FOR THE RECORD, I WOULD LIKE TO SUBMIT THE FOLLOWING
STATEMENT:
THE PROPOSED CHANGES WERE CONTRARY TO THE ESTABLISHED
LAND USE PATTERN'FOR THE AREA AS EVIDENCED BY THE MATERIALS SUB-
MITTED REGARDING THE GRADUAL, ORDERLY DEVELOPMENT OF THE AREA
ACCORDING TO EXISTING ZONING REGULATION.
THE PROPOSALS WOULD ALTER THE DENSITY PATTERN WHICH HAS
BEEN ESTABLISHED AND ABIDED BY OVER THE PAST MANY YEARS.

REGARDItiG DALSTROM-WILCOX AND
VERO-MAR REZONING APPLICATIONS
It has come.to my attention that it is necessary
for me to enter into the official records, my reasoning
for denying the rezoning applications for the Dalstrom-
Wilcox project and the Vero -Mar project. Arguments in
support and opposition were almost identical in their
presentation; hence, my reasoning for denial was the
same for both projects.
• The impact on available and projected governmental
services would have a detrimental effect on the.safety
and welfare of our county.
State Highway A -1-A does not now have capacity to
handle the additional automobile traffic that
would be generated and improvements to this road
are, at best. uncertain.
We have but one bridge to service the South Beach
and it is inadequate to handle todayls traffic.
Although a second bridge is in the planning stages,
the immediate prospect for obtaining this critically
needed facility is only marginal. Threats of legal
action by the City of Vero Beach and private citizens
lead me to believe there could be a serious delay
in obtaining this facility.
We will soon start construction of a new hospital
but we have been warned there may be a shortage
of beds the day it opens. The addition of another
floor is already under consideration.
Recent legislation has reduced state participation
in the funding of Indian River County schools,
placing additional responsibility on local effort.
Our school board has already expressed concern
about how overcrowding will affect their goal
of quality education. Double sessions have been
mentioned.
Although the City of Vero Beach has apparently
agreed to service the area in question with water,
this agreement is subject to reconsideration. A
change in attitude by the current City Council

has confused this situation. Areas outside the
city that were previously to be serviced by them
are now indefinite. A county -wide sewer and water
system has been tabled and there is no binding
agreement with the city to service any of the
unincorporated areas of the county.
We do not presently enjoy a county -wide fire
protection program. There is only one fire station
on the entire island. As it is municipally owned
and administered, their first obligation is to
city residents. Their ability to take on additional
territory is suspect. A county -wide system could
eventually solve this problem but progress toward
this end has been painfully slow due to political
and financial difficulties.
These are only the most serious service problems
and should in no way infer that they are the only problems
we can anticipate.
I shall not attempt to review the hours of testimony
offered by single family property owners expept by way
of summation. It is important to understand I considered
it my responsibility to weigh the evidence as presented,
assign it a value and make a judgment decision based on
what I thought was in the best interests of our county.
There is no question in my mind that a vast majority
of the property owners in the South Beach area felt very
strongly that this rezoning would not be the highest and
best use for the land and would have a detrimental effect
on their property.
It was stated repeatedly that they had purchased
homes in this area only after careful review of the
existing zoning, obtaining assurances from every avail-
able source that single family zoning would be continued,
1 F and an expression of confidence in elected officials
that they would protect their interests. As this is all

that could be reasonably expected of them, they were
entitled to property protection afforded by the zoning
regulations of our county.
If a pattern or trend has been established for
our South Beach, it has been toward single family de-
velopment. The "domino effect" scare is, in my opinion,
a valid concern. -Real estate records of our county will
prove that rezoning dramatically increases property
value of the general and surrounding area. Such a trend
can only bring increased pressure for multi -family and

commercial development. Past experience throughout the
st`ate-supports the fact this discourages sixigle family
'development and reverses the values held in such reverence
i by present home owners..
Action of this kind only benefits the speculator
-and developer at the expence of the single family home
owner and would be irresponsible and arbitrary.

THE SUPPLEMENTAL BUDGET AS ADVERTISED.
ROSEMARY RICHEY, SUPERVISOR OF ELECTIONS PRESENTED
JURY LISTS CONTAINING APPROXIMATELY 350 NAMES FOR THE COMMISSIONERS
TO REVIEW AND APPROVE.
THE BOARD REVIEWED ALL THE LISTS AND RETURNED THEM TO
MRS. RICHEY, WHO WILL PREPARE THE CERTIFICATION FOR THE COM-

THE BUILDING DEPARTMENT. MR. JENNINGS STATED THAT HE WOULD
CHECK TO SEE THAT THIS PROCEDURE IS BEING CARRIED OUT.

