HomeMy WebLinkAbout2008-201RESOLUTION NO. 2008-.201 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, AMENDING CERTAIN OF THE EXISTING FEES AND PROCEDURES FOUND IN PART A, LICENSE AND IMPOUNDMENT FEES, OF RESOLUTION 2006-005 RELATED TO THE ENFORCEMENT OF THE ANIMAL CONTROL ORDINANCE WHEREAS, the Board of County Commissioners of Indian River County ("Board"), pursuant to Florida Statutes sections 125.01 and 828.27, has adopted an animal control ordinance, codified in Chapter 302 of The Code of Indian River County, that allows the Board to establish certain fees and procedures related to the animal control ordinance; WHEREAS, the amendments to Chapter 302 of The Code of Indian River County, adopted following a duly -noticed public hearing held on December 16, 2008, that allow three year licenses to be purchased for dogs and cats effective on February 9, 2009 require amendments to Part A 1a, License and Impoundment Fees, of Resolution 2006- 005, adopted January 17, 2006. WHEREAS, effective on February 9, 2009, the LICENSE FEES established in Part A 1a, License And Impoundment Fees, of Resolution 2006-005 are hereby superseded by this Resolution; and WHEREAS, effective on the adoption date of this Resolution, being December 16, 2008, the PROCEDURES AND ADDITIONAL FEES established in Part A 1e, License And Impoundment Fees, of Resolution 2006-005 are hereby superseded by this Resolution; and WHEREAS, on the adoption date of this Resolution, being December 16, 2008, all other fees, procedures and civil penalties established in Parts B and C of Resolution 2006-005, and all remaining portions of Part A 1, License And Impoundment Fees, not otherwise amended by this Resolution, are hereby declared to remain in full force and effect and are not modified or superseded by this Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: A. LICENSE AND IMPOUNDMENT FEES. 1. The license and impoundment fees, penalties, and procedures shall be as follows: a. LICENSE FEES EFFECTIVE FEBRUARY 9,2009: 1. Unsterilized female or male dog or cat, initial or one (1) year rabies vaccination and one (1) year license - $20.00 per year. 2. Unsterilized female or male, dog or cat, three (3) year vaccination and three (3) year license - $50.00 [fee covers three (3) years]. 1 3. Unsterilized female or male, dog or cat, three (3) year vaccination and one (1) year license- $20.00 per year. 4. Sterilized female or male, dog or cat, initial or one (1) year rabies vaccination and one (1) year license - $10.00 per year. 5. Sterilized female or male, dog or cat, three (3) year vaccination and three (3) year license - $25.00 [fee covers three (3) years]. 6. Sterilized female or male, dog or cat, three (3) year vaccination and one (1) year license- $10.00 per year. 7. One-half of the applicable license fee will be charged for any initial license issued for six (6) months or less. 8. All renewals shall be at full price per category. 9. Additional late charge for licensing after date required by law - $5.00. 10. Fee for issuance of duplicate license tag - $5.00. 11. There is no fee required for an animal license for the year in which the animal is sterilized. 12. There is no license fee required for police dogs (sheriff and municipal police departments) or service animals; however, such dogs are required to be licensed. 13. All licensing fees are to be paid to the Department of Emergency Services, Animal Control Division of Indian River County, Florida. e. PROCEDURES AND ADDITIONAL FEES EFFECTIVE DECEMBER 16. 2008. 1. Impoundment fees and redemption penalties during business hours shall be paid at the Office of the Clerk of the Circuit Court, Indian River County Courthouse, 2000 16th Avenue, Vero Beach, FL 32960. Impoundment fees and redemption penalties payable during non -business hours, Saturdays, and Sundays shall be paid at a location to be designated by the Animal Control Director in writing. In addition to all other fees and penalties, there is a collection fee of $10.00 that is to be paid to the Clerk of the Circuit Court. 2. An owner shall pay all actual expenses and fees incurred for which the County has obligated itself for additional care for quarantine or veterinary services as an impoundment fee, at the time of redemption of the animal. 3. For animals subject to bite quarantine only, the owner shall prepay for both: (a) a rabies vaccination in the amount of $20.00 per animal; and (b) the applicable license fee per animal, prior to redemption. 4. Any civil penalties imposed by County Court for violation of the Code as established by this Resolution. 5. All fees, penalties, charges, and expenses shall be paid prior to release of an animal from an impoundment facility. 6. All prepaid rabies vaccination and license fees will be forfeited at the end of thirty (30) days. 2 This Resolution was moved for adoption by Commissioner O'Bryan and the motion was seconded by Commissioner Flescher and upon being put to a vote, the vote was as follows: Chairman Wesley S. Wheeler AYE The Chairman thereupon declared this Resolution duly passed and adopted this 16th day of December, 2008, with the effective dates as set forth hereinabove.
