HomeMy WebLinkAbout2006-039ORDINANCE NO. 2006- 039 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AMENDING SECTION 101.02.1 OF THE INDIAN RIVER COUNTY CODE, TO PROVIDE FOR THE ELECTION OF A CHAIRMAN AND VICE CHAIRMAN ANNUALLY ON THE THIRD TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in the interest of more efficient operation and continuity in County leadership, the Board of County Commissioners has discussed and directed County staff to amend Section 101.02 of the Indian River County Code, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that Section 101.02, Chairman and vice chairman, of the Indian River County Code is hereby amended as follows: SECTION 1. Section 101.02, Chairman and vice chairman, is amended to read: Section 101.02. Chairman and vice chairman. 1. Election. Annually at its meeting on the third Tuesday following the first Monday in November On januar�, the board shall select from its members a chairman and a vice chairman. 2. Duties. The chairman shall preside at meetings of the commission and shall be recognized as head of the county government for service of process, ceremonial matters, and execution of contracts, deeds, and other documents. The chairman shall have no administrative duties other than those necessary to accomplish these duties and any others as may be required by Florida law. The vice chairman shall act as chairman during the absence or disability of the chairman. In the absence of the chairman and vice chairman, the remaining commissioners shall select a chairman pro tempore. SECTION 2. CODIFICATION. It is the intention of the Board of County Commissioners that the provision of this ordinance shall become and be made part of the Indian River County Code, and that the sections of this ordinance may be renumbered or re - lettered and the word ordinance may be changed to section, article or such other appropriate word or phrase in order to accomplish such intention. SECTION 3. SEVERABILITY If any section, sentence, clause, or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. SECTION 4. EFFECTIVE DATE This ordinance shall take upon filing with the Florida Department of State. This ordinance was advertised in the Vero Beach Press -Journal on the 11th day of November, 2006, for a public hearing to be held on the 21st day of November, 2006, at which time it was moved for adoption by Commissioner 0' Bryan , seconded by Commissioner Davi s and adopted by the following vote: Vice Chairman Gary C.
