RESOLUTION NO. 2008- 181
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER
COUNTY, FLORIDA, CANCELING TAXES UPON PUBLICLY OWNED LANDS,
PURSUANT TO SECTION 196.285 FLORIDA STATUTES.
WHEREAS, Section 196.28, Florida Statutes, allows the Board of County Commissioners of each
County to cancel and discharge any and all liens for taxes, delinquent or current, held or owned by the county
or the state, upon lands heretofore or hereafter conveyed to or acquired by any agency, governmental
subdivision, or municipality of the state, or the United States, for road purposes, defense purposes,
recreation, reforestation, or other public use; and
WHEREAS, such cancellation must be by resolution of the Board of County Commissioners, duly
adopted and entered upon its minutes properly describing such lands and setting forth the public use to which
the same are or will be devoted; and
WHEREAS, upon receipt of a certified copy of such resolution, proper officials of the county and of
the state are authorized, empowered, and directed to make proper entries upon the records to accomplish
such cancellation and to do all things necessary to carry out the provisions of Section 196.28, Florida
Statutes;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
INDIAN RIVER COUNTY, FLORIDA, that:
• Pursuant to the authority of Section 196.28, Florida Statutes, any and all liens for taxes, delinquent or
current held or owned by Indian River County, against the property described in the Warranty Deed recorded
in OR Book 2292, Page 2170 (the "Deed"), attached hereto and incorporated herein by this reference, are
hereby canceled. The property set forth on the Deed was recently acquired by Indian River County under its
Environmental Bonds Land Acquisition Program to: conserve an historic homestead; preserve open space
along the Jungle Trail Greenway; provide public access to the Indian River Lagoon; restore habitat; and
provide public passive recreation access.
• The Clerk to the Board of County Commissioners is hereby directed to send a certified copy of this
resolution to the Tax Collector.
The resolution was moved for adoption by Commissioner Flescherand the motion was
seconded by Commissioner 0' Bryan , and, upon being put to a vote, the vote was as follows:

husband and wife, each as to an undivided one-half ('A) interest as tenants in common whose address
is P. O. Box 94,Wabasso, Florida, 32970 herein called the Grantor, to Indian River County, a political
subdivision of the state of Florida, whose post office address is 1840 25'a Street, Vero Beach, Florida
32970, hereinafter called the Grantee:

representatives and assigns of individuals, and the successors and assigns of corporations)

Dollars and other valuable considerations, receipt whereof is hereby acknowledged, hereby grants, bargains, sells,

TOGETHER, with allthetenements, hereditaments and appurtenances thereto belonging or in anywise
appertaining.
TO HAVE AND TO HOLD, the same in fee simple forever.
AND, the Grantor hereby covenants with said Grantee that the Grantor is lawfully seized of said land in fee simple;
that the Grantor has good right and lawful authority to sell and convey said land, and hereby warrants the title to said
land and will defend the same against the lawful claims of all persons whomsoever; and that said land is free of all
encumbrances, except taxes accruing subsequent to December 31, 2007.
