AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA, AMENDING INDIAN RIVER COUNTY
CODE SECTION 102.04 "ORDER OF BUSINESS"
TO ADD "INFORMATIONAL ITEMS FROM STAFF
OR COMMISSIONERS NOT REQUIRING BOARD
ACTION"; PROVIDING FOR CODIFICATION,
P ROVIDING FOR SEVERABILITY; AND
P ROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners has been
empowered by Florida Statute 125 01(1)(a) to adopt rules of procedure; and
WHEREAS, the Board of County Commissioners has by ordinance
set the order of business appearing on its regular meeting agenda at Code
section 102.04; and
WHEREAS, the Board of County Commissioners has conducted a
public hearing on its proposal to add "Informational Items" to its agenda order of
business,
N OW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA:
S ECTION 1. AMENDMENT.
Indian River County Code section 102.04, Order of business, is
hereby amended to read as follows:

SECTION 2. CODIFICATION.
It is the intention of the Board of County Commissioners that the
provision of this ordinance shall become and be made part of the Indian River
County Code, and that the sections of this ordinance may be renumbered or re -
lettered and the word ordinance may be changed to section, article or such other
appropriate word or phrase in order to accomplish such intention.
SECTION 3. SEVERABILITY
If any section, sentence, clause, or phrase of this ordinance is held
to be invalid or unconstitutional by any court of competent jurisdiction, then said
holding shall in no way affect the validity of the remaining portions of this
ordinance.
SECTION 4. EFFECTIVE DATE
This ordinance shall take effect upon filing with the Florida
Department of State.

This ordinance was advertised in the Vero Beach Press -Journal on
the 29th day of February, 2008, for a public hearing to be held on the 11th day of
March, 2008, at which time it was moved for adoption by Commissioner
Wesley S Davis , seconded by Commissioner Sandra L Bowden and adopted
by the following vote:
