AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING
ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR APPROXIMATELY
135.77 ACRES LOCATED ALONG THE WEST SIDE OF 43 11D AVENUE, NORTH OF
25TH STREET SW AND APPROXIMATELY 608 FEET SOUTH OF 17T" STREET SW,
FROM A-1, AGRICULTURAL DISTRICT (UP TO 1 UNIT/5 ACRES), TO RS -31
SINGLE-FAMILY RESIDENTIAL DISTRICT (UP TO 3 UNITS/ACRE); AND
PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency on
such matters, has held a public hearing and subsequently made a recommendation regarding this
rezoning request; and
WHEREAS, the Board of County Commissioners of Indian River County, Florida, did
publish and send its Notice of Intent to rezone the hereinafter described property; and
WHEREAS, the Board of County Commissioners has determined that this rezoning is in
conformance with the Comprehensive Plan of Indian River County; and
WHEREAS, the Board of County Commissioners has held a public hearing pursuant to this
rezoning request, at which parties in interest and citizens were heard;
NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian
River County, Florida, that the zoning of the following described property situated in Indian River
County, Florida, to -wit:
TRACTS 9 AND 16, IN SECTION 33, TOWNSHIP 33 SOUTH, RANGE 39 EAST,
ACCORDING TO THE PLAT OF LANDS FILED BY INDIAN RIVER FARMS
COMPANY IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF ST. LUCIE
COUNTY, FLORIDA, IN PLAT BOOK 2, PAGE 25; SAI.D LAND NOW LYING AND
BEING IN INDIAN RIVER COUNTY, FLORIDA, LESS AND EXCEPTING THAT
PORTION LYING IN STATE ROAD 611 (43RD AVENUE) AND 25"" STREET SW
(HAMILTON ROAD).
CONTAINING 75.905 ACRES, MORE OR LESS; AND

TRACT 1, LESS THE NORTH 19.5 ACRES, AND TRACT 8 LESS CANAL, ALL IN
SECTION 33, TOWNSHIP 33 SOUTH, RANGE 39 EAST, ACCORDING TO THE LAST
GENERAL PLAT OF LANDS OF INDIAN RIVER FARMS COMPANY AS RECORDED
IN PLAT BOOK 2, PAGE 25 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY,
FLORIDA, SAID LANDS NOW LYING AND BEING IN INDIAN RIVER COUNTY.
FLORIDA, SAID PARCEL CONTAINS 59.78 ACRES, MORE OR LESS.
Be changed from A-1, Agricultural -1 District (up to 1 unit/5 acres), to RS -3, Single -Family
Residential -3 District (up to 3 units/acre).
All with the meaning and intent and as set forth and described in said Land Development
Regulations.
This ordinance shall become effective upon filing with the Department of State.
Approved and adopted by the Board of County Commissioners of Indian River County, Florida, on
this 2nd day of December, 2003.
This ordinance was advertised in the Press -Journal on the 11 th day of November, 2003, for a public
hearing to be held on the 2nd day of December, 2003, at which time it was moved for adoption by
Commissioner Adam seconded by Commissioner Neuberger and
adopted by the following vote:
