PRESENT WERE ALMA LEE Loy, CHAIRMAN, EDWARD J. MASSEY, VICE CHAIRMAN; WILLARD W. SIEBERT, JR.; .JACK U. DRITENBAS. RICHARD P. BOGOSIAN WAS ABSENT. ALSO PRESENT WERE JACK G, .JENNINGS, COUNTY ADMINISTRATOR; PAUL D. BURCH, ATTORNEY TO THE BOARD OF COUNTY COMMISSIONERS; LS. THOMAS COUNTY FINANCIAL COORDINATOR AND ELIZABETH FORLANI, DEPUTY CLERK. THE CHAIRMAN CALLED THE MEETING TO ORDER. ATTORNEY BURCH PRESENTED TO THE BOARD FOR THEIR REVIEW AND APPROVAL A TRIPARTITE AGREEMENT BETWEEN THE CITY - COUNTY AND HOSPITAL FOR THE PURPOSE OF ALLOWING THE CITY TO TEMPORARILY PROVIDE WATER SERVICE TO THE HOSPITAL DURING CONSTRUCTION OF THE NEW HOSPITAL, THE SITE OF WHICH LIES IN THE COUNTY SERVICE AREA, ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER MASSEY, THE BOARD UNANIMOUSLY APPROVED THE TRIPARTITE AGREEMENT AND AUTHORIZED THE SIGNATURE OF THE CHAIRMAN, B00lt ; PAGE4Q 1 r 4 TRIPARTITE AGREEMENT ,THIS TRIPARTITE AGREEMENT entered. into between the CITY OF VERO BEACH, FLORIDA, hereinafter referred to as "City", INDIAN RIVER COUNTY, FLORIDA, hereinafter referred to as "County", and THE INDIAN RIVER COUNTY HOSPITAL DISTRICT, hereinafter referred to as "Hospital", WITNESSETH: WHEREAS, the City and County entered into an Agreement dated January 11, 1973, a copy of which is attached hereto as Exhibit "A", and WHEREAS, the City, County and Hospital desire to enter into a Tripartite Agreement as required under the January ll, 1973, Agreement for the purpose of allowing the City to temporarily provide water service to the Hospital during construction of the new hospital, 'the site of which lies in the County service area, and WHEREAS, by entering into this Tripartite Agreement, all parties agree as follows: 1. All parties agree the Hospital must have temporary water service during construction of the new Hospital. 2. All parties agree that the- County cannot provide -said temporary water service at this time and only the City can provide said j service. 3. The City agrees to provide said temporary water service to the new Hospital site, the legal description of which is shown on Exhibit "B" attached hereto. 4. City and Hospital shall by agreement set the terms and conditions for said temporary water service and the County hereby agrees to the same. M 5. This Agreement shall be in force until ninety (90) days after permanent water and sewer service is provided to the Hospital or until amended or modified by mutual agreement of all parties.
