For Liberty Park, the public benefits are as follows: EMI Elementary School Site: The developer dedicated the 18.89 acre Liberty Magnet School site without compensation in advance of project consideration. In addition to the site, drainage, paving, and landscape upgrades for the school were provided by the developer. The school is now open and operational. County Park: (Ryall Park) The applicant will dedicate a 58.92 acre site at the northeast corner of 66th Avenue and 81st Street as a county park. The site will also provide stormwater treatment for the CR510 widening project. The applicant will dedicate the site with the final plat for phase 1. Prior to a certificate of completion for phase 11, the applicant will construct park improvements on the site including play fields, packing landscaping and bathrooms. The developer will also pave 81st Street from 66th Avenue to the park entrance. With the final plat, the developer will dedicate a 12 acre conservation area for native uplands and wetlands at the north end of the park. 12th Street Public Use Site: The developer will dedicate 18.90 acres at the southeast corner of 1 2th Street and 58th Avenue for public use. This parcel will be graded and grassed, and improved with access, then dedicated to the county for park or other public uses prior to or via the phase II1 final plat. Indian River Blvd Conservation Area: The developer will place conservation easements over two adjacent parcels that lie just east of Indian Rivet Blvd on the north side of 37th Street. There is a 15.64 acre parcel that is in the County and a 41.2 acre parcel in the City of Vero Beach. County staff has coordinated with the city community development director who has indicated that the proposed density transfer and conservation easement are consistent with city policies and regulations. While maintaining ownership of the parcels, the developer will place conservation easements over these two parcels that will prohibit residential use of the parcels and restrict the density to zero. The conservation easements will need to be established prior to or via the recording of the final plat phase 1 to both -Indian River Blvd sites. The developer may use the parcels as a mitigation bank. ' Breezy Village" Conservation Area: This 40.2 acre parcel is located just west of the Breezy Village mobile home par k at the west end of 99th Street. While the developer will retain ownership of and maintenance responsibilities for the parcel, the developer will establish a conservation easement over this parcel prohibiting residential use and restricting the density to zero. In addition, the site will be rezoned to PD at zero density, and the developer will remove exotics from the site to enhance the conservation area. The conservation easement will need to be established prior to or via the final plat for phase 1. The exotics must be removed prior to issuance of a certificate of completion for phase 1. F:\Community Development\Users\CurDevAORDINANCE\2008\2008-_Liberty Park Ordinanace.rtf 10 ORDINANCE NO. 2008 - Emergency Services/public use site: The developer has committed to dedicating a 4.59 acre parcel located near the southeast corner of CR510 and 66th Avenue for a fire station or other public uses. The site will need to be dedicated to the county without compensation prior to or via the final plat for phase I. Right -of -Way Dedications: The applicant will dedicate right-of-way for CR510, 66th Avenue, 70th Avenue (Powerline Road), and 74th Avenue without compensation. The rights-of-way for CR510, 66th Avenue, and 81st Street Tying cast of 66th Avenue will need to be dedicated prior to approval of the phase I preliminary PD plan, or within 90 days of notification by the county of a justifiable need (utility line relocates), whichever occur s first. The rights-of-way for the other roads will be dedicated prior to 01 via the final plat for the phase or sub -phase which includes the subject right-of-way. Street Dedications: All interior streets will be privately dedicated, but open to the public This will be reflected in the dedication language on the final plats. The major roads that run through the main site, 74th Avenue and 81st Street, will be publicly dedicated, but the landscaping installed within the right-of-way will be privately maintained. Douglas Subdivision Drainage and Pedestrian Improvements: With the Ryall Park improvements, the developer has committed to construct stormwater improvements that will serve to enhance drainage for the Douglas Subdivision which lies east of the park. A pedestrian connection from the Douglas Subdivision to the park will be made with the drainage improvements. The drainage work must be done prior to issuance of a certificate of completion for phase II. Off-site sidewalk The developer has committed to construct an off-site sidewalk along the south side of CR510 to serve the Douglas Subdivision. The sidewalk will run from 64th Avenue to 66th Avenue and be consti ucted prior to issuance of a certificate of completion for phase I.
