PRESENT WERE ALMA LEE LOY, CHAIRMAN; EDWARD J. MASSEY; WILLIAM C. WODTKE, JR.; AND EDWIN S. SCHMUCKER. ABSENT WAS WILLARD W. SIEBERT, JR., WHO WAS ON VACATION. ALSO PRESENT WERE PAUL D. BURCH, ATTORNEY TO THE BOARD OF COUNTY COMMISSIONERS; JACK G. JENNINGS, COUNTY ADMINISTRATOR; L.S. "TOMMY" THOMAS, COUNTY COORDINATOR; AND ELIZABETH FORLANI, DEPUTY CLERK, THE CHAIRMAN CALLED THE MEETING TO ORDER AND STATED THAT THIS SPECIAL MEETING WAS CALLED TO ADOPT A RESOLUTION SETTING FORTH THE RECOMMENDATIONS FOR INDIAN RIVER COUNTY BEACH EROSION CONTROL AND BEACH NOURISHMENT PROJECT. THE CHAIRMAN STATED THAT THERE ARE THREE STEPS TO BE OUTLINED IN THE RESOLUTION, AS FOLLOWS: 1, THAT THE COUNTY AGREES TO ACT AS THE LOCAL SPONSOR FOR SOME TYPE OF EROSION CONTROL PROJECT IN INDIAN RIVER COUNTY. 2. THAT THE COUNTY AGREES TO PROVIDE THE ASSURANCES THAT ARE REQUIRED OF ALL SPONSORS OF ALL FEDERAL CIVIL WORKS PROJECTS. 3. THAT THE COUNTY MAKE THEIR RECOMMENDATIONS TO THE CORPS OF ENGINEERS REGARDING SPECIFIC PROJECTS TO BE CONDUCTED IN INDIAN RIVER COUNTY. ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER WODTKE, THE BOARD UNANIMOUSLY AGREED THAT THE COUNTY WILL ACT AS THE LOCAL SPONSOR FOR THE PROPOSED BEACH EROSION PROJECTS. ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER MASSEY, THE BOARD UNANIMOUSLY AGREED THAT THE COUNTY WILL PROVIDE THE ASSURANCES THAT ARE REQUIRED OF ALL SPONSORS OF ALL FEDERAL CIVIL WORKS PROJECTS. ON MOTION BY COMMISSIONER WODTKE, SECONDED BY COMMISSIONER MASSEY, THE BOARD UNANIMOUSLY AGREED THAT THE FOLLOWING RECOMMENDATION #' CONCERNING THE SEBASTIAN STATE PARK AREA BE INCLUDED AS PART OF THE PROPOSED RESOLUTION: #1 THE FEDERAL PROJECT SHOULD PROVIDE FOR A PROTECTIVE AND Irk ,p -,11P RECREATIONAL BEACH AND FUTURE MAINTENANCE NOURISHMENT. IT WOULD BE VERY DESIRABLE FOR THE PROJECT TO PROVIDE FOR DEVELOPMENT OF A MORE EFFICIENT SAND TRANSFER SYSTEM AT THE INLET AND PARTICIPATION IN THE OPERATION OF THAT SYSTEM, WE WOULD PREFER TO HAVE THE BREAKWATER GROIN SOUTH OF THE INLET INCLUDED AS AN AUTHORIZED ALTERNATIVE FOR CON- STRUCTION ONLY AFTER ITS NEED IS CLEARLY DEMONSTRATED. A MONITORING PROGRAM SHOULD DEFINITELY BE INCLUDED AS A PART OF A PROJECT IN THIS AREA. THE MONITORING PROGRAM WOULD ASSIST IN THE EVALUATION OF THE PROJECT AND IS PARTICULARLY IMPORTANT FOR ASSESSING THE EFFECTIVENESS OF THE SAND TRANSFER OPERATION AT THE INLET AS WELL AS FOR DETERMINING THE NEED FOR THE DEFERRED STRUCTURE. ON MOTION BY COMMISSIONER WODTKE, SECONDED BY COMMISSIONER SCHMUCKER, THE BOARD UNANIMOUSLY AGREED THAT THE FOLLOWING RECOMMENDATION #2 AND #3 CONCERNING THE CITY OF VERO BEACH BE INCLUDED AS PART OF THE PROPOSED RESOLUTION. WITHIN THE CITY OF VERO BEACH: #2 RECOMMEND AND CONCUR WITH THE CORPS OF ENGINEERS' RECOM- MENDATION FOR BEACHFILL RENOURISHMENT IN THE PROJECT AREA, INCLUDING A BREAKWATER GROIN AS AN AUTHORIZED ALTERNATIVE FOR CONSTRUCTION ONLY AFTER ITS NEED IS CLEARLY DEMONSTRATED. A MONITORING PROGRAM WOULD ASSIST IN THE EVALUATION OF THE PROJECT AND IS PARTICULARLY IMPORTANT FOR ASSESSING THE RESULTS OF THE BEACH -FILL PROJECT. #3 RECOMMEND A TEST REEF KNOWN AS THE SABECON REEF BE AN AUTHORIZED ALTERNATIVE FOR CONSTRUCTION, UNDERTAKEN BY THE CORPS OF ENGINEERS AS AUTHORIZED BY THE UNITED STATES CONGRESS. THIS TEST REEF TO CONSIST OF TWO TANGENTS OF THE REEF WITH NO BEACH FILL ACCOMPANYING. PROJECT MONITORED TO EVALUATE RESULTS. BASED ON THE PROFESSIONAL TESTIMON PRESENTED DURING THE PUBLIC HEARINGS, THIS PROJECT COULD PROVIDE A NEW AVENUE FOR BEACH AND SHORE PROTECTION AND RESTORATION FOR THE ENTIRE COAST OF THE UNITED STATES. ON MOTION BY COMMISISONER WODKTE, SECONDED BY COMMISSIONER MASSEY, THE BOARD UNANIMOUSLY AUTHORIZED THE PREPARATION OF A RESOLUTION WITH THE ABOVE RECOMMENDATION NUMBERS 1,2, AND 3; AUTHORIZBDTHE SIGNATURE OF THE CHAIRMAN AND COPIES OF THE RESOLUTION BE SENT TO ALL STATE AND FEDERAL LEGISLATORS, RESOLUTION NO. 75-37 HAVING BEEN COMPLETED IS HEREBY BEING MADE A PART OF THESE MINUTES. 2 JUN 2 71975 Rix*: 23 porg111 JUN 2 71975 RESOLUTION NO. 75-37 WHEREAS, Indian River County has suffered beach erosion; and WHEREAS, a public hearing was held to attempt to find a solution to the problem; and WHEREAS, the City of Vero Beach, the Sebastian Inlet District and Indian River County have agreed to certain recom- mendations; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida that it supports the State of Florida's and Army Corps of Engineers' recommendations for the Sebastian State Park area as follows: 1. The Federal project should provide for a protective and recreational beach and future maintenance nourishment. It would be very desirable for the project to provide for development of a more efficient sand transfer system at the Inlet and partic- ipation in the operation of that system. We would prefer to have the breakwater groin South of the Inlet included as an authorized alternative for construction only after its need is clearly demon- strated. A monitoring program should definitely be included as a part of a project in this area. The monitoring program would assist in the evaluation of the project and is particularly import- ant for assessing the effectiveness of the sand transfer operation at the Inlet as well as for determining the need for the deferred structure. WITHIN.CITY OF VERO BEACH 2. Recommend and concur with the Corps of Engineers' recommendation for beachfill renourishment in the project area, including a breakwater groin as an authorized alternative for construction only after its need is clearly demonstrated. A monitoring program would assist in the evaluation of the project and is particularly important for assessing the results of the beach -fill project. 3. Recommend a test reef known as the Sabecon Reef be an authorized alternative for construction, undertaken by the Corps of Engineers as authorized by the United States Congress. This test reef to consist of two tangents of the reef with no to©K 23 11 2 beach -fill accompanying. Project monitored to evaluate results. Based on the professional testimony presented during the public hearings, this project could provide a new avenue for beach and shore protection and restoration for the entire. coast of the United States, and WHEREAS, the Board of County Commissioners of Indian River County, Florida agrees to be the sponsoring agent for the project and Jack Jennings the County Administrator, will be the County's contact man; and WHEREAS, the Board of County Commissioners of Indian River County agrees to a. Provide without cost to the United States all lands, easements, and rights-of-way, including borrow areas and reloca- tions necessary for construction of the improvements; b. Provide a cash contribution of the non -Federal share of the project cost, exclusive of costs for lands, easements, rights-of-way, relocations and alterations, the final percentage to be based on shore ownership and use at the time of construction; c. Assure maintenance of the project after completion as may be required to serve the intended purposes. For beach -fill type projects, a cash contribution will be provided for the non - Federal share of the cost for periodic nourishment, such contribu- tion to be made prior to each nourishment operation, and the final percentage to be based on shore ownership and use existing at the time of construction; d. Hold and save the United States free from damages due to construction works; e. Assure continued public ownership of the shore upon whichthe amount of Federal participation in the beach erosion control project is based and its administration for public use and, as appropriate, assure continued availability for public use of privately -owned shores where Federal aid is based on such use; f. Provide without cost to the United States appropriate access and facilities, including parking and sanitation, necessary for realization of the public benefits upon which Federal partici- pation is based; -2- g. Adopt appropriate ordinances, or provide other means, to insure the intended use of the beach -fill areas; and h. Control water pollution to the extent necessary to safeguard the health of bathers. CHAIRMAN LOY STATED THAT SHE HAS RECEIVED A VERBAL AGREEMENT FROM THE SEBASTIAN INLET DISTRICT REGARDING THE BEACH EROSION CONTROL PROJECT AND SHE HAS RECEIVED A RESOLUTION ADOPTED BY THE CITY OF VERO BEACH ACCEPTING THE RECOMMENDATIONS DISCUSSED AT THIS MEETING, THAT RESOLUTION I$ HEREBY BEING MADE A PART OF THESE MINUTES.: RESOLUTION NO. 2 V 37 RESOLUTION ACCEPTING RECOMMENDATIONS OF INDIAN RIVER COUNTY COMMISSION CON- CERNING RENOURISHMENT OF EROSION DAM- AGED BEACHES IN THE CITY OF VERO BEACH AND INDIAN RIVER COUNTY. WHEREAS, in the past twelve to eighteen months storms and accom- panying winds have considerably eroded and otherwise damaged large areas of the beaches existing in the City of Vero Beach and Indian River County; and WHEREAS, renourishment of the said beaches is an immediate need and in this regard on June 10, 1975, the Jacksonville District of the De- partment of Army Corps of Engineers conducted a public hearing in the City of Vero Beach, offering various methods by which beach renourishment can be accomplished; and WHEREAS, the Board of Commissioners of Indian River County met following the said public hearing and by. letter of June 20, 1975, from Jack G. Jennings, County Administrator, did relate the following recom- mendations to the City Council of the City of Vero Beach: 1. Support State of Florida's recommendations for Sebastian State Park area, including request project be monitored. Urgently recommends a test reef known as the Sabecon Reef be an authorized alternative for construction, undertaken by the Corps of Engineers as authorized by the United States Congress. Based on the professional testimony presented during the public hearings, this project could pro- vide a new avenue for beach and shore protection and restor ation for the entire coast of the United States. and WHEREAS, the City Council of the City of Vero Beach believes that the foregoing recommendations constitute an acceptable procedure for remedy- ing.the beach erosion hereinabove described; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERO BEACH that the foregoing recommendations are accepted by the City Coun- cil as an appropriate method to remedy the beach erosion problems existing in the City of Vero Beach and Indian River County, which recommendations should be immediately forwarded to the Jacksonville District of the Depart- ment of Army Corps of Engineers. HE WAS INFORMED THAT BECAUSE OF THE AMOUNT OF RAIN WE HAVE HAD THE EQUIPMENT CAN NOT GET TO THE BUILDING SITE AND THAT THIS IS AN EMERGENCY SITUATION. HE CONTINUED THAT WE DO HAVE THE FILL AND WE DO HAVE THE EQUIPMENT AND PERSONNEL TO HANDLE THIS REQUEST. ON MOTION BY COMMISSIONER WODTKE, SECONDED BY COMMISSIONER SCHMUCKER, THE BOARD UNANIMOUSLY AUTHORIZED THE COUNTY ADMINISTRATOR TO ASSIST THE COMMUNITY COLLEGE, IN THIS EMERGENCY SITUATION, BY SUPPLYING THE MINIMUM AMOUNT OF FILL NEEDED TO TAKE CARE OF THIS SITUATION.
