair, alter or extend burglar and fire alarm systems. Any electrical installation will be performed by a licensed electrical contractor. CARPENTRY CONTRACTOR Those who have the knowledge and skill to install any wood products in a building including, but not limited to, rough framing, structural and nonstructural, trusses, sheathing, and the work of the finish carpentry Contractor. FINISH CARPENTRY CONTRACTOR Those who have the knowledge -and skill to install finish wood products -including paneling, trim cabinetry, doors, windows (including metal) and all hardware incidental thereto. Those who are qualified to install, maintain, repair, alter or extend wiring, apparatus, circuits, and equipment operating at less than 50 volts, raceways, conduit for private telephone, intercom and public address systems. This contractor may connect to an existing power circuit beyond the last overcurrent device, but may not install burglar and fire alarm systems. Those who are qualified to batch and mix aggregates, cement and water to agreed specifications, to construct forms and framework for the casting and shaping of concrete, to place miscellaneous embedded steel and to pour, place and finish concrete. Those who are qualified to pour, place and finish concrete flatwork (floors, slab on grade, sidewalks, etc.) including placement of mesh reinforcement, plastic vapor barriers and edge forms incidental thereto. I hose who are qualified to demolish and remove structures, such as dwellings, commercial buildings and foundations. Those who are qualified to operate hydraulic dredging equipment that digs material and removes material by pump and places pumped material to a fill area in one operation. Those who are qualified to install gypsum drywall products to woad and metal studs, wood and steel joists and metal runners in buildings of unlimited area and height. The scope of the work shall include the preparation of the surface over which the drywall product is to be applied, including the placing of metal studs and runners and all necessary trim. DRYWALL, LATH AND PLASTER CONTRACTOR Those who are qualified to do the work of the plastering contractor and the drywall contractor. Those who are qualified to install, maintain, repair, alter or extend any elevator, dumbwaiter or escalator. Those who are qualified to excavate or remove materials such as rock, gravel and sand to construct or excavate canals, lakes and levees, including the clearing of land of surface debris; and vegetation, the grubbing of roots, the removal of debris; and leveling of the surface lands incidental thereto. Those who are qualified to install, maintain, repair, alter or extend fire alarm systems. Any electrical installation will be performed by a licensed electrical contractor. Those who are qualified to install, maintain, repair, alter or extend all piping for fire sprinkler systems, tincluding the connection to the fire water service outlet provided for e sprinkler systems. GAS CONTRACTOR (Also Gas Fitter, Master Gas, Gas Installer) Those who are qualified to install, maintain, repair, alter orextend gas piping, appliances, gas mains, lines, laterals, tanks and other appurtenances in connection therewith. Those who are qualified to install, maintain, repair, alter or extend gas piping, appliances, gas mains, lines, laterals, tanks and other appurtenances in connection therewith while employed or supervised by a master gas fitter or a gas contractor. Those who are qualified to install, maintain, repair, alter or extend any system used for the storage and dispensing of gasoline, kerosene, diesel oils and similar liquid hydrocarbon fuels or mixtures to be used solely in connection with gasoline filling stations dispensing fuel to mobile vehicles or marine equipment provided, however, that bulk plants shall not be a part of the scope of such work. Those who are qualified to select, cut, assemble and install all makes and kinds of glass and glass work and execute the glazing frames, panels, sash and door and holding metal frames, ornamental decorations, mirrors, tub and shower enclosures. Those who are qualified to use and maintain pressure equipment, mix materials and apply according to building codes. Those who are qualified and who have the experience and skill to excavate -for and construct, alter, repair and maintain transmission and distribution lines for liquid or gaseous fuels under pressure in welded pipes, valves, meters and similar components incidental thereto. INSULATION CONTRACTOR, all types Those who are qualified to install, maintain, repair, alter or extend any insulation primarily installed to prevent loss or gain of heat from internal or external sources in pipes, vessels, ducts or built-up refrigerated boxes or rooms, or acoustical materials. INSULATION CONTRACTOR, buildings Those who are qualified to install, maintain, repair, alter or extend any insulation primarily installed to prevent loss or gain of heat from rooms or buildings. IRRIGATION SPRINKLER CONTRACTOR (Also Lawn Sprinkler) Those who are qualified to install, maintain, repair, alter or extend all piping and sprinkler heads for the irrigation of lawns, including the connection to a water pump. Those who are qualified to apply and