IN OBTAINING AN URBAN FORESTER FOR ONE YEAR, CONTINGENT ON THE
PARTICIPATION OF THE CITY OF VERO BEACH. THE ATTORNEY WAS INSTRUCTED
TO DELIVER THE RESOLUTION TO THE CITY COUNCIL"

- WHEREAS, by the terms of Chapter 71-183 Laws of Florida, IP71,
Indian River County is authorized to appropriate funds and to enter into
cooperative agreements with the Department of Agriculture and Consum-
er Services, Division of Forestry, and
WHEREAS, said Deparment is.authorized to provide forest rela-
ted assistance to counties and muncipalities, and
WHEREAS, the Board of County Commissioners of Indian Ri er
County has determined that it is to the best interests of the count :•
to stimulate production of timber wealth and to provide for the pro-
tection and improvement of the beauty of urban and suburban areas, and
WHEREAS, the City Council of the City of Vero Beach, Florida,
has expressed similar desires for the City of Fero Beach, Florida,
and
WHEREAS, it is to the best interest of Indian River Count-. Flori-
da, and the City of Vero Beach, Florida, to cooperate in obtaining the
services of a Forester and sharing the expense.
NOW THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Indian River County, that*upon the passage of a
resolution by the City Council of the City of Vero Beach, Florida,
agreeing to enter into cooperative agreements, with Indian River County,
and the State Division of Forestry and agreeing to share one-half of
the expense in obtaining and paying a forester, not to exceed 51500. 00
per year, that the Chairman of the Board of County Commissioners,
is authorized to sign on behalf of the Board of County Commission-
ers the required documents to obtain a Forester. The Chairman
may commit Indian River County up to $1500. 00 per year from
general revenue funds for such purpose.

USE IT, BUT IT SHOULD BE UNDERSTOOD THAT THERE ARE COUNTY PROJECTS

RESOLUTION No. 73-35
WHEREAS, ARNOLD'RA,1:OS, District Engineer, Fourth District,
Florida State Department of Transportation, has submitted his
resignation to the Department of -Transportation, and
WHEREAS, ARNOLD RAMOS, during his tenure as District Engineer,
from 1968 to the present, has set a high standard of excellence .in
performance; has shown his devotion to creating a workable highway
system within Indian River County; and has shown great sensitivity
to public needs and desires, and
WHEREAS, ARNOLD RAMOS, has always endeavored to maintain a
close working relationship with this Board, and.
WHEREAS, this Board acknowledges that the responsibilities and
recognition that came to him during his employment with the Department
of Transportation were a result of his superior ability and the
confidence this Board and the Department of Transportation placed in
him and his resignation will leave a voice that will not be•easily.
replaced, and
WHEREAS, many road projects of major importance were constructed
in Indian River County, with his help and cooperation, and
WHEREAS, this Board wishes to publicly acknowledge its appre-
ciation of his cooperation and hard work for this County;

ORDINANCE NO. 73-7
An ordinance assessing an additional $1.00 as court
costs in all criminal convictions in County and Circuit
Courts in Indian River County, Florida, pursuant to
the provisions of Section 23. 105, Florida Statutes, and
providing an effective date.
BE IT ORDAINED BY THE .BOARD OF COUNTY COMMISS-
IONERS OF INDIAN RIVER COUNTY, FLORIDA:
Section 1. Every County and Circuit Court in Indian River
County, Florida created by the Constitution of Florida or by Legis-
lative Act shall assess $1.00 in addition to the $1.00 assessed by
Section 23. 103, Florida Statutes, as a court cost against every per-
son convicted for .violation of a state penal or criminal statute or
convicted for violation of a municipal or county ordinance. In
addition, $1. 00 from every bond estreature or forfeited bail bond
related to such penal statutes or penal ordinances shall be deposited
in the General Fund of Indian River County for the purpose herein-
after provided. However, no such assessment shall be made
against any person convicted for violation of any state statute,
municipal ordinance or county ordinance relating to the parking
of vehicles. All such costs collected by the aforesaid courts shall
be deposited in the General Fund of Indian River County to be used
for law enforcement education expenditures by said County.
Section 2. This ordinance shall take effect on May 14, 1973.

INDIAN RIVER COUNTY ORDINANCE 73-8 _
AMENDING INDIAN RIVER COUNTY ORDINANCE 71-3
BE IT ORDAINED By the Board of County Commissioners of
Indian River County, Florida.,
That Indian River County Ordinance 71-3 is hereby amended
as follows:
1. Section 2. Definitions:
ESSENTIAL SERVICES: The erection, construc-
tion, alteration or maintenance, by public utilities companies or muni-
cipal or other governmental agencies, of underground or overhead gas,
electrical, steam or water transmission or distribution systems, in -
eluding poles, wires, mains, drains, sewers, pipes, conduits, cables.,
fire alarm boxes, police call boxes, traffic signals, hydrants and
other similar equipment and accessories or buildings housing such .
equipment, in connection therewith, reasonably necessary for the furn-
ishing of adequate service by such public utilities or municipal or other
governmental agencies or for -the` public health or safety or general
welfare.
2. Section 3. Districts and Boundaries Thereof:
• PARAGRAPH E, except as hereafter provided:

heretofore defined, shall be erected, constructed, reconstructed, or
structurally altered, nor shall any structure or land or combination
thereof, e except essential

structure and/or land is to be put is listed in the USES PERMITTED

structure, land and/or use fully complies with all of the applicable
district regulations, except as allowed under Paragraph J, Section
25, General Provisions.
3. Section 25. Paragraph R:
ESSENTIAL SERVICES: Essential services
shall be permitted in any district, as authorized and regulated by law
and resolutions of Indian River County, it being the intention hereof

to exempt such essential services from the application of this
ordinance .except that all buildings or structures to be located in
Residential Districts shall be subject to Site Plan Approval.
This Ordinance shall take effect on May 9, 1973.

AT THE REGULAR MEETING OF THE COUNTY COMMISSIONERS ON
APRIL 18. 1973 A PUBLIC HEARING WAS HELD REGARDING VISTA PROPERTIES,
INC OBTAINING A COUNTY SEWER AND WATER FRANCHISE. THE BOARD WAS
INFORMED THAT ECOLOGICAL UTILITIES, INC. HAS AN EXCLUSIVE FRANCHISE
IN THAT AREAL IT WAS THE BOARDS OPINION THAT ECOLOGICAL UTILITIES,
INC. AND VISTA PROPERTIES, INC. WORK OUT A SOLUTION TO THIS PROBLEM
AND APPROVED A CONTINUATION OF THIS PUBLIC HEARING UNTIL MAY 9,1973.
.JOHN CALMES, REPRESENTING VISTA PROPERTIES, INC.AND
G. KENDALL SHARP, ATTORNEY AND STEVE LEDERER REPRESENTING ECOLOGICAL
UTILITIES, INC., APPEARED AND MR. CALMES INFORMED THE BOARD THAT
VISTA PROPERTIES, INC. WILL CONSTRUCT A SEWER AND WATER TREATMENT
PLANT AND WHEN THIS PLANT IS COMPLETED IT WILL BE TURNED OVER
TO ECOLOGICAL.UTILITIES, INC. AT THIS TIME THE AGREEMENT BETWEEN
VISTA PROPERTIES, INC. AND ECOLOGICAL UTILITIES,INC. HAS NOT BEEN
SIGNED.
THE ATTORNEY INFORMED THE BOARD THAT IF THIS AGREEMENT
IS SIGNED, THE COUNTY WILL HAVE TO BUY THIS SYSTEM FROM ECOLOGICAL
UTILITIES, INC. WHEN THE COUNTY COMES THROUGH WITH ITS SEWER AND WATER
SYSTEMS THE ATTORNEY STATED IF WE WANT THIS SYSTEM, WE SHOULD GET IT
NOW. IT WAS SUGGESTED THAT THE COUNTY INVESTIGATE THE POSSIBILITY.
OF BUYING OUT THE COUNTY'S FRANCHISE WITH ECOLOGICAL UTILITIES. INC.
THE BOARD REQUESTED VISTA PROPERTIES, INC. DELAY SIGNING
THIS AGREEMENT:WITH ECOLOGICAL'UTILITIES, INC. FOR 30 DAYS, MR.
CALMES STATED VISTA PROPERTIES, INC. WOULD GO ALONG WITH THE BOARD S
REQUEST.
ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER
DRITENBAS, THE BOARD UNANIMOUSLY AUTHORIZED THE COUNTY CONSULTING
ENGINEERS TO PROCEED IMMEDIATELY ON AN EVALUATION AND APPRAISAL OF
INDIAN RIVER COUNTY'S FRANCHISE WITH ECOLOGICAL UTILITIES, INC. AND
RETURN WITH THIS INFORMATION. THE BOARD ALSO APPROVED A CONTINUATION
OF THIS PUBLIC HEARING UNTIL MAY 23, 1973.
MRS. ABBATIELLO AND GEORGE BULTEZ REPRESENTING THE ROCK
RIDGE PROPERTY OWNERS ASSOCIATION APPEARED TO INFORM THE BOARD
THAT SINCE THE ADOPTION OF A COUNTY ORDINANCE CREATING A SPECIAL
PURPOSE DISTRICT KNOWN AS THE "ROCK RIDGE STREET LIGHTING DISTRICT"
THEY HAVE NOT RECEIVED ANY STREET LIGHTS, AND REQUESTED THE BOARDS
ASSISTANCE. THE ATTORNEY STATED THAT HE HAD TELEPHONED THE CITY
UTILITY DEPARTMENT AND HE WAS INFORMED THAT THERE IS A SHORTAGE
