COMMISSIONER DRITENBAS STATED THAT HE DID ATTEND THE E.P.A. THE PROPOSALS WOULD BE A STIMULUS TO DEVELOPMENT OF ADJACENT PROPERTIES, AT A TIME WHEN UTILITIES AND GOVERNMENTAL SERVICES ARE NOT AVAILABLE TO HANDLE THE ANTICIPATED IMMiEDIATE NEEDS, THE PROPOSALS WOULD ADVERSELY AFFECT PRESENT PROPERTY VALUES FOR THE SINGLE FAMILY HOMEOWNER, Q THESE ARE.MY.PERSONAL OBSERVATIONS BASED ON THE MATERIALS AND INFORMATION.AS PRESENTED AND AVAILABLE TO ME.�� OCT 101973 COMMISSIONER SIEBERT STATED THAT HE WOULD LIKE THE FOLLOWING STATEMENT OF HIS REASONS FOR DENYING THE VERO MAR SHORES PROJECT AND THE BONNIE DAHL.STROM PROJECT BE'INSERTED IN THE MINUTES ON PAGE 19 AND PAGE 21; STATEMENT BY W. W. SIEBERT, JR. REGARDItiG DALSTROM-WILCOX AND VERO-MAR REZONING APPLICATIONS It has come.to my attention that it is necessary for me to enter into the official records, my reasoning for denying the rezoning applications for the Dalstrom- Wilcox project and the Vero -Mar project. Arguments in support and opposition were almost identical in their presentation; hence, my reasoning for denial was the same for both projects. • The impact on available and projected governmental services would have a detrimental effect on the.safety and welfare of our county. State Highway A -1-A does not now have capacity to handle the additional automobile traffic that would be generated and improvements to this road are, at best. uncertain. We have but one bridge to service the South Beach and it is inadequate to handle todayls traffic. Although a second bridge is in the planning stages, the immediate prospect for obtaining this critically needed facility is only marginal. Threats of legal action by the City of Vero Beach and private citizens lead me to believe there could be a serious delay in obtaining this facility. We will soon start construction of a new hospital but we have been warned there may be a shortage of beds the day it opens. The addition of another floor is already under consideration. Recent legislation has reduced state participation in the funding of Indian River County schools, placing additional responsibility on local effort. Our school board has already expressed concern about how overcrowding will affect their goal of quality education. Double sessions have been mentioned. Although the City of Vero Beach has apparently agreed to service the area in question with water, this agreement is subject to reconsideration. A change in attitude by the current City Council - 3 - x Im PAU 65 _ M has confused this situation. Areas outside the city that were previously to be serviced by them are now indefinite. A county -wide sewer and water system has been tabled and there is no binding agreement with the city to service any of the unincorporated areas of the county. We do not presently enjoy a county -wide fire protection program. There is only one fire station on the entire island. As it is municipally owned and administered, their first obligation is to city residents. Their ability to take on additional territory is suspect. A county -wide system could eventually solve this problem but progress toward this end has been painfully slow due to political and financial difficulties. These are only the most serious service problems and should in no way infer that they are the only problems we can anticipate. I shall not attempt to review the hours of testimony offered by single family property owners expept by way of summation. It is important to understand I considered it my responsibility to weigh the evidence as presented, assign it a value and make a judgment decision based on what I thought was in the best interests of our county. There is no question in my mind that a vast majority of the property owners in the South Beach area felt very strongly that this rezoning would not be the highest and best use for the land and would have a detrimental effect on their property. It was stated repeatedly that they had purchased homes in this area only after careful review of the existing zoning, obtaining assurances from every avail- able source that single family zoning would be continued, 1 F and an expression of confidence in elected officials that they would protect their interests. If a pattern or trend has been established for our South Beach, it has been toward single family de- velopment. The "domino effect" scare is, in my opinion, a valid concern. -Real estate records of our county will prove that rezoning dramatically increases property value of the general and surrounding area. Such a trend can only bring increased pressure for multi -family and i commercial development. Past experience throughout the st`ate-supports the fact this discourages sixigle family 'development and reverses the values held in such reverence i by present home owners.. The District originally owned all of this property and subsequently, on April 11, 1957, conveyed an undivided one-half interest to Indian River County. In the conveyance from the District to the County, the purpose was for each of the parties to jointly remove the earth on any and all public projects 'as shall be, from time to time, determined by the two owners. There is further provided that should the County dis- continue the use, the interest of the County in the lands shall revert and become the sole property of the District. This deed is recorded in Of- ficial Record Book 10, page 255, and a copy is enclosed. for your records. I have been informed that since the conveyance of the one-half interest to the County on April 11, 1957, the County has from time to time removed dirt from an approximate three to five acre site on this land. However, for other periods of time, the borrow pit has remained dormant and no dirt removed. The District has not removed any of the dirt for its use. There is a possibility that because of the discontinuance of use by the County, the property has reverted back to the District. -The