affix wood, gypsum or metal lath or any otherproduct prepared or manufactured to provide key or suction bases for the support of plaster coatings, to provide hangers, channels and other material in such a manner that under an agreed specification, acceptable lathing can be executed and installed, including the channel iron work for the support of metal or other fire resistive lath on walls, ceilings or soffits, or for solid plaster partitions. This does not include any plaster work. LIGHTNING PROTECTION SYSTEMS CONTRACTOR Those who are qualified to install, maintain, repair or alter any lightning protection system, including all terminals, conductors, ground rods, fittings and all other system fastenings, connections and bonding necessary to complete a system .designed to protect structures and open spaces. Any electrical installations will be performed by a licensed master electrician or electrical contractor. Those who are qualified to install, maintain, repair, alter, or extend liquefied petroleum gas piping, appliances, gas mains, lines, laterals, tanks, regulators, meters and other appurtenances and para- phernalia in connection therewith, including wall and central heating units and any building or structure or on any premises, public or private. Those who are qualified with the experience and skill to construct seawalls, bulkheads, revetments, docks, piers, wharfs, groins and other marine structures, including pile driving. Those who are qualified to select, cut and lay brick and concrete block or any other unit masonry products, lay brick and other baked clay products, rough cut and dress stone, artificial stone and precast blocks, structural glass brick or block, but shall not pour or finish concrete. Those who are qualified to do the work of a masonry contractor and to pour, place and finish concrete flatwork (floors, sidewalks, etc.) including placement of mesh reinforcement, vapor barriers and edge forms incidental thereto. OVERHEAD UTILITIES CONTRACTOR Those who are qualified to install wood or reinforced concrete poles, cross arms, fastening devices and overhead transmission lines. Those who are qualified to use spraying equipment as well as hand tools to finish both exterior and interior work. A painting contractor may do paperhanging, sandblasting, waterproofing and may clean and finish roofs. PAVING CONTRACTOR, COMMERCIAL (Unlimited) Those who are qualified with the experience and skill to construct roads, airport runways and aprons, parking lots, sidewalks, curbs and gutters, property line walls, storm drainage facilities and to perform the excavating, clearing and grading incidental thereto. PAVING CONTRACTOR, RESIDENTIAL Those who are qualified with the experience and skill to construct driveways, sidewalks and patios using portland cement concrete or asphaltic concrete over shell or rock base course. Those who are qualified with the experience and skill to drive piling, including sheet piling, and constructing foundations, including the excavating, forming and placing of reinforcing steel and concrete and performing other work incidental thereto. PIPEFITTER CONTRACTOR (Also Pipefitter Master) Those who are qualified to install piping for central air conditioning, refrigeration, and heating, piping to boilers and unfired pressure vessel systems, lift station equipment and piping, insulation for pipes, pressure and process piping, pneumatic control piping, piping to fuel tanks and pump installations, installation of oil tanks, fire sprinkler systems and standpipes, air piping, vacuum line piping, oxygen lines, nitrous oxide piping, ink and chemical lines, and condensate drain piping. PIPEF=R JOURNEYMAN Those who are qualified to perform pipefitting work while employed or supervised by a pipefitting or mechanical contractor. PLASTERING CONTRACTOR (Also Lath & Plaster, Plastering & Stucco) Those who are qualified to coat surfaces with a mixture of sand or other aggregate gypsum plaster, portland cement or quick -lime and water, or any combination of such material as to create a per- manent surface coating. Such contractor may apply and affix gypsum or metal lath or any other product prepared or manufactured, including the placing of metal studs and runners to which lath is to be applied, to provide key or suction bases for the support of the plaster coating. Those who are qualified to proportion and apply concrete to surfaces by pneumatic methods, chip loose concrete, sandblast and clean reinforcing, batch and proportion cement, sand and water, to erect forms and formwork to which concrete is to be applied pneumatically and place miscellaneous reinforcing for repair of concrete and to proportion and place cement and intergrout by pneumatic pumping methods that under an agreed specification subsurface load bearing capacities can be stabilized or previously settled structures raised or restored to plumb, grade or alignment. Those who are qualified to install, maintain, repair, alter or extend any systems of piping, tubing, vessels, containers, pumps, apparatus, and appurtenances, in connection with such pressure piping used for circulation, transporting, holding or processing of any gas, vapor, fluid, liquid, semi-liquid or any combination thereof, provided