HomeMy WebLinkAbout2006-155RESOLUTION NO. 2006- 155 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, DELEGATING TO THE COUNTY ADMINISTRATOR OR DESIGNEE THE AUTHORITY TO EXECUTE STANDARD CONTRACTS FOR CONSTRUCTION FOR FINAL LIFT OF ASPHALT AND ACCOMPANYING CASH DEPOSIT AND ESCROW AGREEMENTS. WHEREAS, when properties are platted, the developer cannot receive a Certificate of Completion for the project until all the required improvements are installed, with the exception of sidewalks; and WHEREAS, many projects are designed for a final lift of asphalt to be laid over the minimum lift required by County Code, after the development has a majority of the homes constructed and before turnover of homeowner associations so that the roads are more aesthetically pleasing; and WHEREAS, in order to address the developers concerns about being able to obtain a Certificate of Completion prior to the final lift of asphalt being laid, and to deliver a "fresh" finished development to the homeowners, developer is allowed to enter into a standard form Contract for Construction for Final Lift of Asphalt to guaranty the installation of the final lift and to post cash in the amount of 125% of the estimated 1 F:\Attorney\Nancy\DOCS\RES\Reso autho admin re final lift.doc RESOLUTION NO. 2006- 155 cost as certified by Developer's engineer and approved by the County Engineer and execute a standard form Cash Deposit and Escrow Agreement, or in the alternative, post a letter of credit; and WHEREAS, it is in the best interests of the County and the public to be able to provide the standard forms in an expeditious manner; and WHEREAS, the execution of these standard forms is administrative in nature and does not require the attention of the Board; and WHEREAS, Section 101.05.1.q of the Code of Indian River County allows the Board to authorize the County Administrator, or his designee, to perform other duties on behalf of the Board. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: The above recitals are affirmed, and the County Administrator or designee is hereby delegated authority to execute Contracts for Construction for Final Lift of Asphalt and where cash is being posted, to execute the accompanying Cash Deposit and Escrow Agreements that are in standard form, with the approval signatures of the County Attorney or designee and the Budget Director or designee. The resolution was moved for adoption by Commissioner Davi s and the motion was seconded by Commissioner Bowden , and, upon being put to a vote, the vote was as follows: Arthur R.