A DISCUSSION FOLLOWED REGARDING WHEN AN INSPECTION
REGARDING SEPTIC TANKS SHOULD BE MADE AND MAYOR ZIMMER SUGGESTED
THAT A TEMPORARY BUILDING PERMIT BE ISSUED FOR A BUILDING FOUNDATION
AND WHEN THIS FOUNDATION IS COMPLETED AND FILL ADDED, THEN A SEPTIC
TANK INSPECTION COULD BE MADE.
ATTORNEY BURCH STATED THAT ISSUING A TEMPORARY BUILDING
PERMIT IS IN VIOLATION OF THE LAW. HE ALSO STATED THAT THIS BOARD
ACTS AS A POLICING POWER TO SET FEES FOR THE SERVICES THE BOARD
OF HEALTH PROVIDES AS STATED IN HOUSE BILL 2165, BUT IT DOES
NOT SET THE RULES AND REGULATIONS THAT THE BOARD OF HEALTH FOLLOWS.
THESE ARE SET BY THE STATE DEPARTMENT OF HEALTH,
AFTER MUCH DISCUSSION CHAIRMAN Loy STATED THAT OUR

I represent Indian River Farms Water Management District,
who, together with the county, own a borrow pit legally described
as Tract 3, Section 34, Township 33 South, Range 38 East, according
to last general plat of Indian River Farms Company recorded in Plat
Book 2, page 25, public records of St. Lucie County, Florida.
The District originally owned all of this property and subsequently,
on April 11, 1957, conveyed an undivided one-half interest to Indian
River County. In the conveyance from the District to the County, the
purpose was for each of the parties to jointly remove the earth on any
and all public projects 'as shall be, from time to time, determined by
the two owners. There is further provided that should the County dis-
continue the use, the interest of the County in the lands shall revert and
become the sole property of the District. This deed is recorded in Of-
ficial Record Book 10, page 255, and a copy is enclosed. for your records.
I have been informed that since the conveyance of the one-half
interest to the County on April 11, 1957, the County has from time to
time removed dirt from an approximate three to five acre site on this
land. However, for other periods of time, the borrow pit has remained
dormant and no dirt removed. The District has not removed any of the
dirt for its use. There is a possibility that because of the discontinuance
of use by the County, the property has reverted back to the District.
-The District has plans to use this property as a water storage area
to conserve water ire this area and for this purpose, would have to excavate
to a sufficient depth to have a large reservoir area. The primary purpose
of this storage area would be for storage of water for agricultural uses
only, and it could not be used for recreational areas.
The District would like to have an understanding and agreement
with the County as to the use of the entire property and would like to
define the respective interest of the District and the County in this land.
In this connection, the District has met with Jack Jennings for some pre-
liminary discussion on this, and to try to determine an understanding as
to the use of the land by each party. The District proposes that it be
allowed to excavate the fill, either by the District or contractors working
with `the District on this tract, except as to the perimeter around the entire
trach: approximately 150 feet wide, measured from the outside right-of-
way of the District.

That the District be allowed to sell or convey any dirt in
this area, and this property would be the District's. That after
three years from date, any dirt not so removed by the District,
could then be removed by the County for its own use within the next
three years.
That the outside perimeter of this property can be used by
the County as a dirt storage area and any other use that would not be
inconsistent with the water reservoir area.
I have prepared a proposed Agreement to accomplish the
above purposes, and would you review it and let me know if you agree
to the form prior to the next meeting on October 10, at which time it
would be presented to the County. I am sending a copy of this letter
to Jack Jennings. Since we don't have too much time, would you advise
me as soon as possible after you have reviewed this Agreement to
determine if you have any suggested changes or additions.

THAT MEETING ALL COMPLAINTS WERE DISCUSSED AND MR. WRIGHT OUTLINED
THE STEPS MID FLORIDA UTILITIES WOULD TAKE TO SERVE THEIR CUSTOMERS
SATISFACTORY WATER. THE BOARD ASKED MR. WRIGHT TO PUT THESE
IMPROVEMENTS DISCUSSED AND A TIME SCHEDULE FOR COMPLETION OF THESE
IMPROVEMENTS IN THE FORM OF A LETTER. THAT LETTER DATED OCTOBER

Dear Mr. Jennings:
At the last meeting of the Commissioners of Indian
River County, we stipulated that we would provide the Com-
missioners with further details and a realistic time schedule
for the improvements to the treatment facilities. This letter
will serve to fulfill that commitment.
Before going into that phase, let me say that we do
not envision the immediate expansion of our service area. Our
goal is to provide good service to our existing customers and
the consolidation of our existing service area. Expansion
can be a fine goal, but never at the expense of existing
customers.

