RESOLUTION NO, 2008-019
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER
COUNTY, FLORIDA, CANCELING TAXES UPON PUBLICLY OWNED LANDS,
PURSUANT TO SECTION 196.28, FLORIDA STATUTES.
WHEREAS, Section 196.28, Florida Statutes, allows the Board of County Commissioners of each
County to cancel and discharge any and all liens for taxes, delinquent or current, held or owned by the county
or the state, upon lands heretofore or hereafter conveyed to or acquired by any agency, governmental
subdivision, or municipality of the state, or the United States, for road purposes, defense purposes,
recreation, reforestation, or other public use; and
WHEREAS, such cancellation must be by resolution of the Board of County Commissioners, duly
adopted and entered upon its minutes properly describing such lands and setting forth the public use to which
the same are or will be devoted;.and
WHEREAS, upon receipt of a certified copy of such resolution, proper officials of the county and of
the state are authorized, empowered, and directed to make proper entries upon the records to accomplish
such cancellation and to do all things necessary to carry out the provisions of Section 196.28, Florida
Statutes;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
INDIAN RIVER COUNTY, FLORIDA, that:
• Pursuant to the authority of Section 196.28, Florida Statutes, any and all liens for taxes, delinquent or
current held or owned by Indian River County, against the property described in the Warranty Deed
recorded in OR Book 2236, Page 2137 (the "Deed"), attached hereto and incorporated herein by this
reference, are hereby canceled.
• The property set forth on the Deed was recently acquired by Indian River County to attain the ultimate
right-of-way for County Road 510 expansion.
• The Clerk to the Board of.County Commissioners is hereby directed to send a certified copy of this
resolution to the Tax Collector and the Property Appraiser with copies to Fixed Assets, Budget; and
the County Attorney's Office.
The resolution was moved for adoption by Commissioner Wesley S. Davis , and the motion was
seconded by Commissioner. Joseph E. Flescher and, upon being put to a vote, the vote was as follows:

This deed, made as of this 1.7th clay of January, 2008, by Tammy Lynn Vogel (formerly known as Tammy Lynn
Snyder), a single person (as Grantor); and Indian River County, Florida, a political subdivision of the State of
Florida, whose post office address is: 1801 27th Street, Vero Beach, FL 32960 (as Grantee);
(Wherever used herein, the terms "grantor" and "grantee" shall irtcltccle singular and plural, heirs,
legal representatives, and assigns of individuals, and the successors and assigns of corporations,
partnerships or other entities; wherever the context so adnii.ts or requires.)
WITNESSETH:
That the grantor, For and in consideration of the sum of $10.00 in hand paid by grantee, the receipt whereof is hereby
acknowledged, does hereby grant, bargain, sell, alien, remise, release, convey and confirm unto the grantee forever, all

West, (Bearings are based on said North line of the Northwest 1/4 of Section 31 and all other
bearings shown hereon are relative thereto), a distance of 668.49 feet to a point; thence South
00 degrees 24' 01" West, a distance of 40.00 feet to a point on the South right of way line of
C.R. 510 (Wabasso Road) and the Point of Beginning:
Thence continue South 00 degree 24' 01" West, with the East line of the. North 290 feet of the
East 300 feet of the West 1/2 of the Northeast 1/4 of the Northwest 1/4 of said Section 31, a
distance of 30.00 feet to a point; thence North 89 degrees 42' 02" West, a distance of 300.00 feet
to a point; thence North 00 degree 24' 01" East, with the West line of the North 290. feet of the
East 300 feet of the West 1/2 of the Northeast 1/4 of the Northwest 1/4 of said Section 31, a
distance of 30.00 feet to a point, thence South 89 degrees 42' 02" East, with said South right of
way line of C.R. 510, a distance of 300.00 feet to the point of beginning.
TOGETHER with all the tenements, hereditaments and appurtenances thereto belonging or in anywise appertaining.
TO HAVE AND TO HOLD the same in fee simple forever.
AND grantor hereby covenants with grantee that grantor is lawfully seized of said land in fee simple; that grantor has

and easements of record, if any; insofar as same are valid and enforceable (however, this clause shall not be construed
to reimpose same).