however, that boilers, boiler piping, piping used to convey potable water, sanitary sewage, liquefied petroleum, manufactured or natural gas or refrigeration, air conditioning and comfort heating piping shall not be part of the scope of such work. Those who are qualified to erect structural precast concrete units such as decks, beams, girders, walls, columns and stairs that are or may be used as structural members for buildings and structures, including welding and rigging in connection therewith and to erect precast concrete units for guard rails and decorative panels above the ground floor, including such minor field fabrication as may be necessary. Those who are qualified to install, maintain, repair or alter any system of refrigeration unlimited to tons or horsepower provided, however, that such refrigeration is intended to be used for the purpose of food and product preservation and is not to be used for comfort systems. Those who are qualified to fabricate, place and tie steel reinforcing bars (rods) of any profile, perimeter, or cross-section, that are or may be used to reinforce concrete buildings or structures in such a manner that under all agreed specification, steel reinforcing bars (rods) for concrete buildings and structures can be fabricated, placed and tied. Those who are qualified and certified to erect, construct, fabricate and install roof decks of portland cement or gypsum concrete, using lightweight aggregate, on joists or other supporting members erected by others, and shall include the placing of forms and welding of supporting members for forms and miscellaneous reinforcing of the deck and the proportioning, mixing and placing of cement, aggregate and water, provided, however, that roof decks of wood, metal, heavy aggregate concrete, glass or plastic and the application of roofing felts or other water resistant membranes shall not be a part of the scope of such work, Those who are qualified to install, repair and replace residential steep roof coverings. Work may include fabrication and installation of sheet metal incidental to residential steep roof coverings and installation of asphalt shingles, asphalt roll roofing materials, clay tile, concrete tile, slate, wood shake or shingles and other prefabricated shingle products. Those who are qualified to install, repair and replace roof covering. Work may include, but shall not be limited to roof deck insulation, roof coating, painting and covering, including use of sheet metal and installation of other sheet metal products incidental to roofing work or other material in connection therewith, or any combination thereof, and including installation of non-structural decking and siding, Those who are qualified with experience and skill to install, repair, alter, extend and excavate for septic tanks, interceptor tanks; may clean sewer lines, but shall not include any other plumbing work or connecting pipes or pumps. Those who are qualified to manufacture, assemble, cast, cut, shape, forge, fabricate; weld, repair; recondition, adjust and install sheet rolled metal of any kind or combination and all other air4eyor systems and air handling systems, regardless of materials used, including all equipment and all reinforcements in connection therewith. SIGN CONTRACTOR, ELECTRICAL Those who are qualified to install, repair, alter, add to, or change any electrical wires, apparatus, raceways, conduit or any pan thereof on electrical signs and is qualified to erect signs. Such contractor may contract for, and take out building permits for the erection of signs. SIGN CONTRACTOR, NON -ELECTRICAL Those who are qualified to install, repair, add to or change non -electrical signs according to the building code. 1 nose who are qualified to install, repair, alter, add to, or change any electrical wires; apparatus,raceways, conduit or any part thereof on electrical signs. Such contractor may not erect signs. SOLAR HEATER INSTALLATION CONTRACTOR Those who have the knowledge to install, alter, repair or replace any solar hot water heating system of residences or for swimming pools, including collectors, storage and ezpansioi tanks, heat exchangers, piping, valves, pumps, sensors, low voltage controls which connect toexisdng plumbing and electrical stub -outs. STRUCTURAL STEEL CONTRACTOR Those who are qualified to erect structural steel shapes and plates, including stick tnnor field fabrication as may be necessary, of any profile, perimeter, or cross-section, that are or tray be used as structural members for buildings and structures, including riveting, welding and ridging, only in connection therewith. SWIMMING POOL CONTRACTOR, COMMERCIAL Those who are qualified to excavate, construct, fabricate, install and equip all switnibing pools, including the pumps, "Pool heaters, solar pool heaters, filters and chlorinators, and that piping incidental to the recirculating system, and may do the slab incidental to the pool. '•• ••'IMIJIDIS Those who are qualified to excavate, construct, fabricate, install and equip residential swimming pools, including the pumps, pool heaters, solar pool heaters, filters and chlorinators, and that piping incidental to the recirculating system, and may do the slab incidental to the pool.
