RESOLUTION NO. 2007-1 3 3 A RESOLUTION OF BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA CONFIRMING THE ASSESSMENT ROLL FOR CERTAIN PAVING AND DRAINAGE IMPROVEMENTS TO 1st ROAD FROM 35th AVENUE TO 32"d AVENUE IN VERO BEACH HOMESITES SUBDIVISION - IRC PROJECT NO. 0522 WHEREAS, the Board of County Commissioners of Indian River County adopted Resolution No. 2007-092 providing for certain paving and drainage improvements to 1st ROAD FROM 35th AVENUE TO 32"d AVENUE IN VERO BEACH HOMESITES SUBDIVISION. WHEREAS, said resolution described the manner in which the special assessments are to be made and how the special assessments are to be paid; and WHEREAS, the resolution was published as required by Section 206.06, Indian River County Code; and WHEREAS, the Board of County Commissioners of Indian River County passed Resolution No. 2007-093, on September 11, 2007 which set a time and place for a public hearing at which the owners of the properties to be assessed and other interested persons would have the chance to be heard as to any and all complaints as to said project and said special assessments, and for the Board to act as required by Section 206.07, Indian River County Code; and F:\Engineering\Petition Paving\0522 1st Rd. from 32nd Ave. to 35th Ave\0255 Resolution-Confirming-mjm.doc This document was prepared by and should be returned to the County Attorney's Office 1801 27th Street Vero Beach, Florida 32960 1 BK: 2209 PG: 1983 • RESOLUTION NO. 2007- 133 WHEREAS, notice of the time and place of the public hearing was published in the Vero Beach Press Journal Newspaper on September 17, 2007 and September 24, 2007, (twice, one week apart, and the last being at least one week prior to the hearing), as required by Section 206.06, Indian River County Code; and WHEREAS, the land owners of record were mailed notices at least ten days prior to the hearing, as required by Section 206.06, Indian River County Code; and WHEREAS, the Board of County Commissioners of Indian River County on Tuesday., October 2, 2007 9:05 A.M. conducted the public hearing with regard to the special assessments, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: 1. The foregoing recitals are affirmed and ratified in their entirety. 2. The Board finds that the properties assessed by this resolution will receive special benefits equal to or greater than the cost of the assessment. 3. The special assessments shown on the attached assessment roll are hereby confirmed and approved, and shall remain legal, valid, and binding first liens against the properties assessed until paid in full. 4.
