AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING
ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR APPROXIMATELY 10.76
ACRES LOCATED APPROXIMATELY 620 FEET EAST OF 27TH AVENUE AND 630 FEET
SOUTH OF 9TH STREET S.W. (OSLO ROAD), FROM RS -6, SINGLE FAMILY RESIDENTIAL
DISTRICT (UP TO 6 UNITS/ACRE) TO RM -6, MULTI -FAMILY RESIDENTIAL DISTRICT (UP
TO 6 UNITS/ACRE); AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE
DATE.
WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on
such matters, has held a public hearing and subsequently made a recommendation regarding this
rezoning request; and
WHEREAS, the Board of County Commissioners of Indian River County, Florida, did
publish and send its Notice of Intent to rezone the hereinafter described property; and
WHEREAS, the Board of County Commissioners has determined that this rezoning is in
conformance with the Comprehensive Plan of Indian River County; and
WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this
rezoning request, at which parties in interest and citizens were heard;
NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian
River County, Florida, that the zoning of the following described property situated in Indian River
County, Florida, to -wit:
A PARCEL OF LAND, BEING A PORTION OF TRACT 4, SECTION 26, TOWNSHIP 33
SOUTH, RANGE 39 EAST, AS SHOWN ON INDIAN RIVER FARMS COMPANY PLAT OF
LANDS AND PLAN FOR LAND DRAINAGE AND ROAD RESERVATIONS ACCORDING TO
THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 2, PAGE 25, OF THE PUBLIC
RECORDS OF ST LUCIE COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
BEGIN AT THE SOUTHEAST CORNER OF SAID TRACT 4; THENCE ALONG THE SOUTH
LINE OF SAID TRACT 4, NORTH 89°58'29" WEST, A DISTANCE OF 663.92 FEET; THENCE
ALONG THE WEST LINE OF THE EAST 20.29 ACRES OF SAID TRACT 4, NORTH 00°19'54"

EAST, A DISTANCE OF 701.87 FEET; THENCE NORTH 89°16'04" EAST, A DISTANCE OF
644.03 FEET TO A POINT ON THE EAST LINE OF SAID TRACT 4; THENCE, ALONG SAID
LINE, SOUTH 00°19'54" WEST, A DISTANCE OF 710.65 FEET TO THE POINT OF
BEGINNING.
SUBJECT TO EASEMENTS, RESERVATIONS, RESTRICTIONS AND RIGHTS-OF-WAY OF
RECORD.
SAID LANDS LYING AND SITUATE IN INDIAN RIVER COUNTY, FLORIDA AND
CONTAINING 10.76 ACRES (468,939 SQUARE FEET), MORE OR LESS.
is changed from RS -6, Single -Family Residential District (up to 6 units/acre) to RM -6, Multi -Family
Residential District (up to 6 units/acre).
All with the meaning and intent and as set forth and described in said Land Development
Regulations.
This ordinance shall become effective upon filing with the Department of State.
Approved and adopted by the Board of County Commissioners of Indian River County,
Florida, on this 1St day of June, 2004.
This ordinance was advertised in the Press -Journal on the 19th day of May, 2004, for a
public hearing to be held on the 1St day of June, 2004, at which time it was moved for adoption by
Commissioner Neuberger , seconded by Commissioner Adams , and adopted
by the following vote:
