HomeMy WebLinkAbout2008-013RESOLUTION 2008=013 A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, AMENDING RESOLUTION NO. 99-58 [RATE RESOLUTION] ADOPTING THE DEPARTMENT OF UTILITY SERVICES SCHEDULE OF WATER AND SEWER RATES, FEES, AND OTHER CHARGES. WHEREAS, pursuant to Ordinance No. 91-9, duly adopted by the Indian River County Board of County Commissioners on June 22, 1999 and codified in Chapter 201 of The Code, Indian River County enacted Resolution No. 99-58, also known as the "Rate Resolution setting forth the schedule of water and sewer rates, fees and other charges for the Department of Utility Services effective October 1, 1999; and WHEREAS, commencing in 1991, the County has paid interest on water and sewer deposits; the current deposit amount is $50 for water and $50 for sewer; and WHEREAS, the interest on the amount deposited, as set forth in the Rate Resolution, is .00208% per month, or 2.5% a year; and WHEREAS, the County had been collecting social security numbers of individuals making water and/or sewer deposits to comply with the requirements of the Internal Revenue Service that a 1099 -INT form be sent if the County pays interest of more than $10 per year to an individual. The administrative burden on staff of Utilities, Budget, and Finance was disproportionate to the amount of interest paid. Increasingly, as a result of identity theft and other types of fraud associated with social security numbers, customers were quite reluctant to divulge their social security numbers; and WHEREAS, effective October 1, 2007, the Florida Legislature adopted new requirements with respect to the collection and dissemination of social security numbers by all political subdivisions in Florida; .and WHEREAS, the new law required a review by the County to determine whether our collection of social security numbers was in compliance and the immediate discontinuation of any such collection of social security numbers that was not in compliance; and WHEREAS, as a result of the new legislation, the Utilities Department was advised immediately to discontinue the collection of social security numbers from individuals; and WHEREAS, by a duly noticed public hearing on even date herewith, the Board amended Section 201.08(h) of The Code to remove the requirement of paying interest on water and sewer deposits; and WHEREAS, amending rate resolution, Resolution 99-58 to remove the interest rate will complete the County's compliance with the new legislation. 1 RESOLUTION 2008=013 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida that: 1. The schedule of rates, fees, and charges set forth in Rate Resolution 99-58 is hereby amended to remove the interest rate paid on deposits, as set forth in Exhibit A, attached hereto and incorporated by this reference. 2. All other rates, fees, charges and other provisions of Rate Resolution 99-58 not amended by this Resolution shall remain in full force and effect until amended by subsequent duly adopted resolution of the Indian River County Board of County Commissioners. 3.
