HomeMy WebLinkAbout2004-042ORDINANCE NO. 2004- 042 AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR +/- 3.18 ACRES LOCATED SOUTH OF 17th STREET SW APPROXIMATELY 1,450 FEET EAST OF THE 43RD AVENUE FROM RS -3, SINGLE-FAMILY RESIDENTIAL DISTRICT (UP TO 3 UNITS/ACRE), TO CN, NEIGHBORHOOD COMMERCIAL DISTRICT, AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on such matters, held a public hearing and subsequently made a recommendation regarding this rezoning request; and WHEREAS, the Board of County Commissioners of Indian River County, Florida, did publish and send its Notice of Intent to rezone the hereinafter described property; and WHEREAS, the Board of County Commissioners has determined that this rezoning is in conformance with the Comprehensive Plan of Indian River County; and WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this rezoning request, at which parties in interest and citizens were heard; NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian River County, Florida, that the zoning of the following described property situated in Indian River County, Florida, to -wit: COMMENCE AT THE NORTHEAST CORNER OF TRACT 3, SECTION 34, TOWNSHIP 33 SOUTH, RANGE 39 EAST, INDIAN RIVER COUNTY, FLORIDA, THENCE RUN N89° 36' 30"W ALONG THE NORTH LINE OF' THE AFORESAID TRACT 3, SECTION 34, TOWNSHIP 33 SOUTH, RANGE 39 EAST A DISTANCE OF 679.30 FEET: THENCE RUN SOO° 22' 35"W A DISTANCE OF 30 00 FEET TO THE POINT OF BEGINNING. THENCE FROM THE POINT OF BEGINNING CONTINUE SOO° 22' 35"W A DISTANCE 252.15 FEET; THENCE RUN N89° 36' 30" W A DISTANCE OF 548.70 FEET; THENCE RUN N00° 23' 30"E A DISTANCE OF 252.15 FEET; THENCE RUN S89° 36' 30"E A DISTANCE OF 548.64 FEET TO THE POINT OF BEGINNING. CONTAINING ±3.18 ACRES AND Page 1 of 3 ORDINANCE NO. 2004- 042 SUBJECT TO EASEMENTS, RESERVATIONS, RESTRICTIONS AND RIGHTS-OF-WAY OF RECORD. is changed from RS -3, Single Family Residential District (up to 3 units/acre), to CN, Neighborhood Commercial District. All with the meaning and intent and as set forth and described in said Land Development Regulations. This ordinance shall become effective upon filing with the Department of State. Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on this 14th day of December, 2004. This ordinance was advertised in the Press -Journal on the 29th day of November, 2004, fora public hearing to be held on the 14th day of December, 2004, at which time it was moved for adoption by Commissioner navi s , seconded by Commissioner whpp1 Pr , and adopted by the following vote: Arthur R.
