HomeMy WebLinkAbout1994-14ORDINANCE NO. 94-14 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ;ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM MED TO OCR, FOR THE PROPERTY LOCATED ON THE NORTH SIDE OF 37TH STREET, APPROXIMATELY 167 FEET WEST OF THE INTERSECTION OF 37TH STREET AND INDIAN RIVER BOULEVARD, AND DESCRIBED HEREIN, AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property, and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard, NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit: A PARCEL OF LAND LYING IN SECTION 25, TOWNSHIP 32 SOUTH, RANGE 39 EAST, INDIAN RIVER COUNTY, FLORIDA DESCRIBED AS FOLLOWS: BEGIN AT THE INTERSECTION OF THE NORTH -SOUTH QUARTER SECTION LINE OF SAID SECTION 25 AND THE NORTH RIGHT-OF-WAY LINE OF 37TH STREET (A 110.00 FOOT RIGHT-OF-WAY); THENCE N OOo01'22" W, ALONG SAID QUARTER SECTION LINE, A DISTANCE OF 608.13 FEET, THENCE N 89042'39" E, A DISTANCE OF 248.57 FEET, TO THE SOUTHWESTERLY RIGHT-OF-WAY LINE OF INDIAN RIVER BOULEVARD (A 200.00 FOOT RIGHT-OF-WAY); THENCE S 44056'05" E, ALONG SAID RIGHT-OF-WAY LINE, A DISTANCE OF 620.55 FEET; THENCE S OOo01'22" E, A DISTANCE OF 167.00 FEET, TO A POINT ON THE AFOREMENTIONED NORTH RIGHT-OF-WAY LINE OF 37TH STREET; THENCE S 89044'30" W, ALONG SAID RIGHT-OF-WAY LINE, A DISTANCE OF 686.69 FEET, TO THE POINT -OF -BEGINNING. CONTAINING 7.369 ACRES, MORE OR LESS. Be changed from MED to OCR. All with the meaning and intent and as set forth and described in County Land Development Regulations. i ORDINANCE NO. 94-14 Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 24th day of May, 1994. This ordinance was advertised in the Vero Beach Press -Journal on the 4th day of May, 1994 for a public hearing to be held on the 24th day of May, 1994 at which time it was moved for adoption by Commissioner Adams seconded by Commissioner Eggert and adopted by the following vote: Chairman John W.
