HomeMy WebLinkAbout2004-037ORDINANCE NO. 2004- 037 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR +/- 11.2 ACRES LOCATED WEST OF 74TH AVENUE AND APPROXIMATELY 600 FEET SOUTH OF STATE ROAD 60 FROM A-1, AGRICULTURAL DISTRICT (UP TO 1 UNIT/5ACRES), TO RM -6, MULTIPLE -FAMILY RESIDENTIAL DISTRICT (UP TO 6 UNITS/ACRE), AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, has held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit: A PARCEL OF LAND SITUATED IN TRACT 9, SECTION 1, TOWNSHIP 33 SOUTH, RANGE 38 EAST ACCORDING TO THE LAST GENERAL PLAT OF LANDS OF THE INDIAN RIVER FARMS COMPANY SUBDIVISION AS RECORDED IN PLAT BOOK 2, PAGE 25, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA; SAID LANDS NOW LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA AND THIS PARCEL OF LAND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE EAST ONE-QUARTER CORNER OF SAID SECTION 1, TOWNSHIP 33 SOUTH, RANGE 38 EAST AND THE NORTHEAST CORNER OF SAID TRACT 9; THENCE SOUTH 00°11'52" WEST, ALONG THE EAST LINE OF SAID SECTION 1 AND THE EAST Page 1 of 3 AneW\keui s‘it;L • ORDINANCE NO. 2004- 037 LINE OF SAID TRACT 9, A DISTANCE OF 630.00 FEET TO A POINT, THENCE NORTH 89° 54' 53" WEST, A DISTANCE OF 90.00 FEET TO A POINT ON THE WEST RIGHT-OF-WAY LINE OF 74TH AVENUE; THENCE SOUTH 00° 11' 52" WEST, ALONG THE WEST RIGHT-OF- WAY LINE OF SAlD 74TH AVENUE A DISTANCE OF 701 03 FEET TO A POINT ON THE SOUTH LINE OF SAID TRACT 9; THENCE SOUTH 89° 58' 51" WEST, ALONG THE SOUTH LINE OF SAID TRACT 9, A DISTANCE OF 697.76 FEET TO A POINT; THENCE NORTH 00° 11' 52" EAST, ALONG A LINE 50.00' EAST OF, AS MEASURED AT RIGHT ANGLES TO, THE WEST LINE OF THE EAST 25.61 ACRES OF SAID TRACT 9, A DISTANCE OF 702.30 FEET TO A POINT; THENCE SOUTH 89° 54' 53" EAST, A DISTANCE OF 697.75 FEET TO THE POINT OF BEGINNING AND CONTAINING 11.239 ACRES OF LAND MORE OR LESS. LESS AND EXCEPT CANAL RIGHT OF WAY AND ROAD RIGHTS OF WAY. is changed from A-1, Agricultural District (up to 1 unit/5 acres), to RM -6 Multiple -Family Residential District (up to 6 units/acre). All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 16th day of November; 2004. This ordinance was advertised in the Press -Journal on the 1st day of November, 2004, for a public hearing to be held on the 16th day of November, 2004, at which time it was moved for adoption by Commissioner Lowther , seconded by Commissioner Davis , and adopted by the following vote: Chairman Arthur R.
