ORDINANCE NO. 2007- 025
AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING
ORDINANCE AND THE ACCOMPANYING ZONING} MAP FOR MORE OR LESS 29.63
ACRES LOCATED SOUTH OF 33RD STREET AND APPROXIMATELY 1650 FEET WEST
OF 66AVENUE FROM A-1, AGRICUALTURAL-1 DISTRICT (UP TO 1 UNIT/ 5
ACRES), TO RS -3, SINGLE FAMILY RESIDENTIAL DISTRICT (UP TO 3 UNITS/ACRE);
AND PROVIDING CODIFICATION, SI-VERABILITY, AND EFFECTIVE DATE
WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency
on such matters, held a public hearing and subsequently made a recommendation regarding this
rezoning request; and
WHEREAS, the Board of County Commissioners of Indian River County, Florida, did
publish and send its Notice of Intent to rezone the hereinafter described property; and
WHEREAS, the Board of County Commissioners held a public hearing pursuant to this
rezoning request, at which parties in interest and citizens were heard;
WHEREAS, the Board of County Commissioners has determined that this rezoning is in
conformance with the Comprehensive Plan of Indian River County; and
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of
Indian River County, Florida, that the zoning of the following described property situated in
Indian River County, Florida, to -wit:
LAND SITUATED IN THE STATE OF FLORIDA, COUNTY OF INDIAN RIVER, AND
BEING PART OF TRACT 10, Oh SECTION 31, TOWNSHIP 32, RANGE 39, ACCORDING
TO TIIE LAST GENERAL PLAT OF THE INDIAN RIVER FARMS COMPANY
SUBDIVISION, RECORDED 1N PLAT BOOK 2, PAGE 25, ST. LUCIE COUNTY RECORDS
NOW INDIAN RIVER COUNTY RECORDS AND MORE PARTICULARLY BOUNDED
AND DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHEAST CORNER OF SAID SECTION 31, TIIENCE RUN N

BEGINNING.
THENCE RUN S 00024'53" W, A DISTANCE OF 1290.67 FEET, TO A POINT ON THE
SOUTH LINE OF TRACT 10; THENCI- RUN N 89042'55" W ,ALONG TIIE SOUTH LINE OF
TRACT 10, A DISTANCE OF 999.50 FEET TO THE SOUTH WEST CORNER OF TRACT
10; THENCE RUN N 00022'14" E ALONG WEST LINE OF TRACT 10, A DISTANCE
OF 1290.85 FEET TO THE SOUTH LINE OF SAID 30' CANAL "A-4" RIGHT-OF-WAY;
THENCE RUN S 89°42'16" E ALONG SAID RIGIIT-OF -WAY LINE, A DISTANCE OF
1000.49 FEET; TIIE POINT OF BEGINNING.
SAID LAND CONTAINING: 29.63 ACRES OF LAND, MORE OR LESS. AND SUBJECT OF
EASEMENTS, RESTRICTIONS AND RESERVATIONS OF RECORD,
is changed from A-1, Agricultural -I District (up to 1 unit/5 acres), to RS -3, Single Family
Residential District (up to') units/acre).
All with the meaning and intent as set forth and described in said Land Development
Regulations.
This ordinance shall become effective upon filing with the Department of State.
Approved and adopted by the Board of County Commissioners of Indian River County,
Florida, on this 20' day of July 2007.
This ordinance was advertised in the Press -Journal on the 9th day of duly , for a
public bearing to be held on the 20' day of July 2007, at which time it was moved for adoption
by Commissioner Bowden
