FLORIDA MET IN SPECIAL SESSION AT THE COURTHOUSE, VERO BEACH, FLORIDA
ON THURSDAY, MAY 29, 1975 AT 7:30 O'CLOCK P.M. PRESENT WERE ALMA LEE
LOY, CHAIRMAN; WILLARD W. SIEBERT, JR., VICE CHAIRMAN; EDWARD J. MASSEY;
WILLIAM C. WODTKE, JR., AND EDWIN,S, SCHMUCKER. ALSO PRESENT WERE
JACK G. JENNINGS, COUNTY ADMINISTRATOR; PAUL D. BURCH, ATTORNEY TO THE
BOARD OF COUNTY COMMISSIONERS, AND ELIZABETH FORLANI, DEPUTY CLERK,
THE CHAIRMAN CALLED THIS MEETING TO ORDER AND STATED THAT
THE PURPOSE OF THIS MEETING IS TO CONSIDER THE ADOPTION OF A COMPRE—
HENSIVE LAND USE PLAN FOR THE UNINCORPORATED AREAS OF INDIAN RIVER
COUNTY.

DIRECTOR; ROBERT BERG, ASSISTANT PLANNING DIRECTOR; HARRY ADLEY OF ADLEY
AND ASSOCIATES, CONSULTANT WHO PREPARED THE ORIGINAL COMPREHENSIVE
LAND USE PLAN AND THEN WORKED WITH THE PLANNING DEPARTMENT ON THE REVI-
SIONS; AND RALPH SEXTON, CHAIRMAN OF THE INDIAN RIVER COUNTY ZONING
COMMISSION.
CHAIRMAN LOY STATED THAT THIS PLAN REPRESENTS A TREMENDOUS
AMOUNT OF HOURS OF WORK AND STUDY WITH DEVELOPERS AND CONSULTANTS ALL
PLANNING TOGETHER TO PRESENT A PIAN FOR THE ORDERLY GROWTH OF INDIAN
RIVER COUNTY.
RALPH SEXTON, CHAIRMAN OF THE ZONING COMMISSION, APPEARED
AND STATED THAT THE ZONING COMMISSION HAS WORKED ON THIS PLAN SINCE
JUNE OF 1971, AND THEY RECOMMEND ADOPTION OF IT TONIGHT.
VAL BRENNAN, PLANNING DIRECTOR, APPEARED AID PRESENTED SOME
BACKGROUND INFORMATION REGARDING THE PROGRESS OF THIS PLAN TO THIS
POINT.
MR. BRENNAN STATED THAT THE POPULATION CHART PREPARED IN 1971
SHOWED AN ANTICIPATED GROWTH IN INDIAN RIVER COUNTY OF 86,090 BY 1990,
IN 1974"wE ARE RIGHT ON COURSE WITH 45,933 AS .THE OFFICIAL POPULATION
FIGURE FOR INDIAN RIVER COUNTY, THE CITY OF VERO BEACH ANTICIPATED A
GROWTH OF 42,000 BY 1990 AND HAS AS ITS OFFICIAL FIGURE FOR 194,14,758,
MR, BRENNAN STATED THAT THE POPULATION IS INCREASING FASTER IN THE CITY
LIMITS, AND THE COUNTY IS FOLLOWING THE GROWTH PATTERN AS OUTLINED ON
THEIR CHARTS,
MR, BRENNAN INFORMED THE BOARD THAT IF EVERY PARCEL OF DEVEL-
OPABLE LAND WERE ACTUALLY DEVELOPED AS THE MASTER PLAN PRESENTED TODAY
INDICATES, THE COUNTY COULD HAVE ALMOST 582,640 RESIDENTS.
HARRY ADLEY OF ADLEY & ASSOCIATES, CONSULTANTS HIRED TO WORK
WITH THE PLANNING DEPARTMENT TO CREATE THIS MASTER PLAN, APPEARED AND
MADE HIS PRESENTATION,
HE STATED THAT HE HAS NEVER WORKED ON A MASTER PLAN PROJECT
WHERE MORE PEOPLE IN A COMMUNITY HAVE PARTICIPATED,
COMMISSIONER SIEBERT ASKED IF MR, ADLEY WOULD ENDORSE THIS
MASTER PLAN.
MR. ADLEY STATED THAT THIS IS AN ADOPTABLE PLAN, AND HE DOES
ENDORSE IT.

THE CHAIRMAN ASKED IF ANYONE PRESENT WISHED TO SPEAK,
KENDALL SHARP, ATTORNEY REPRESENTING FRED NICHOLS OF DAYTON,
OHIO, APPEARED AND STATED THAT HIS CLIENT OWNS 600 FEET OF OCEANFRONT •
PROPERTY ADJACENT AND SOUTH OF THE MOORINGS, EAST OF AIA,- AND HE IS
REQUESTING THAT THE MEDIUM DENSITY PROPOSED FOR THE MOORINGS BE EX-
TENDED TO INCLUDE HIS PROPERTY,
MR, BRENNAN STATED THAT THE SOUTH BEACH AREA HAS NOT CHANGED
FROM THE LOW DENSITY SHOWN ON THE ZONING MAP,
CHAIRMAN LOY ASKED IF THIS REQUEST HAD BEEN MADE TO THE ZONING
COMMISSION PRIOR TO THEIR PUBLIC HEARING AND IF THERE IS ANY IMMEDIATE
NEED FOR THE CHANGE,
MR, SHARP STATED THERE ARE NO IMMEDIATE PLANS FOR THIS PROPERTY,
MR, BRENNAN STATED THAT MR, NICHHOLS DID APPEAR AT A MEETING,
THE AREA TO -THE NORTH OF MR, NICHQLS' PROPERTY IS NOW IN MEDIUM DENSITY,
AND SINCE THE BOUNDARY LINE ON THE COMPREHENSIVE LAND USE MAP IS VERY
FLEXIBLE, IT WILL BE UP TO THE ZONING COMMISSION TO RULE ON IT, IR.
BRENNAN STATED THAT THEY HAVE TRIED TO PUT IN ROUNDED LINES SO THAT
BOUNDARIES CANNOT BE DEFINED BUT RATHER AN APPROXIMATE AREA SINCE THIS
IS NOT A ZONING MAP,
COMMISSIONER WODTKE ASKED MR, BRENNAN TO EXPLAIN THE DIFFER-
ENCE BETWEEN "LOW, MEDIUM OR NIGH" DENSITIES,
MR. BRENNAN STATED THAT LOW DENSITY IS DEFINED AS FOUR UNITS
PER ACRE, MEDIUM DENSITY AS EIGHT UNITS PER ACRE, AND HIGH DENSITY AS
FIFTEEN UNITS PER ACRE.
COMMISSIONER WODTKE FURTHER ASKED IF FOUR UNITS MEANS ZERO TO
FOUR UNITS OR SOMEWHERE BETWEEN ZERO AND FOUR AS THE MAXIMUM LOW DENSITY,
MR, BRENNAN STATED THAT OUR ZONING CATEGORIES WILL BREAK THE
DENSITIES DOWN, BUT THAT HAS NOT BEEN DETERMINED BY THE ZONING COMMISSION.
CARL ARCHER APPEARED AND STATED THAT HE HAS 10 ACRES OF PROPERTY
ON SOUTH GIFFORD ROAD WHICH IS LOCATED BETWEEN THE COUNTY LANDFILL AND
THE POLICE PISTOL RANGE, HE PURCHASED THE PROPERTY AS INDUSTRIAL, AND
NOW ACCORDING TO THE COMPREHENSIVE LAND USE PLAN, IT WILL BE RESIDENTIAL,
HE IS REQUESTING THAT HIS PROPERTY BE LEFT AS INDUSTRIAL,

MR. BRENNAN STATED THAT IN TIME THE COUNTY LANDFILL WILL BE
VACATED AND WHAT THAT PROPERTY WILL BE USED FOR IN LATER YEARS IS NOT
KNOWN. THERE IS NO INTENTION TO REZONE MR. ARCHER'S PROPERTY, BUT IT
MAY BE REZONED AT A LATER TIME, IF THE COUNTY DECIDES TO SELL THEIR
PROPERTY AND INDUSTRY COMES IN, THE AREA WILL REMAIN INDUSTRIAL, BUT IF
ITIS TURNED INTO A PARK, THE AREA WILL BE REZONED TO RESIDENTIAL.
MR, BRENNAN STATED THAT THE ZONING COMMISSION, UPON THE ADOPTION
OF THE COMPREHENSIVE LAND USE PLAN, IS GOING TO IDENTIFY PRIORITY AREAS
THAT SHOULD BE STUDIED IN WHICH THE COMPREHENSIVE LAND USE PLAN DOES NOT
AGREE WITH THE EXISTING AREAS, AND WE ARE GOING TO STUDY THOSE AREAS AND
THEN RECOMMEND CHANGES SO THAT THEY WILL CONFORM TO THE ZONING 1AP,
COMMISSIONER SCHMUCKER SUGGESTED THAT THE STRAIGHT LINES IN-
DICATING BOUNDARY LINES BE ROUNDED SO AS NOT TO BE SO DEFINITIVE.
MR, BRENNAN AGREED THAT THE STRAIGHT LINES ARE TOO DEFINITIVE.
COMMISSIONER P1ASSEY STATED THAT IT WAS HIS OPINION THAT THOSE
BOUNDARY LINES WERE GUIDE LINES AND WE SHOULD ACCEPT IT FOR THAT REASON,
COMMISSIONER SCHMUCKER RECOMMENDED THAT THE INDUSTRIAL AREA
DISCUSSED BY SMR, ARCHER BE MADE A BLOB INSTEAD OF A DEFINED AREA,
MR, SEXTON STATED THAT THERE WILL BE AN ORDINANCE ADOPTED TO
GO ALONG WITH THE MASTER PLAN, AND HE READ FROM THE PROPOSED ORDINANCE
AS FOLLOWS:
"THE LAND USE PLAN IS NOT A CONSTITUTION BUT A GUIDE ONLY TO
THE MOST COMPATIBLE, LEAST DISRUPTIVE, USES OF LAND ON A BROAD,
GENERAL AREA BASIS WITHOUT IN SOME CASES CONSIDERING THE PRESENT
USE OF LANDS INCLUDED THEREIN, A BROAD BRUSH APPROACH WAS USED
WITH THE INTENT THAT BOUNDARY LINES NOT BE INTERPRETED AS BEING
PERMANENTLY FIXED OR LOCATED, THE PLAN IS NOT ULTIMATELY DEFINI-
TIVE, IT IS SIMPLY A GAUGE FOR DETERMINING THE OPTIMUM DESIRABLE
DEVELOPMENT UNDER PRESENTLY KNOWN RESOURCES."
MR, SEXTON STATED THAT IF THIS PLAN IS ADOPTED, IT WILL BE
USED AS A GUIDE LINE, THE ZONING COMMISSION WILL DO THE REZONING,
COMMISSIONER SIEBERT ASKED FOR AN EXPLANATION OF THE CONSERVA-
TION AREAS,

