ORDINANCE NO. 2003- 030
AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING
ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR 3.28 ACRES LOCATED
ALONG OLD DIXIE HIGHWAY, APPROXIMATELY 288 FEET NORTH OF 12TH STREET,
FROM CH, HEAVY COMMERCIAL DISTRICT, TO CG, GENERAL COMMERCIAL
DISTRICT; AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on
such matters, has held a public hearing and subsequently made a recommendation regarding this
rezoning request; and
WHEREAS, the Board of County Commissioners of Indian River County, Florida, did
publish and send its Notice of Intent to rezone the hereinafter described property; and
WHEREAS, the Board of County Commissioners has determined that this rezoning is in
conformance with the Comprehensive Plan of Indian River County; and
WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this
rezoning request, at which parties in interest and citizens were heard;
NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Iridian
River County, Florida, that the zoning of the following described property situated in Indian River
County, Florida, to -wit:
FROM A POINT OF BEGINNING AT THE NORTHEAST CORNER OF THE
SOUTH ONE HALF OF THE SOUTHWEST '/4 OF NORTHWEST '/4 OF
SECTION 12, TOWNSHIP 33 SOUTH, RANGE 39 EAST, RUN WEST ON A
LINE PARALLEL TO THE NORTH LINE OF SAID SOUTHWEST QUARTER
OF NORTHWEST QUARTER TO THE EXISTING EASTERLY ROW OF OLD
DIXIE HIGHWAY; THENCE RUN IN A SOUTHERLY DIRECTION ALONG
THE EASTERLY BOUNDARY OF SAID OLD DIXIE HIGHWAY ROW A
DISTANCE OF 265.43 FEET; THENCE RUN EASTERLY ON A LINE
PARALLEL TO THE NORTH PROPERTY LINE A DISTANCE OF 360.55 FEET;
THENCE RUN NORTHERLY 257.29 FEET TO THE POINT OF BEGINNING.

DIXIE HIGHWAY; THENCE ON A NORTHERLY DIRECTION PARALLEL TO