To this end, we have recently modified the mode of
operations of our existing facilities. We have also provided
additional instruction on this operation to our local personnel.
This has resulted in an immediate improvement in the treatment
and our customers are now being furnished with good water.
The proposed improvements to our facilities and
operation are as follows:
(1) Install an additional 5' 0 x 8' zeolite filter
with all related appurtenances.
(2) Install a tank level indicator, recorder, with
3 pump controllers.
(3) Install a master meter with an indicator, recorder,
and totalizer.
(4) Install chlorinator with 2 rate of feed valves,
2 injector pumps, automatic switch -over, and 2 scales.

(5) Install dual feeder systems for water stabilization and
corrosion control.
(6) Replace test sink and provide for common chemical water
test equipment for hardness, ph, iron, chlorine, and alkalinity.
(7) The preparation of an instruction manual, and instruction
of local personnel, for the proper utilization of the equipment and
operation of the facilities.
We have estimated and allocated approximately $35,000 as the
funding required to carry out this program.
Our tentative time schedule for this program would be as follows: -
2 to 4 weeks for preparation of final plans, specifications,
and approval submittals to the Division of Health.
2 to 4 weeks for approvals by the Division of Health.
14 to 16 weeks for longest delivery items of equipment..
2 to 3 weeks for installation.
1 week for final inspection and approval by the Division of
Health.
Based upon this we would project a schedule of not less than
21 weeks nor more than 28 weeks as the total required time for completion
of this program.
Since the time of our last meeting we have made serious attempts
to meet and discuss the proposed plan with the Division of Health. To
date we have been unable to arrange this. We shall continue with our
efforts to arrange such a meeting.
We trust that this information covers fully any questions that were
unanswered. If we may be of any further assistance, please call on us.

IRA McALLISTER, PLANT MANAGER FOR MID FLORIDA UTILITIES
STATED THAT THE FIRE HYDRANT THAT WAS DISCUSSED WAS BROKEN AND
HE WAS INFORMED BY THE CITY OF AERO BEACH THAT THEY WOULD NEVER
USE THAT FIRE HYDRANT SO IT WAS REMOVED.
COMMISSIONER MASSEY ASKED MR. WRIGHT THAT SINCE IT WAS
ESTABLISHED DURING THE MEETING THAT THE RESPONSIBILITY OF MID FLORIDA
ENDS AT THE PROPERTY LINE, HOW COME YOU WILL NOT REPLACE THE
GALVANIZED PIPES THAT YOU STATED ARE THE CAUSE OF THE RUST IN THE
WATER.
MR. WRIGHT STATED THAT HE BELIEVES THAT THE NEW EQUIPMENT
AND THE CHLORINATOR WILL RELEAVE THE PROBLEM, BUT IF IT DOES NOT
THEN WE WILL REPLACE THE PIPES. MR. WRIGHT FURTHER STATED THAT
THIS IS A MAJOR IMPROVEMENT AND WOULD HAVE TO BE PAID BY THE
CUSTOMERS IN THE FORM OF A RATE INCREASE.
MR. WRIGHT STATED THAT ALL THE NEW EQUIPMENT ON ORDER
SHOULD BE RECEIVED AND OPERATIONAL ABOUT .JANUARY 15, 1974.
COMMISSIONER DRITENBAS STATED THAT WHEN THE SERVICES
HAVE BEEN BROUGHT UP TO SATISFACTORY STANDARD THEN WE SHOULD TALK
ABOUT A RATE INCREASE.
A MOTION WAS MADE BY COMMISSIONER SIEBERT, SECONDED BY
COMMISSIONER BOGOSIAN, THAT THIS BOARD ORDERS MID FLORIDA UTILITIES
TO BRING THEIR SERVICES UP TO ACCEPTABLE STANDARD, ACCORDING TO

