HomeMy WebLinkAbout2009-029RESOLUTION #2009- 029 A RESOLUTION OF INDIAN RIVER COUNTY AMENDING THE SCHEDULE OF FEES FOR PLAN REVIEW AND INSPECTIONS; ESTABLISHING DIFFERENT CATAGORIES FOR SPECIAL EVENTS; AMENDING THE PENALTY FOR VIOLATION OR FAILING TO OBTAIN A PERMIT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Indian River County Emergency Services District ("District") is responsible for inspecting all property and investigating for fire hazards, including the enforcement of a fire prevention code; and WHEREAS, on July 6, 2004, the Board of County Commissioners of Indian River County adopted Ordinance No. 2004-021 enacting the Indian River County Emergency Services District Fire Code; and WHEREAS, pursuant to the above referenced authority, the District provides to the public certain plan review, inspection and code enforcement services through its Fire Marshal; and WHEREAS, the Board adopted Resolution 2004-071 which established fair and reasonable fees for said services, and fines for violations of the code, pursuant to the provisions of Sections 208.10-14 of Ordinance No. 2004-021; and WHEREAS, the Board deems it necessary to amend Resolution 2004-071 as it pertains to fees charged to organizers of Special Events for plan review, inspection services and penalties for code enforcement. NOW, THEREFORE, be it resolved by the Board of County Commissioners of Indian River County as follows: 1. The Board hereby adopts the following amended Schedule of Fees for Permits for Special Events: Permits Category 1 No Fee For a one -day Special Event with no electrical services, no cooking and not to exceed 25 exhibit sites. Exhibit sites may use tents not to exceed 12'x12'. The event organizer shall submit a site drawing/sketch roughly to scale on 8x11 paper. The site drawing shall display all exhibit sites. Approval of site drawing shall serve as an inspection of the event. Category 2 $30 Fee For non-consecutive but recurring one -day Special Events utilizing any type of electrical services or cooking and no more than 25 exhibit sites. Exhibit sites may use tents not to 1 RESOLUTION #2009-.029 exceed 12'x12'. The event organizer shall use the existing permitting process. However, the permit will remain in effect for 120 days as long as the event organizer submits written notice each 30 days affirming no site changes and the upcoming dates of operation. Category 3 $30 Fee All other Special Events. Failure to obtain a Special Event Permit in advance of the Special Event or violations of this section shall be punishable by a fine of up to $200.00. 2. Except as amended above, the Schedule of Fees for Plan Review, Inspections, Cost Recovery, Code Enforcement and Violation and Fine Schedule set forth in Resolution 2004-071 shall remain unchanged 3. This Resolution shall take effect March 17, 2009 Duly passed and adopted by the Board of County Commissioners of Indian River County, this 17th day of March, 2009. The resolution was moved for adoption by Commissioner 0' Bryan , and the motion was seconded by Commissioner Flac;rhPr and, upon being put to a vote, the vote was as follows: Chairman Wesley S.
