THE SAME MEMBERS PRESENT.
ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY
COMMISSIONER MASSEY, THE BOARD UNANIMOUSLY AUTHORIZED OUT -OF -COUNTY
TRAVEL FOR THE COUNTY ADMINISTRATOR TO ATTEND A MEETING WITH THE
DEPARTMENT OF TRANSPORTATION ON AUGUST 9, 1974 IN FORT LAUDERDALE.
COMMISSIONER DRITENBAS , WHO WAS APPOINTED TO SERVE ON.
THE PIONEER OCCUPATIONAL CENTER NOW CALLED THE TRI -COUNTY
REHABILITATION CENTER, STATED THAT DUE TO A CONFLICT OF
MEETING DATES, THE REHABILITATION CENTER MEETS ON TU SDAY;NIGHT
IN STUART, AND THE COUNTY COMMISSION MEETS ON WEDNESDAY, IT IS IMPOSSIBL
TO ATTEND A MEETING IN STUART AND GET BACK IN TIME TO STUDY THE
MATERIAL NECESSARY FOR THE REGULAR COUNTY COMMISSION MEETING
AND SUGGESTED THAT THE BOARD APPOINT SOMEONE ELSE NOT ON THIS
BOARD TO ATTEND THESE MEETINGS AND BRING BACK REPORTS.
THE CHAIRMAN STATED THAT THIS REQUEST WILL BE HELD IN
ABEYANCE,
ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY
COMMISSIONER MASSEY, THE BOARD UNANIMOUSLY AUTHORIZED DONALD
MACDONALD TO ATTEND THE ANNUAL WATER RESOURCES MEETING IN
TALLAHASSEE, FLORIDA ON AUGUST 15, 1974.
ON MOTION BY COMMISSIONER MASSEY, SECONDED BY
COMMISSIONER SIEBERT, THE BOARD UNANIMOUSLY ACCEPTED THE BID
i OF GENE MORRIS FOR A 1973 CADILLAC AS BEING THE BEST BID IN
THE AMOUNT'OF $4,166.66.
THE BOARD THEN ADJOURNED AT 11:25 O'CLOCK A.M. AND
RECONVENED AT 1:30 O'CLOCK P.M.

HOME ADMIN.ISTRATION APPEARED REQUESTING APPROVAL OF THE
CONCEPT THAT INDIAN RIVER COUNTY OPERATE AND MAINTAIN URBAN
DEVELOPMENT UTILITIES AND REQUESTED CONSIDERATION OF THE
FOLLOWING TWO CONDITIONS:
1. THAT THE UTILITY SYSTEM BE RENOVATED TO THE COUNTY
CONSULTING ENGINEER'S REQUIREMENTS, AND
2. THAT AN OPERATING AGREEMENT BE FORMULATED ?HAT WOULD BE
AGREEABLE TO THE BOARD OF COUNTY COMMISSIONERS, FARMERS
HOME ADMINISTRATION AND THE BOARD OF DIRECTORS OF URBAN
DEVELOPMENT UTILITIES.
L. S. THOMAS, COUNTY COORDINATOR ASKED MR. .JONES
WHERE THE MONEY WOULD COME FROM TO DO THIS RENOVATING.
MR. .JONES REPLIED THAT F.H.A. WOULD PROVIDE THE
FUNDS NECESSARY; THAT THEY HAVE FUNDS SET ASIDE FOR THIS PURPOSE.

LEON YOUNG, REPRESENTING URBAN DEVELOPMENT UTILITIES
APPEARED AND STATED THAT HE WAS NOT NOTIFIED OF THIS MEETING BUT
READ ABOUT IT IN THE NEWSPAPER AND IS HERE TODAY IN OPPOSITION TO
F.H.A.'S SUGGESTION THAT THE COUNTY TAKE OVER THE MANAGEMENT OF
THIS SYSTEM. MR. YOUNG WAS RECENTLY HIRED BY URBAN DEVELOPMENT
UTILITIES TO MANAGE THIS SYSTEM,
JAR. YOUNG ASKED MR. .JONES WHERE THE $80,000.00 LOANED
BY F A A IS NOW LOCATED;
MR. .JONES STATED THAT THE MONEY IS IN THE BANK. THE
$80,000.00 WAS LOANED TO U.D.U. TO INSTALL A PERMANENT WELL IN
ORDER TO SERVE U.D.0 CUSTOMERS WITH POTABLE WATER. "TODAY WE
ARE TALKING ABOUT THE WATER AND SEWER SYSTEM AND IT IS A WHOLE
NEW BALLGAME."
MR. .JONES CONTINUED THAT F.H.A. OFFICIALS AGREE
THAT U.D.U. IS NOT ABLE TO MANAGE ITS OWN BUSINESS. MOST OF THE
PROGRESS MADE HAD BEEN.DONE BY F.H.P..; WE ARE NOT IN THE UTILITY
BUSINESS. THE SYSTEM IS IN DEFAULT AND WE DO NOT FEEL THAT
THE BOARD OF DIRECTORS OF P A U. ARE ABLE TO HANDLE THIS SYSTEM
AS IT SHOULD BE, VIE ARE WILLING TO EXPEND MORE MONEY TO GET THIS

