HomeMy WebLinkAbout2004-011ORDINANCE NO. 2004- 011 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR APPROXIMATELY 21.2 ACRES LOCATED NORTH OF 12TH STREET AND APPROXIMATELY 1962 FEET WEST OF 82ND AVENUE, FROM RMH-8, RESIDENTIAL MOBILE HOME DISTRICT (UP TO 8 UNIT/ACRE) TO RM -6, MULTI -FAMILY RESIDENTIAL DISTRICT (UP TO 6 UNITS/ACRE); AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit THAT PORTION OF TRACTS 2 AND 7, IN SECTION 11, TOWNSHIP 33 SOUTH, RANGE 38 EAST OF THE PLAT OF INDIAN RIVER FARMS SUBDIVISION RECORDED IN PLAT BOOK 2, PAGE 25, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA, DESCRIBED AS FOLLOWS: COMMENCE AT THE SOUTHWEST CORNER OF SAID TRACT 7 AND RUNN00°12'55" W ALONG THE WEST LINE OF SAID TRACT 7 FOR 1653.88 FEET; THENCE RUN N89°33"03"E FOR 956.13 FEET, THENCE SOO°12'41"E FOR 510.75 FEET; THENCE S89°23 59"W FOR 499.60 FEET; THENCE SOO°12'28"E FOR 1080.61 FEET; THENCE S89°23'59"W FOR 456.37 Page 1 of 3 ORDINANCE NO. 2004- 011 FEET TO THE POINT OF COMMENCEMENT. SAID LAND LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. SUBJECT TO EASEMENTS, RESERVATIONS, RESTRICTIONS AND RIGHTS-OF-WAY OF RECORD CONTAINING APPROXIMATELY 21.2 ACRES, MORE OR LESS. is changed from RMH-8, Residential Mobile Home District (up to 8 units/acre) to RM -6, Multi - Family Residential District (up to 6 units/acre). All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 13`" day of April, 2004.
