AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING
SECTION 303.33 OF THE INDIAN RIVER COUNTY CODE TO PROVIDE
FOR ESTABLISHMENT OF INSPECTION FEES BY COUNTY
RESOLUTION AMENDING SECTION 303.35 OF THE INDIAN RIVER
COUNTY CODE TO PROVIDE FOR ESTABLISHMENT OF RE-
INSPECTION FEES BY COUNTY RESOLUTION PROVIDING FOR
REPEAL OF CONFLICTING PROVISIONS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF
INDIAN RIVER COUNTY; PROVIDING FOR FILING WITH THE
DEPARTMENT OF STATE; AND PROVIDING FOR AN EFFECTIVE
DATE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN
RIVER COUNTY, FLORIDA AS FOLLOWS:
WHEREAS, Part V of Chapter 303 of the Indian River County Code provides for
inspections and approval prior to the demolition of certain structures, and
WHEREAS, Section 303.33 of the Indian River County Code establishes inspection
fees to accompany applications for demolition approval; and
WHEREAS, Section 303.35 of the Indian River County Code establishes re -inspection
fees to accompany applications for demolition approval; and
WHEREAS, the Board of County Commissioners wishes to facilitate the updating of
those inspection and re -inspection fees by allowing such fees to be established by County
Resolution.
PART I. AMENDMENT TO SECTION 303.33 OF THE CODE OF INDIAN RIVER COUNTY,
FLORIDA.
SECTION 1. AMENDMENT TO SECTION 303.33 OF THE CODE.
After the effective date of this Ordinance, Section 303.33 of The Code shall be amended to
read as follows:
Section 303.33 Application For Approval And Fee.
Application for Health Department demolition approval shall be made on forms provided by
the Health Department and shall be accompanied by an inspection fee established by
County resolution, except that Indian River County and the municipalities shall be exempt
from the requirement of such fee or reinspection fee. The fee shall be as follows: a. $100

SECTION 2. AMENDMENT TO SECTION 303.35 OF THE CODE.
After the effective date of this Ordinance, Section 303.35 of The Code shall be amended to
read as follows:
Section 303.35. Re -Inspection fee.
In the event that the health department, during its initial inspection, identifies items on the site
which require removal prior to demolition, a re -inspection shall be required to verify said
removal and a re -inspection fee established by County resolution of twenty five dollars
($25.00) shall be paid to the health department by the applicant.
PART II• GENERAL PROVISIONS
SECTION 1: REPEAL OF CONFLICTING ORDINANCES. The provisions of any other
Indian River County ordinance that are inconsistent or in conflict with the provisions of this
Ordinance are repealed to the extent of such inconsistency or conflict.
SECTION 2. SEVERABILITY. It is declared to be the intent of the Board, that if any
section, subsection, sentence, clause, or provision of this Ordinance is held invalid, the
remainder of the Ordinance shall be construed as not having contained such section,
subsection, sentence, clause, or provision, and shall not be affected by such holding.
SECTION 3. INCLUSION INTO THE CODE OF ORDINANCES. It is the intent of the
Board that all of the provisions of this Ordinance shall become and be made part of the
Indian River County Code of Ordinances and that the sections of this ordinance may be
renumbered or relettered.
SECTION 4. EFFECTIVE DATE; FILING WITH DEPARTMENT OF STATE. A certified
copy of this Ordinance shall be filed with the Department of State by the Clerk to the Board
immediately after adoption of this Ordinance, and this Ordinance shall take effect on filing
with the Department of State.
This Ordinance was advertised in the Vero Beach Press Journal on the
18th day of April , 2008, for a public hearing to be held on the 29th day
of April , 2008. Following the April 29, 2008 public hearing, this Ordinance
was moved for adoption by Commissioner Peter D. O'Bryan seconded by
Commissioner Joseph E. Flescher , and adopted by the following vote:
