AND THE ACCOMPANYING ZONING FROM A-1 AND A-2 TO PD INDUSTRIAL FOR
APPROXIMATELY 142.42 ACRES AND APPROVING THE PD CONCEPTUAL PLAN FOR THE
SUBJECT SITE LOCATED WEST OF I-95 AT THE NORTHWEST CORNER OF SR 60 AND 98TH
AVENUE; AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such
matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request;
WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and
send its Notice of Intent to rezone the hereinafter described property; and
with the Comprehensive Plan of Indian River County; and
WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning
request, at which parties in interest and citizens were heard;
NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River
County, Florida, that the zoning of the following described property situated in Indian River County, Florida,
to -wit:
TRACTS 1, 29 7 AND 8, OF SECTION 4, TOWNSHIP 33 SOUTH, RANGE 38 EAST ACCORDING TO
THE LAST GENERAL PLAT OF LANDS OF INDIAN RIVER FARMS COMPANY SUBDIVISION AS
RECORDED IN PLAT BOOK 2, PAGE 25 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY,
FLORIDA. SAID LAND NOW LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA.

SPECIFIC USE CRITERIA:
• There shall be no direct access from SR 60 or 98th Avenue to any non -industrial site.
Access to such sites shall be from internal park roadways. A limited access easement is
depicted along 98`h Avenue and SR 60 except where street connections are shown.
• The Park shall be limited to two free standing restaurants. One restaurant may be located
within 100' of SR 60. The second must be set back a minimum of 200' from SR 60, to
be located on lots 1 and 2.
• Retail Uses
1. Retail / commercial (including restaurant) uses accessory to the industrial park as
a whole are allowed, but limited to no more than 10% of the gross park area. This
10% restriction does not apply to retail showroom and sales and service areas that
are part of a manufacturing facility.
a. The accessory retail / commercial uses that are subject to the 10% area
restriction shall be designed to serve the tenants, employees and
businesses within the park (e.g. business and office services, restaurant,
hotel). These uses shall be located on interior lots within the park and on
Lots 1 and 2, Block A, which are located at the northwest corner of 981h
Avenue and SR 60. Said sites shall have no direct access onto SR 60 or
98`h Avenue and shall be located behind the SR 60 and 981h Avenue
buffers (5' berms plus SR 60 corridor landscaping). Consistent with the
PD accessory commercial building location standards of 915.12(2)(B)4, a
200 foot commercial building setback from park perimeters shall apply,
with the exception for a single restaurant use to be allowed within 100'.
Also, all SR 60 corridor regulations for commercial uses shall apply.
b. The accessory retail / commercial uses that are subject to the 10% area
restriction cannot be developed ahead of the industrial uses. At a
minimum, an equal or greater amount of land must be developed as
industrial, prior to development of the commercial uses.
• Contractors Trade
Construction / contractor trades uses shall be limited to no more than 25% of the gross
park area for the first 3 years following PD zoning approval and no more than an
additional 25% of the park area from years 3 through year 6 following PD zoning
approval. After 6 years from the date of. PD zoning approval, no more than 50% of the
gross park area shall be used for construction / contractor trades uses.
• Citrus
Managed active citrus may continue on the site as an allowable permitted agricultural use
until such citrus areas are cleared for development.
