HomeMy WebLinkAbout2004-012ORDINANCE NO. 2004- 012 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FROM A-1 TO PD RESIDENTIAL FOR APPROXIMATELY 30.80 ACRES AND APPROVING THE PD CONCEPTUAL PLAN FOR THE SUBJECT SIVE LOCATED AT THE SOUTHWEST CORNER THE MAIN RELIEF CANAL AND 58TH AVENUE; AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFLCTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has deteniiined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit: THE FOLLOWING PARCELS OF LAND, SITUATE IN PORTIONS OF SECTION 5 AND 8, TOWNSHIP 33 SOUTH, RANGE 39 EAST, INDIAN RIVER COUNTY, FLORIDA, BEING PARTICULARLY DESCRIBED AS FOLLOWS: PARCEL A: BEGINNING AT THE SOUTHWEST CORNER OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SAID SECTION 5, TOWNSHIP 33 SOUTH, RANGE 39 EST, THENCE NORTH TO THE SOUTH RIGHT-OF-WAY LINE OF THE MAIN CANAL OF THE INDIAN RIVER FARMS COMPANY; THENCE EASTERLY ALONG THE SAID CANAL RIGHT-OF-WAY LINE TO THE WEST RIGHT-OF-WAY LINE OF CANAL OF THE SIAD INDIAN RIVER FARMS COMPNAY, KNOWN AND PLATTED AS LATERAL `B', THENCE SOUTH ALONG THE RIGHT- OF-WAY OF THE SAID LATERAL `B' TO THE SECTION LINE DIVIDING SECTION 5 AND SECTION 8; THENCE WEST TO THE POINT OF BEGINNING; LESS AND EXCEPT THE WEST 56 FEET OF THE EAST 136 F:\Co:mnunity Development\Users\CurDev\ORDINANCE\Segovia Lakes PD ordinance.doc 1 ORDINANCE NO. 2004- 012 FEET OF THE SOUTHEAST 1/4 OF SECTION 5, TOWNSHIP 33 SOUTH, RANGE 39 EAST LYING SOUTH OF THE MAIN CANAL, ACCORDING TO THE LAST GENERAL PLAT OF THE LANDS OF THE INDIAN RIVER FARMS COMPANY RECORDED IN PLAT BOOK 2, PAGE 25, OF THE PUBLIC RECORDS OF ST. THEN RUN NORTH 00.29'24" EAST A DISTANCE OF 676.58 FEET TO THE POINT OF BEGINNING. is changed from A-1, Agricultural 1, District( up to 1 unit/5 acres) to PD, Planned Development Residential with the uses and specific criteria provided for in the attached use table ( exhibit A) and the layout as depicted in the attached conceptual PD plan ( exhibit B). All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 20th day of April, 2004.