District has plans to use this property as a water storage area to conserve water ire this area and for this purpose, would have to excavate to a sufficient depth to have a large reservoir area. The primary purpose of this storage area would be for storage of water for agricultural uses only, and it could not be used for recreational areas. The District would like to have an understanding and agreement with the County as to the use of the entire property and would like to define the respective interest of the District and the County in this land. In this connection, the District has met with Jack Jennings for some pre- liminary discussion on this, and to try to determine an understanding as to the use of the land by each party. I have prepared a proposed Agreement to accomplish the above purposes, and would you review it and let me know if you agree to the form prior to the next meeting on October 10, at which time it would be presented to the County. I am sending a copy of this letter to Jack Jennings. Since we don't have too much time, would you advise me as soon as possible after you have reviewed this Agreement to determine if you have any suggested changes or additions. Jennings, County Administrator Indian River County Vero Beach, Florida 32960 Dear Mr. Jennings: At the last meeting of the Commissioners of Indian River County, we stipulated that we would provide the Com- missioners with further details and a realistic time schedule for the improvements to the treatment facilities. This letter will serve to fulfill that commitment. Before going into that phase, let me say that we do not envision the immediate expansion of our service area. Our goal is to provide good service to our existing customers and the consolidation of our existing service area. Expansion can be a fine goal, but never at the expense of existing customers. 1 To this end, we have recently modified the mode of operations of our existing facilities. We have also provided additional instruction on this operation to our local personnel. This has resulted in an immediate improvement in the treatment and our customers are now being furnished with good water. The proposed improvements to our facilities and operation are as follows: (1) Install an additional 5' 0 x 8' zeolite filter with all related appurtenances. (2) Install a tank level indicator, recorder, with 3 pump controllers. (3) Install a master meter with an indicator, recorder, and totalizer. (6) Replace test sink and provide for common chemical water test equipment for hardness, ph, iron, chlorine, and alkalinity. (7) The preparation of an instruction manual, and instruction of local personnel, for the proper utilization of the equipment and operation of the facilities. We have estimated and allocated approximately $35,000 as the funding required to carry out this program. Our tentative time schedule for this program would be as follows: - 2 to 4 weeks for preparation of final plans, specifications, and approval submittals to the Division of Health. 2 to 4 weeks for approvals by the Division of Health. 14 to 16 weeks for longest delivery items of equipment.. 2 to 3 weeks for installation. 1 week for final inspection and approval by the Division of Health. Based upon this we would project a schedule of not less than 21 weeks nor more than 28 weeks as the total required time for completion of this program. Since the time of our last meeting we have made serious attempts to meet and discuss the proposed plan with the Division of Health. To date we have been unable to arrange this. We shall continue with our efforts to arrange such a meeting. We trust that this information covers fully any questions that were unanswered. THE BOARD REQUESTED THAT BARBER AVENUE FROM U.S. #1 TO THE INDIAN RIVER BE PLACED ON THIS PRIORITY SHEET AS ITEM #B, BARBER AVENUE WILL BE AN ACCESS ROAD TO THE NEW PROPOSED HOSPITAL. 40 OCT 111973 is rack l B ON MOTION BY COMMISSIONER DRITENBAS, SECONDED BY COMMISSIONER SIEBERT, THE BOARD UNANIMOUSLY ADOPTED THE RESOLUTION #73-67 - 41 - STATE 01" FLORIDA o COUNTY RESOLUTION 011 USE OF SECONDARY ROAD FUNDS RESOLUTION NO. 73-67 YEAR 1973 COUNTY INDIAN RIVER WHEREAS, under the provisions of Section 206.47, Florida Statutes and Section 9, Article XII Constitution of the State of Florida, the Florida Department of Transportation will receke a portion of the -sur- plus of this County's pro -rata share of the 5th and 6th cent gasoline tax to be used within this County; and WHEREAS, under the provisions of Section 339.08 and Section 339.081, Florida Statutes, the expenditure of such funds shall be as prescribed by regulations of the Department and pursuant to an adopted resolution by this Board of County Commissioners; and WHEREAS, under the provisions of Section 334.21, Florida Statutes, the County is required to subrpit to the Department of Transportation a plan of work for the construction and maintenance of roads and streets within its jurisdiction for the five-year period beginning October 1, 1973 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the Florida Department of Transportation is hereby re- quested to use the aforesaid funds for the purposes and projects listed .1n EXHIBIT "A" attached hereto and made a part hereof and that the Depart- ment consider the listed items in accordance with priorities shown and to the extent of available funds in the preparation of its annual program of work for the above -listed fiscal year with the remaining requests con- stituting a continuing program to be scheduled in accordance with esti- mated available funds during the succeding four years. 2. That the actual scheduling of work by the Department on the re- quested projects be in the order of priorities listed insofar as is practicable, but not to the extent of retarding the whole program or pro - eluding the grouping of similar type projects in one construction contract. 3.
