HomeMy WebLinkAbout2004-016ORDINANCE NO. 2004- 016 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR APPROXIMATELY 10.76 ACRES LOCATED APPROXIMATELY 620 FEET EAST OF 27TH AVENUE AND 630 FEET SOUTH OF 9TH STREET S.W. (OSLO ROAD), FROM RS -6, SINGLE FAMILY RESIDENTIAL DISTRICT (UP TO 6 UNITS/ACRE) TO RM -6, MULTI -FAMILY RESIDENTIAL DISTRICT (UP TO 6 UNITS/ACRE); AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit: A PARCEL OF LAND, BEING A PORTION OF TRACT 4, SECTION 26, TOWNSHIP 33 SOUTH, RANGE 39 EAST, AS SHOWN ON INDIAN RIVER FARMS COMPANY PLAT OF LANDS AND PLAN FOR LAND DRAINAGE AND ROAD RESERVATIONS ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 2, PAGE 25, OF THE PUBLIC RECORDS OF ST LUCIE COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGIN AT THE SOUTHEAST CORNER OF SAID TRACT 4; THENCE ALONG THE SOUTH LINE OF SAID TRACT 4, NORTH 89°58'29" WEST, A DISTANCE OF 663.92 FEET; THENCE ALONG THE WEST LINE OF THE EAST 20.29 ACRES OF SAID TRACT 4, NORTH 00°19'54" Page 1 of 3 ORDINANCE NO. 2004- 016 EAST, A DISTANCE OF 701.87 FEET; THENCE NORTH 89°16'04" EAST, A DISTANCE OF 644.03 FEET TO A POINT ON THE EAST LINE OF SAID TRACT 4; THENCE, ALONG SAID LINE, SOUTH 00°19'54" WEST, A DISTANCE OF 710.65 FEET TO THE POINT OF BEGINNING. SUBJECT TO EASEMENTS, RESERVATIONS, RESTRICTIONS AND RIGHTS-OF-WAY OF RECORD. SAID LANDS LYING AND SITUATE IN INDIAN RIVER COUNTY, FLORIDA AND CONTAINING 10.76 ACRES (468,939 SQUARE FEET), MORE OR LESS. is changed from RS -6, Single -Family Residential District (up to 6 units/acre) to RM -6, Multi -Family Residential District (up to 6 units/acre). All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 1St day of June, 2004. This ordinance was advertised in the Press -Journal on the 19th day of May, 2004, for a public hearing to be held on the 1St day of June, 2004, at which time it was moved for adoption by Commissioner Neuberger , seconded by Commissioner Adams , and adopted by the following vote: Chairman Caroline D.
