HomeMy WebLinkAbout2008-007ORDINANCE NO. 2008- C07 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR 1.57 ACRES LOCATED APPROXIMATELY 580 FEET WEST OF U.S 1 AND APPROXIMATELY 130 FEET SOUTH OF 13I H LANE, FROM IG, GENERAL INDUSTRIAL DISTRICT, TO CG, GENERAL COMMERCIAL DISTRICT, AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in hldian River County, Florida, to -wit: A PORTION OF LAND BEING A PART OF THE SOUTHEAST 1/4 OF THE NORTHWEST 1/4 OF SECTION 12, TOWNSHIP 33 SOUTH, RANGE 39 EAST, INDIAN RIVER COUNTY, FLORIDA AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: ALL OF LOT 3 MALL CENTER, AS SHOWN ON THE PLAT THEREOF, RECORDED PLAT BOOK 20, PAGE 83, OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA SAID PORTION OF LAND CONTAINS 64,751.621 SQUARE FEET 1.57 ACR FS, MORE OR LESS, LYING AND BEING 1N INDIAN RIVER COUNTY, FLORIDA AND SUBJECT TO EASEMENTS RESTRICTIONS AND RESERVATIONS OF RECORD Page 1 of 3 ORDI\ANCE NO. 2008- 007 SUBJECT TO EASEMENTS, RESERVATIONS, RESTRICTIONS, AND RIGHTS-OF-WAY OF RECORD. is changed from IG, General Industrial District to CG, General Commercial Disti.ict. All with the meaning and intent as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 8th day of April 2008. This ordinance was advertised in the Press -Journal on the 24th day of March 2008, for a public hearing to be held on the 8th day of April , 2008 at which time it was moved for adoption by Commissioner Gary C.