MR. YOUNG STATED THAT U.D.U. HAS HAD MANAGEMENT PROBLEMS,
BUT HE FEELS THAT HE WILL BE ABLE TO PUT THIS SYSTEM ON A
SOUND BASIS AND SHOULD BE GIVEN THAT CHANCE. HE ALSO REQUESTED
THAT THIS MEETING BE POSTPONED*UNTIL U.D.U.'S ATTORNEY, CHARLES
HERRING CAN BE PRESENT.
MR. YOUNG WENT ON TO EXPLAIN THE PROBLEMS ENCOUNTERED
WITH THE SEWER SYSTEM , WHICH IS MAINLY THE FACT OF HAVING ONE
LIFT STATION AND THE LAW REQUIRES TWO, BUT EQPIPMENT FOR ANOTHER
LIFT STATION HAS BEEN RECEIVED AND IS WAITING TO BE IW TALLED.
CHAIRMAN Loy INFORMED 11R. YOUNG THAT U.D,U'S DIRECTORS
HAVE BEEN BEFORE THE COUNTY COMMISSIONERS REQUESTING THAT THE
COUNTY TAKE OVER THE MANAGEMENT OF THIS SYSTEM,
MR. YOUNG STATED THAT AT THAT TIME HE WAS IN FAVOR
OF THE COUNTY TAKING OVER THIS SYSTEM, BUT THE COUNTY DID
NOTHING ABOUT THIS AND HE DECIDED TO WORK AS A MANAGER TO CET
THIS SYSTEM ON A SOUND BASIS.
THE BOARD EXPRESSED AN INTEREST IN F.H.A.'S PROPOSAL AS
PRESENTED BY ROBERT .JONES AS A POSSIBLE SOLUTION TO U.D.U.'S
PROBLEMS AND THEY ENCOURAGED F.H.A. TO PROCEED WITH WHATEVER STEPS
ARE NECESSARY,
THE CHAIRMAN STATED THAT IT WILL BE IN THE BEST INTEREST
OF EVERYONE CONCERNED IF F.H.A., U.D.U. AND THE BOARD SIT DOWN AND
WORK THIS PROBLEM OUT.
MR, JONES STATED THAT THE FIRST STEP NOW IS FOR THE
COUNTY, F.H.A AND U.D.U'S ENGINEERS AND ATTORNEYS TO SCHEDULE A
MEETING.
THE CHAIRMAN STATED THAT OUR ENGINEERS AND ATTORNEY WILL
BE CONTACTED WHEN A MEETING IS SCHEDULED.

BOARD THAT THIS AREA KNOWN AS EAST GIFFORD WAS ZONED PRIMARILY.
INDUSTRIAL AND THERE ARE A NUMBER OF RESIDENTS IN THE AREA WANTING
TO BUILD HOUSES, BUT BECAUSE OF THE ZONING QRDINANCE;"ADOPTED`IN
1971, THEY HAVE TO PAY A FEE TO HAVE THE ZONING CHANGED TO RESIDENTIAL
IN ORDER TO BUILD. THE PLANNING DEPARTMENT WAS DIRECTED TO PREPARE
A PLAN OF THIS AREA,
THIS AREA IS LOCATED WEST OF THE RAILROAD TO 43RD AVENUE,
SOUTH TO SOUTH GIFFORD ROAD AND THE CITY LIMITS, AND P+�RTH TO
LINDSEY ROAD. �
MR. BRENNAN STATED THAT AT THE PUBLIC HEARING -BEFORE THE
ZONING COMMISSION, .JULY 25, 1974, THE BOARD RECOMMENDED THE
REZONING OF EAST GIFFORD AS ADVERTISED, SUBJECT TO THE FOLLOWING
CHANGES. THE PROPERTY KNOWN AS PIERSON•s ENTERPRISES (A JUNK YARD),
ON SOUTH GIFFORD ROAD BE CHANGED FROM LM -1 TO M-1 ZONING AND THE
PROPERTY ON THE SOUTHEAST CORNER OF SOUTH GIFFORD ROAD AND THE
RAILROAD BE CHANGED FROM LM -1 TO R -2B ZONING.
THE CHAIRMAN ASKED IF ANYONE PRESENT WISHED TO BE HEAP.D.
GODFREY GIPSON, REPRESENTING THE GIFFORD .JAYCEES APPEARED
AND STATED THAT HE WAS IN FAVOR OF THE CHANGE TO R -2B ZONING OF THE
SOUTHEAST CORNER OF SOUTH GIFFORD ROAD THAT THE ZONING COMMISSION
RECOMMENDED. MR. GIPSON STATED THAT SOUTH GIFFORD ROAD IS THE MAIN
ENTRANCE INTO GIFFORD AND IF ZONED LM -1 THERE WOULD BE NO CONTROL
OVER WHAT COULD BE BUILT AND WOULD NOT BE AS ATTRACTIVE AS RESIDENTIAL
ZONING. THE CITIZENS OF THIS COMMUNITY WOULD LIKE TO CONTROL THE
DENSITY OF THE COMMUNITY AND ARE IN FAVOR OF R -2B ZONING,
RUDOLPH SMITH ALSO REPRESENTING THE GIFFORD .JAYCEES APPEARED
AND ALSO SPOKE IN FAVOR OF THE ZONING COMMISSIONS RECOMMENDATION
TO REZONE THIS 23 ACRES ON SOUTH GIFFORD ROAD TO R -2B ZONING.