MR, BRENNAN IDENTIFIED .THEM ON THE MAP AS "GREEN" AREAS AND
STATED THAT CONSERVATION AREAS MAINLY APPEAR ALONG THE RIVERFRONT, THEIR
MAIN PURPOSE IS TO CAUTION DEVELOPERS, AND ALSO TO INDICATE TO THE ZONING
COMMISSION THAT THERE IS LAND IN A CONSERVATION AREA AND THEY HAD BETTER
USE EXTREME CAUTION IN APPROVING IT FOR DEVELOPMENT,
COMMISSIONER SIEBERT SUGGESTED THAT THE LAND IN THE PROPOSED
DENSITY SHOULD BE CALLED ENVIRONMENTALLY SENSITIVE LAND, AS CONSERVATION
TO MOST PEOPLE MEANS THAT IT WILL=BE CONSERVED, AND HE SUGGESTED THAT
THEY SHOULD BE CALLED ENVIRONMENTALLY SENSITIVE LANDS AND HAVE A DENSITY,
CHAIRMAN LOY ASKED IF HE IS SUGGESTING THAT ALL THE CONSERVA-
TION AREAS BE CHANGED TO A NEW CATEGORY TO BE CALLED ENVIRONMENTALLY
SENSITIVE AREAS?
_COMMISSIONER SIEBERT STATED HE WAS OBJECTING TO THE METHOD USED
FOR PROJECTION OF POPULATION IN VARIOUS LAND USE AREAS, HE FURTHER STATED
THAT HE IS ALSO CONCERNED ABOUT A LACK OF HIGH DENSITY AREAS IN THE COUNTY
AND FEELS THERE ARE AREAS THAT CAN TAKE IT,
MIKE ZIEGLER, A MEMBER OF THE PELICAN ISLAND AUDUBON SOCIETY,
APPEARED'TO DISCUSS AN AREA OF CRITICAL WATER RECHARGE, HE SUGGESTED.
PLACING AN AREA LOCATED WEST OF THE RAILROAD AND FROM THE NORTH COUNTY
LINE TO THE SOUTH COUNTY.LINE IN AN ENVIRONMENTALLY SENSITIVE AREA, THIS
AREA OUTLINED WITH A DOTTED LINE SHOULD BE GIVEN A RED FLAG AND SHOULD
ONLY BE DEVELOPED WITH EXTREME CAUTION AS THIS IS AN IMPORTANT WATER
RECHARGE AREA,
JEROME KRAMER, COUNSELOR FOR THE VERO BEACH CIVIC ASSOCIATION,
APPEARED TO CONGRATULATE THE PLANNING AND ZONING DEPARTMENT FOR THE TRE-
MENDOUS JOB THEY HAVE DONE AND RECOMMENDED THE BOARD OF COUNTY COMMIS-
SIONERS ADOPT THE COMPREHENSIVE LAND USE PLAN,
FRANK ZORC APPEARED REQUESTING THAT THE AREA KNOWN AS HIBISCUS
AIRPORT BE REZONED BACK TO RESIDENTIAL ZONING TO CONFORM WITH SURROUNDING
ZONING, IT IS SHOWN ON THE COMPREHENSIVE LAND USE MAP AS 1EDIUM DENSITY,
BUT THE LAND ON ALL FOUR SIDES OF THE AIRPORT IS IN Low DENSITY,

COMMISSIONER SIEBERT STATED THAT THE HIBISCUS AIRPORT HAS
GONE THROUGH REZONING, WHICH AT THAT TIME THE ZONING COMMISSION RECOM-
MENDED REZONING AND THE PROPERTY WAS REZONED, BUT WE ARE NOT TALKING
ABOUT REZONING; WE ARE TALKING ABOUT THE COMPREHENSIVE LAND USE PLAN,
MR, ZORC ASKED IF HIBISCUS AIRPORT IS UNDER CONSIDERATION FOR
REZONING BY THE ZONING COMMISSION.
COMMISSIONER SIEBERT STATED THAT IF THE ZONING COMMISSION
DETERMIN 6 IT SHOULD BE REZONED, IT WILL BE REZONED,

TWO: ONE WAS FROM HOBART INDUSTRIES REQUESTING AN AMENDMENT TO THE
ORIGINAL PLAN TO SLIGHTLY INCREASE THEIR INDUSTRIAL AREA AND LEAVE THE
BALANCE OF THEIR LAND IN AGRICULTURE.
COMMISSIONER SIEBERT STATED THAT BECAUSE OF THE FACT THAT IT
LIES IN AN ENVIRONMENTALLY SENSITIVE AREA, THE USE OF THAT LAND WOULD
BE SCRUTINIZED VERY CLOSELY.
MR, GRICE STATED AS A ZONING COMMISSION MEMBER HE WAS IN
AGREEMENT WITH THIS CHANGE,
":THE OTHER CHANGE RECOMMENDED BY THE ZONING COMMISSION WAS A
PROPOSAL FROM MARSHALL BARNES. THE REQUEST IS TO EXTEND THE INDUSTRIAL
AREA OVER SLIGHTLY TO THE WEST TO INCLUDE A SMALL PORTION OF HIS PROPERTY
AND SO THAT IT CONFORMS WITH THE ZONING MAP,
CHAIRMAN LOY STATED THAT INSTEAD OF THE BOUNDARY LINES BEING

