AN ORDINANCE OF INDIAN RIVER COUNTY,
ESTABLISHING REGULATIONS CONCERNING THE
DISCHARGE OF FIREARMS.
WHEREAS, the State has regulated the discharge of firearms in public
(Section 790.15, F.S.); and
WHEREAS, said regulations, among other things, prohibit the discharge
of firearms over or on the right-of-way of any paved public roads; and
WHEREAS, Indian River County has a number of unpaved roads in
developed areas; and
WHEREAS, it is in the public health, safety and welfare to afford this
protection to persons in the vicinity of unpaved roads,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, that:
SECTION 1. AMENDMENT.

It is unlawful for any person to discharge a firearm on or over
the right-of-way of any public road, highway or street in Indian
River County whether paved or unpaved. This section does not
apply to a person lawfully defending life or property or performing
official duties requiring the discharge of a firearm or to a person
discharging a firearm on public roads or properties expressly
approved for hunting by the Fish and Wildlife Conservation
Commission or Division of Forestry.
SECTION 2. SEVERABILITY.
If any section, or any sentence, paragraph, phrase, or word of this
ordinance is for any reason held to be unconstitutional, inoperative, or void, such
holding shall not affect the remaining portions of this ordinance, and it shall be

unconstitutional, invalid or inoperative part.
SECTION 3, EFFECTIVE DATE.
A certified copy of this ordinance, as enacted, shall be filed by the Clerk
with the Office of the Secretary of State of the state of Florida within ten days
after enactment, and this ordinance shall take effect upon filing with the
Secretary of State.
Approved and adopted by the Board of County Commissioners of Indian
River County, Florida, on this 11 th day of , 2000.
This ordinance was advertised in the Vero Beach Press Journal on the 9th
day of June for a public hearing on the 11`h of July, 2000, at which time it was
moved for adoption by Commissioner Stanbridge and seconded
by Commissioner Ginn , and adopted by the following vote:
The Chairman thereupon declared the ordinance duly passed and
adopted this 11 th day of July , 2000.
