HomeMy WebLinkAbout1994-174 / 4 / 94 (parking _ dock Ow ORDINANCE 94- 17 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY AMENDING SECTIONS 307.04 AND 307.06 OF THE INDIAN RIVER COUNTY CODE TO PLACE ADDITIONAL RESTRICTIONS ON COUNTY PARKING FACILITIES. WHEREAS, the County has limited regulations with respect to the use of county owned or leased parking areas; and WHEREAS, the need for additional and specific regulations is necessary due to recent construction, in particular, the new courthouse parking garage, NOW THEREFORE BE IT ORDAINED BY THE B ARD F COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, that: SECTION 1. AMENDMENT . Sections 307.04 and 307.06 of the Code of Ordinances of Indian River County is amended to read as set forth in Appendix "A" to this ordinance. SECTION 2. SEVERABILITY. If any section, or any sentence, paragraph, phrase, or word of this ordinance is for any reason held to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance, and it shall be construed to have been the legislative intent to pass the ordinance without such unconstitutional, invalid or inoperative part. SECTION 3. EFFECTIVE DATE. This ordinance shall become effective upon becoming law. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 24 day of M a _y , 19940 on the 9 day of Mme, 1994, for a public hearing to be held on the 24 day of M A y 1994 , at which time it was moved for adoption by Commissioner Arl? m S , seconded by Commissioner Eggert and adopted by the following vote Chairman John W. Regulation of parking in parking areas located on property owned or leased by Indian River County, Florida. The board of county commissioners may regulate parking, in county rights-of-way, county easements, and parking areas located on property owned or leased by the county, whether or not such areas are located within the boundaries of chartered municipalities, by posting parking regulations. Nothing in this section shall be construed as prohibiting parking in approved driveways that may be located in county rights-of-way or as regulating private roads. is hereby amended to read as follows Section 307.04. Regulation of County owned or leased parking areas, sidewalks, and areas contiguous to said parking areas. (1) The board of county commissioners may regulate parking, in county rights-of-way, county easements, and parking areas located on property owned or leased by the county, whether or not such areas are located within the boundaries of chartered municipalities, by posting parking regulations. Nothing in this section shall be construed as prohibiting parking in approved driveways that may be located in county rights-of-way or as regulating private roads. (2) The use of any County off-street parking facilities is restricted to motor vehicles being operated at the time of parking for the operator or passenger to use the County facility served by the off-street parking facility, provided, however, that no motor vehicle not otherwise restricted from parking in such facilities shall be permitted to park therein if the gross weight of such vehicles shall exceed 2 tons or the length of such vehicle shall exceed 20 feet at such vehicle's longest point or the width of such vehicle shall exceed 7 feet at such vehicle's widest point. (3) No person shall at any time operate a vehicle in any County off-street parking facility for any purpose other than parking purposes and the necessary driving in such facility required of the operator of any vehicle in entering and leaving such facility in connection with the use of the facility as a parking area. (4) No person shall at any time park any vehicle in any County off-street parking facility in other than those areas specifically designated by markings, signs, or other devices as areas where parking is permitted. (5) No person shall 'at any time park any motor vehicle in any designated parking place in a County off-street parking facility in such a manner that the rear of such vehicle shall extend more than 20 feet from the curb, mark, or sign designating the front limit of such parking space . (6) When an area is marked for parking spaces, a vehicle parked in that area shall only be parked within the lines delineated as a parking space. No vehicle shall extend over any lines marked for parking. Any space marked or sign erected for angle parking shall be observed by the motor vehicle being parked with the front wheel against the curb or barrier. (7) No driver of any vehicle in any lane marked for traffic movements in a County off-street parking facility shall turn such vehicle so as to proceed in the opposite direction in the same lane. - 5 - Section 307.04 follows which currently reads as Section 307.04. (9) No person shall drive a vehicle in any County off-street parking facility at a greater speed than is reasonable and prudent under the conditions then existing. Where no special hazard exists, a speed of 10 miles per hour shall be lawful, but any speed in excess of such speed limit shall be unlawful. (10) The driver of any vehicle in a County off-street parking facility shall at all times be subject to all traffic regulations and ordinances of the County and also subject to Florida Uniform Traffic Control Law, as if such facility were a County road. (11) It shall be unlawful for any person to skateboard, roller blade, roller skate, ride a bicycle, or use any similar contrivance in a County off-street parking facility, or on any sidewalk or area contiguous to said off-street parking facility. Section 307.06 is amended by the addition of paragraph (3) to read as follows (3) The provision of Section 307.04 may be enforced by municipal authorities in their jurisdiction in the same manner as is used to enforce other parking laws and ordinances by said municipal authority.