ARE CONTENT WITH THE ZONING OF M -Z FOR PIERSON'S ENTERPRISES AS IT
IS AN EXISTING JUNK YARD, BUT THEY WOULD LIKE TO KEEP OTHER JUNK
YARDS OUT OF THIS AREA,
J.R. RODGERS, OWNER OF INDIAN RIVER PARK INC., THE PROPERTY
IN QUESTION ON SOUTH GIFFORD ROAD AND THE RAILROAD APPEARED AND
STATED THAT HE HAS OWNED THIS PROPERTY SINCE APRIL 1973 WITH
THE INTENTION OF DEVELOPING IT WITH HIGH CLASS BUSINESSES AND HE
STATED THAT R-213 IS NOT THE BEST USE OF THIS PROPERTY AND IT SHOULD
BE LEFT IN INDUSTRIAL ZONING. HE STATED THAT'IT WOULD,.BE ILLOGICAL
TO ASSUME THAT THIS PIECE OF PROPERTY SHOULD BE DEVELOPED AS
RESIDENTIAL BECAUSE OF .ITS. CLOSE PROXIMITY. T0. THI~ RAILROAD. MR,
RODGERS CONTINUED THAT IT HAS NOT BEEN DEVELOPED YET BECAUSE
THEY ARE TRYING TO ATTRACT TENANTS WHO WOULD BE AN ASSET TO THE
COMMUNITY. THIS PROPERTY WOULD BE DEVELOPED WITH WAREHOUSES WHICH
MR. RODGERS FEEL THERE IS A NEED FOR IN INDIAN RIVER COUNTY.
THE PROPERTY WOULD BE FENCED TO -PROTECT CHILDREN IN THE AREA,
DARRELL FENNELL, ATTORNEY REPRESENTING INDIAN FIVER PARK
INC. APPEARED AND STATED THAT LIGHT INDUSTRY WOULD BE THE BEST
USE OF THE AREA AND AN ATTRACTIVE BUSINESS PARK COULD ENHANCE
THE VALUE OF THE.LAND. THE LOCATION OF THE PROPERTY NEXT TO A
RAILROAD BEING ZONED R-213 IS NOT LOGICAL.
LOIS KRAMER APPEARED AND REQUESTED CLARIFICATION OF THE
PROPOSED C—IA ZONING.
ANNA STICKMAN, REAL ESTATE AGENT WORKING WITH THE OWNER OF
INDIAN RIVER PARKS APPEARED AND EXPLAINED TO THE BOARD THE REASONS
FOR THE DELAY IN COORDINATING BUSINESS FOR THE DEVELOPMENT OF
THIS PROPERTY,
MR. BRENNAN STATED THAT WE SHOULD BE CONCERNED WITH WHAT IS
BEST FOR THE COMMUNITY. "WE MUST BE CAREFUL OF THE INDIVIDUAL, BUT
THE INDIVIDUAL'S PROBLEMS ARE SUBSERVIANT TO THE COMMUNITY IN ANY

THE BOARD APPROVED THE REZONING OF THE EAST GIFFORD AREA AS
ADVERTISED WITH THE EXCEPTION OF THE PIECE OF PROPERTY KNOWN AS
PIERSON'S ENTERPRISES, INC, ON SOUTH GIFFORD ROAD WHICH WILL BE
CHANGED FROM LM -1 TO M-1 ZONING AND THAT THE 23 ACRES ON SOUTH
GIFFORD ROAD WEST OF THE RAILROAD THAT THE 70NING COMMISSION
RECOMMENDED BEING CHANGED TO R-211, TO REMAIN AS ADVERTISED, LM -1,
AND ADOPTED THE FOLLOWING RESOLUTION #74-72,
RESOLUTION NO. 74-72
WHEREAS, the Indian River County Zoning Commission
has approved after public hearing the zoning classifications
as indicated on the attached map, and
WHEREAS, this Board did advertise and hold a public
hearing on August 7, 1974, and
WHEREAS, testimony and arguments were heard by this
Board;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN,RIVER COUNTY, FLORIDA, that the County
Zoning maps shall be changed to reflect the zoning classi-
fications as contained in the attached map.