COMMISSIONER SCHMUCKER STATED THAT HE WOULD LIKE TO FURTHER

HE STATED THAT HE FEELS IT IS NOT PRACTICAL TO KEEP THE SOUTH
BEACH AREA FULLY RESIDENTIAL. IF THIS HAPEENS, WE WILL HAVE CONSTANT
PRESSURE FROM THE DEVELOPERS. WE HAVE A CONTINUOUS LINE OF MEDIUM
DENSITY ALONG THE NORTH BEACH AND MAYBE THAT SHOULDN'T BE AS CONSISTaNT
AS IT IS, BUT THERE SHOULD BE SOME MEDIUM DENSITY ON THE SOUTH BEACH.
COMMISSIONER SIEBERT STATED THAT HE FEELS THERE IS A DISTINCT
DIFFERENCE BETWEEN THE NORTH AND THE SOUTH BEACH AREAS, THE DIFFER€NCE

AREA AND AT THE SAME TIME ALLOW THE PROPER MIXTURE IN THAT AREA,
COMMISSIONER WODTKE STATED WHAT WE SHOULD LOOK FOR IS AN OVER-
ALL CONCEPT FOR THE ENTIRE COUNTY WITH A MIXTURE OF THE NUMBERS OF PEOPLE
THAT WE FEEL WE CAN PROPERLY PUT IN THE AREAS WE WOULD LIKE TO HAVE DE-
VELOPED, WITH THE PROPER BALANCE, AND WITH THE PRIMARY CONCERN OF PRO-
TECTING AND SAVING OUR AGRICULTURE LAND, WE ARE ADDRESSING OURSELVES
PRIMARILY TO THE BEACH AREA AT THIS TIME, THERE IS CONSIDERABLE MULTIPLE
FAMILY IN THE NORTH END THAT IS UNDEVELOPED, BUT IT IS MY FEELING THAT
THIS IS THE CONCEPT OR PLAN WE ARE LOOKING TOWARDS, "'!E ARE NOT SPECIFI-
CALLY TRYING TO TELL A MAN WHO OWNS PROPERTY WHAT HE CAN PUT THERE, BUT
WE ARE SAYING THIS IS WHAT WE WOULD LIKE TO HAVE THERE, You KNOW BASICALLY
IN THAT AREA WITH THE LOW DENSITY AND THE MEDIUM DENSITY THE NUMBER OF
PEOPLE YOU WOULD LIKE TO SEE THERE, BUT IF IT DEVELOPS A LITTLE DIFFERENTLY
LIKE COMMISSIONER SIEBERT SAID WITH THE NEW P,U,D, ORDINANCE WE HOPE TO
ADOPT, THIS COULD GREATLY CHANGE THE WAY THE AREA COULD BE DEVELOPED.

AREAS LOCATED AT THE SOUTH COUNTY LINE AND I-95 FROM ENVIRONMENTALLY
SENSITIVE (AREAS TO AGRICULTURE,
A MOTION WAS MADE BY COMMISSIONER SIEBERT, SECONDED BY COM-
MISSIONER MASSEY, TO INCORPORATE THE CHANGE RECOMMENDED BY THE ZONING
COMMISSION WITH REGARD TO HOBART INDUSTRIES' REQUEST TO SLIGHTLY IN-
CREASE THEIR INDUSTRIAL AREA AND TO LEAVE THE BALANCE OF THEIR LAND
IN AGRICULTURE.
COMMISSIONER SCHMUCKER STATED THAT THIS IS A REZONING RE-
QUEST AND NOT A CONSIDERATION FOR THE COMPREHENSIVE LAND USE PLAN.

SIEBERT, THE BOARD UNANIMOUSLY APPROVED CONTINUING THIS PUBLIC HEARING
UNTIL JUNE 4TH AT 2:00 O'CLOCK P.M. FOR THE EXPRESS PURPOSES OF DIS-
CUSSING A PROPOSAL FOR IMPLEMENTATION OF THIS LAND USE PLAN,
