HomeMy WebLinkAbout2006-088RESOLUTION NO. 2006- 088 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, DELEGATING AUTHORITY TO THE COUNTY ADMINISTRATOR OR THE ASSISTANT COUNTY ADMINISTRATOR TO EXECUTE RESOLUTIONS CALLING LETTERS OF CREDIT WHICH MIGHT OTHERWISE EXPIRE BEFORE THE NEXT BOARD MEETING DUE TO CANCELLATION OF NORMALLY SCHEDULED COMMISSION MEETINGS. WHEREAS, the Board of County Commissioners, at its meeting of June 6, 2006, canceled the regularly scheduled Commission meetings for August 1, 2006, August 8, 2006, and August 15, 2006, with the next regularly scheduled meeting to be on August 22, 2006; and WHEREAS, various letters of credit are posted with the County to, among other things, guaranty performance or warranty of subdivision improvements; and WHEREAS, numerous letters of credit have certain call language requiring a resolution of the Board of County Commissioners declaring default or failure to post alternate security; and 1 F:\Attorney\Nancy\DOCS\RES\Reso autho admin re locs.doc RESOLUTION NO. 2006- 088 WHEREAS, Section 101.05.1.q of The Code of Indian River County allows the Board to authorize the County Administrator or his designee to perform other duties on behalf of the Board of County Commissioners; and WHEREAS, absent any Commission meetings during the period from July 19, 2006 through August 21, 2006, the need may arise for the County to be able to timely call letters of credit, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: 1. The above recitals are affirmed. 2. The County Administrator or the Assistant County Administrator are hereby delegated authority to execute resolutions on behalf of the Board of County Commissioners to call letters of credit which might otherwise expire or be close to expiring and requiring action to be taken before the Board of County Commissioners again meet due to cancellation of normally scheduled commission meetings. 3. Any resolutions executed by the County Administrator or the Assistant County Administrator to call letters of credit during the period from July 19, 2006 through August 21, 2006 are to be accompanied by a copy of this resolution delegating that authority.