Gentlemen:
This is in response to your Invitation to Bid on your gasoline and diesel
fuel requirements for the one year period beginning October 1, 1973.
We attach our Form 242, Memorandum of Consumer Agreement, outlining the
prices that we offer on tankwagon deliveries of Chevron Supreme Gasoline
and'Chevron Diesel Fuel. Also listed is the maximum gallons that we will
deliver for the one year period.
The prices as indicated on the contract are tied to market conditions in
the Indian River County area and are subject to change with five days written
notice.
The price as indicated on Chevron Supreme Gasoline includes the $.00125
Florida State Inspection Fee, but is exclusive of any applicable tax.
Our quotation is considered accepted when an authorized representative of
the Board of County Commissioners of Indian River County approve our Form
242 Contract.
This offer is to be considered withdrawn if not accepted within 30 days from
the date of this letter.

the right to change the prices, bases of prices and terms of payment specified here-
in for all.or any part of the products sold hereunder: Should such price revision
not be acceptable to Buyer, Buyer may terminate this Agreement at any time within

FaTIRETY OF COIITRACT:
This contract supersedes and cancels all agreements between the parties in re-
spect of the purchase by Buyer and sale by Seller of products covered hereby for de-
livery at the point(s) of delivery herein stated and without prejudice to accrued
rights of either party under said superseded agreements.
DELIVERIES DELAYED OR PREVE1TED:
All orders shall be filled with reasonable promptness, but the Seller shall not
be liable in damages or otherwise when deliveries are delayed or prevented by reason
of fire, storm, flood, war, rebellion, insurrection, riot, orders or requests of
governmental authorities or the armed forces thereof, strike, differences with work-
men, failure of carriers to transport or furnish customary facilities for transpor-
tation or for delay or failure in delivery when the supplies of the Seller, or, the
facilities of production, manufacture, transportation or distribution, which other-
wise would be available to the Seller are impaired by the order, requisition, re-
quest, or necessity of any government or acting authority, or when such delay or
failure is due to any cause whatsoever beyond the reasonable control of the Seller,
whether similar to or dissimilar from the causes here enumerated. In addition to all
of the foregoing, if at any time Seller's supplies of the products(s) become insuf-
ficient to meet the full requirements of all of its customers contract or otherwise
(of which condition Seller shall be the sole judge), Seller may reduce deliveries
under this contract on a fair and equitable basis, to be determined by it, and shall
not be required to make up deliveries so reduced. In the event Seller is required
to so reduce deliveries under this contract, Buyer may at its option terminate this
° agreement by giving ten darts written notice to the Seller of its desire to do so.
TAXES:
Buyer shall pay Seller amounts equivalent to any applicable tax fee and/or
applicable duty (not included in'the price or otherwise paid by Buyer) now or here-
inafter imposed, directly or indirectly, by any domestic or foreign governmental
authority or agency, and any increases in such applicable tax, fee or duty, on, in
respect of, or measured by (a) this contract, (b) the goods covered by this contract
or any material contained in such goods and/or, (c) the manufacture, sale, use, re-
ceipt, storage, withdrawal from storage and/or other handling of goods or material;
and the Seller, upon payment of or liability for such applicable tax, fee or duty,
shall bill Buyer for, and the Buyer shall pay the amount thereof.
CHANGE IN BRAND =E(S):
The Seller may at any time change the brand name(s) of any product and this con-
tract shall cover any product substituted by the Seller for that discontinued, or any
new brand name(s) substituted for the product herein mentioned.
NOTICE:
Any notice to be given hereunder shall be in writing and shall be deemed to have
been duly given if and when deposited in the United States mail, properly stamped and
addressed to the party for whom intended at the address of such party herein speci-
fied, or when delivered personally to such party at such address.
DEf40ME CLAIMS:
It is agreed that if the Buyer shall hold tank cars beyond the railroad free
time allowance therefor, Buyer shall assume all proper charges for such demurrage
accruing and in addition thereto reimburse Seller for such tank car rental as it is
obligated to pay owner of such cars, for the period in excess of railroad free time
allowed, during which the cars may be so detained. It is also agreed that should
Buyer hold Seller's common or contract carrier transport tank truck(s) beyond the
carrier free time allowance, Buyer shall assume all proper charges for such detention
accruing.
WAIVERS:
The Seller's right to require strict performance by Buyer of any and/or all ob-
ligations imposed upon Buyer by this contract shall not in any way be affected by
any previous waiver, forbearance, or course of dealing.

Due to uncertainties in the supply/demand situation, Seller may not
have sufficient supplies of one or more products from its then contem-
plated sources of supply to meet at one or more delivery points hereunder
the full requirements of all its customers, contract or otherwise. Whenever
that situation exitts and Seller's performance hereunder is not otherwise
excused, Seller may reduce deliveries of such product(s) at such delivery
point(s) on any basis which in Seller's opinion is equitable, allowing for
such priorities to such classes of customers as Seller deems appropriate.
No such reduction need be made up. If any.such reduction occurs, Buyer
shall have the option to accept such reduction or to terminate this Agree-
ment as to any or all products and delivery points by 15 days' notice to
Seller given at any time within 30 days after the notice of reduction.

PARTNER IN THE LAW FIRM OF BURCH, COLLINS AND PADGET WAS THE ATTORNEY
REPRESENTING THE EISWELL CORPORATION IN THE TRANSACTION OF PURCHASING
THIS PROPERTY. ATTORNEY BURCH FURTHER STATED THAT THIS MIGHT BE
CONSIDERED A CONFLICT OF INTEREST AND, IN HIS OPINION, IT WOULD BE
WRONG FOR HIM TO REPRESENT THE COUNTY IN THIS SUIT.

CATS,
THE ADMINISTRATOR WAS AUTHORIZED TO ANSWER MRS
FLETCHER'S LETTER STATING THAT THE BOARD, HAS NO JURISDICTION
IN THIS MATTER.
THE ADMINISTRATOR STATED THAT ROBERT LLOYD, ENGINEER
HAS INFORMED HIM THAT THE DUNES OF DEAUVILLE SUBDIVISION, A PRIVATE
SUBDIVISION, MUST MAKE REVISIONS IN THE CONSTRUCTION OF THE ROADS,
IT WAS STATED THAT THE DEPARTMENT OF POLLUTION CONTROL WILL NOT
GIVE APPROVAL FOR THE DRAINAGE IF.THE ROADS ARE CONSTRUCTED WITH
MIAMI CURBING.
THE ADMINISTRATOR STATED THAT HE HAD NO OBJECTION TO THE
CHANGE IN ROAD CONSTRUCTION AS REQUESTED BY ROBERT LLOYD IN HIS

SECONDARY ROAD FUNDS RESOLUTION NO. 73-67
YEAR 1973 COUNTY INDIAN RIVER
WHEREAS, under the provisions of Section 206.47, Florida Statutes
and Section 9, Article XII Constitution of the State of Florida, the
Florida Department of Transportation will receke a portion of the -sur-
plus of this County's pro -rata share of the 5th and 6th cent gasoline tax
to be used within this County; and
WHEREAS, under the provisions of Section 339.08 and Section 339.081,
Florida Statutes, the expenditure of such funds shall be as prescribed by
regulations of the Department and pursuant to an adopted resolution by
this Board of County Commissioners; and
WHEREAS, under the provisions of Section 334.21, Florida Statutes,
the County is required to subrpit to the Department of Transportation a
plan of work for the construction and maintenance of roads and streets
within its jurisdiction for the five-year period beginning October 1, 1973
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the Florida Department of Transportation is hereby re-
quested to use the aforesaid funds for the purposes and projects listed
.1n EXHIBIT "A" attached hereto and made a part hereof and that the Depart-
ment consider the listed items in accordance with priorities shown and to
the extent of available funds in the preparation of its annual program of
work for the above -listed fiscal year with the remaining requests con-
stituting a continuing program to be scheduled in accordance with esti-
mated available funds during the succeding four years.
2. That the actual scheduling of work by the Department on the re-
quested projects be in the order of priorities listed insofar as is
practicable, but not to the extent of retarding the whole program or pro -
eluding the grouping of similar type projects in one construction contract.
3. That allocations and expenditures of funds by the Department
shall not be restricted by an estimate of cost shown herein, and that

this Board concurs in the use by the Department of any available funds
necessary incidental to making those road projects listed in Exhibit "A1°
fully operating facilities within the termini described in said Exhibit,
and as shorn on the accompanying map.
4. That if, at any time, this County's secondary funds programmed
allocations become over or under -programmed in the amount of 10%, the De-
partment will adjust the Secondary program with the approval and recom-
mendations of this Board to bring said program into balance.
5, That the methods and standards employed by the Department for
the determination of major improvement features, including specific
alignment, types and width of pavement, types of materials, and the De-
partment's standard specifications fot construction are concurred in and
approved by this Board.

Subdivision's roads as shown in Plat Book 4, pages 8, 11, and 60, Official
Records of Indian River County, Florida, shall be restricted to vehicles
weighing five (5) tons or less. The County Administrator is ordered
accordingly, to post signs at all street entrances to the Country Club
Point Subdivision.
