HomeMy WebLinkAbout2000-0072/2000ord\amend\atty0k ORDINANCE NO. 2000=007 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTION 101.06 OF THE INDIAN RIVER COUNTY CODE. WHEREAS, Section 101.06 of the Indian River County Code sets forth the duties of the County Attorney; and WHEREAS, the Board of County Commissioners has determined that a reorganization and change in employment procedures would be in the public interest; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: SECTION 1. AMENDMENT Section 101.06. The county attorney, which reads as follows. The county attorney shall be a member of the Florida Bar and shall be the legal adviser to the commission, the other board officers, boards, and departments. The county attorney shall be responsible for the administration of the county attorney's office and staff and when necessary shall hire, promote, demote, suspend, or dismiss any employee in the office of the county attorney in accordance with the personnel rules of the county. The county attorney or an assistant county attorney shall attend all county commission meetings and render such professional services as may be required by the commission or the laws of the State of Florida. The county attorney shall prepare an annual budget for the operation of the office and shall submit this budget to the administrator for inclusion in the annual county budget. is hereby amended to read as follows. The office of the County Attorney shall consist of the County Attorney, a Deputy County Attorney, and legal staff as necessary. The attorneys shall be members of The Florida Bar and shall be legal advisers to the Commission, other Board officers, departments, and such County Boards and Commissions as necessary. The County Attorney shall be hired by the Board of County Commissioners and shall be responsible for the administration of the County Attorney's Office. The County Attorney shall hire the Deputy County Attorney, with the advice and consent of the Board of County Commissioners. All attorneys hired after March 2000 shall be "at will" contract employees. The County Attorney shall hire, promote, demote, suspend, or dismiss any non -attorney employee in the office of the County Attorney in accordance with the Personnel rules of the County. The County Attorney or the Deputy County Attorney shall attend all County Commission meetings and render such professional services as may be required by the Commission or the laws of the State of Florida. The County Attorney shall prepare an annual budget for the operation of the office and shall submit this budget to the County Administrator for inclusion in the annual County budget. SECTION 2. EFFECTIVE DATE The ordinance was advertised in the Vero Beach Press Journal on the lath-. day of March 2000, for a public hearing to be held on the 21 st day of March , 2000, at which time it was moved for adoption by Commissioner Gi nn , seconded by Commissioner Stanbridge , and adopted by the following vote: Florida Secretary State.
