HomeMy WebLinkAbout2006-021i f ORDINANCE NO. 2006- 021 AN ORDINANCE OF INDIAN RIVER COUNTY FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM CG, GENERAL COMMERCIAL, TO PD, PLANNED DEVELOPMENT COMMERCIAL, FOR APPROXIMATELY 1.51 ACRES AND MODIFYING THE EXISTING PD COMMERCIAL ZONING DISTRICT, GENERALLY LOCATED AT THE SOUTHEAST CORNER OF 58TH AVENUE AND S.R. 60; PROVIDING FOR SEVERABILITY AND EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently considered this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners. of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit: A PORTION OF "A REPLAT AND ADDITION TO THE WAL-MART AT VERO BEACH", ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 15, PAGE 5, PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA. This PD zoning district shall terminate on July 18, 2009, if all conditions of the approval are not satisfied by that date. In such case, the zoning of the subject property shall revert to the PD zoning district in place prior to July 18, 2006. All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 18th day of July, 2006. A public access easement for these driveways will need to be established prior to or via the final plat. • Disaster Recovery Fueling: Generally, the fueling facility will be open to Sam's Club members only. The facility, however, will be equipped with a generator for use in emergencies, and Sam's has committed to opening the facility to the general public during the recovery stage after disasters. • 58th Avenue/SR60 Intersection Contribution: The applicant will deed land to Walgreen's without compensation for replacement parking to facilitate the 58th Avenue/SR60 intersection improvements. • The site's signage and landscaping will be upgraded to meet or exceed the SR60 Corridor plan.
