HomeMy WebLinkAbout2005-026ORDINANCE 2005- 026 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AMENDING CODE SECTION 102.01: BOARD OF COUNTY COMMISSIONERS MEETINGS AND PROCEDURES, ELIMINATING THE REQUIREMENT TO HAVE ONE NIGHT TIME MEETING PER MONTH, PROVIDING FOR CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, Ordinances 90-19, • 2000-002 and 2004-023 established and amended procedures for meetings for the Indian River County Board of Commissioners; and WHEREAS, the Commission formerly held its regular meeting every Tuesday morning, except the last Tuesday of the month; and WHEREAS, in order to attempt to increase citizen attendance and involvement at Commission meetings, the Commission decided to amend the code to provide for one night meeting time each month; and WHEREAS, the Board and staff have noticed that citizen attendance and involvement did not appreciably increase at meetings held during the evening hours; and WHEREAS, the Board recognizes that it is a hardship for some citizens to attend Commission meetings held in the morning, but the Board has observed that morning meetings are well attended by the public and interested parties; N OW THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Indian River County, that section 102.01.1 of the Indian River Code is hereby amended as follows: S ECTION 1. AMENDMENT. S ection 102.01.1 of the Indian River County Code is hereby amended to read as follows: S ection 102.01.1 Board of county commissioners meetings and procedures. 1. Time. The county commission shall generally hold regular meetings on Tuesday beginning at 9:00 a.m. except for the second Tuesday of each month the regular meeting will begin at 6:00 pm. When the day fixed for any regular meeting of the commission is a holiday recognized by the county the meeting shall be held at the same time on the next Tuesday not a holiday unless the meeting is cancelled otherwise rescheduled by the commission. S ECTION 2. CODIFICATION. It is the intention of the Board of County Commissioners that the provisions of this ordinance shall become and be made a part of the Indian River County Code and the word "ordinance" may be changed to "section," "article," or other appropriate word or phrase and the sections of this Ordinance may be renumbered or relettered to accomplish such intention; providing, however, that Sections 2, 3 and 4 shall not be codified. S ECTION 3. SEVERABILITY. If any section, or any sentence, paragraph, phrase, or word of this ordinance is for any reason held to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance, and it shall be construed to have been the legislative intent to pass the ordinance without such unconstitutional, invalid or inoperative part. S ECTION 4. EFFECTIVE DATE This ordinance shall take effect upon filing with the Florida Secretary of State. This ordinance was advertised in the Press Journal on the 5th day of August, 2005, for a public hearing on 16th day of August, 2005, at which time it was moved for adoption by Commissioner Neuberger , and seconded by Commissioner Bowden , and adopted by the following vote: Chairman Vice Chairman Commissioner Commissioner Commissioner Thomas S.
