for historic and environmental
resource preservation
RESOLUTION NO. 2002- 117
A RESOLUTION OF INDIAN RIVER
COUNTY, FLORIDA, CANCELLING
CERTAIN TAXES UPON PUBLICLY OWNED
LANDS, PURSUANT TO SECTION 196.28,
FLORIDA STATUTES.
WHEREAS, section 196.28, Florida Statutes, allows the Board of
County Commissioners of each County to cancel and discharge any and all liens
for taxes, delinquent or current, held or owned by the county or the state, upon
lands heretofore or hereafter conveyed to or acquired by any agency,
governmental subdivision, or municipality of the state, or the United States, for
road purposes, defense purposes, recreation, reforestation, or other public use;
and
WHEREAS, such cancellation must be by resolution of the Board of
County Commissioners, duly adopted and entered upon its minutes properly
describing such lands and setting forth the public use to which the same are or
will be devoted; and
WHEREAS, upon receipt of a certified copy of such resolution, proper
officials of the county and of the state are authorized, empowered, and directed
to make proper entries upon the records to accomplish such cancellation and to
do all things necessary to carry out the provisions of section 196.28, F.S.;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA, that:
1. The property as described in O.R. Book 1533, at Pages 2739-2741
of the Public Records of Indian River County, Florida, was purchased for historic
and environmental resource preservation; and
2. Any and all liens for taxes delinquent or current against the
following described lands, which were acquired from Hallstrom Properties, Inc.,
a Florida corporation, are hereby cancelled pursuant to the authority of section
196.28, F.S.
See attached Warranty Deed from Hallstrom
Properties, Inc., a Florida corporation, to Indian
River County describing lands, recorded in O.R.
Book 1533 at Pages 2739-2741, Public Records of
Indian River County, Florida.
The resolution was moved for adoption by Commissioner
Adams , and the motion was seconded by Commissioner
Gi nn , and, upon being put to a vote, the vote was as follows:

of Indian River in the State of Florida, grantor, and Indian River. County,
Florida, a political subdivision within the state of Florida, whose post
office address is-1840, 25th Street, Vero Beach, Florida, 32960, grantee,
(Wherever used herein the terms "grantor" and "grantee" include all the parties to this
instrument and their heirs, legal representatives, successors and assigns. "Grantor" and o
"grantee" are used for singular and plural, as the context requires and the use of any o

WITNESSETH: That the said grantor, for and in consideration of the ca
sum of Ten Dollars and other good and valuable considerations, to said
grantor in hand paid by said grantee, the receipt whereof is hereby -
acknowledged, has granted, bargained and sold to the said grantee, and w

By acceptance of this warranty deed, grantee herein hereby agrees that
the use of the Property described herein shall be subject to the covenants
and restrictions as set forth in. that certain Grant Award Agreement
recorded in Official Record Book , Page , Public Records of
Indian River County, Florida. These covenants and restrictions shall run
with the Property herein described. If any of the covenants and
restrictions of the Grant Award Agreement are violated by the grantee or by
some third party with the knowledge of the grantee, fee simple title to the
Property described herein shall be conveyed to the Board of Trustees of the
Internal Improvement Trust Fund of the State of Florida in accordance with
the Grant Award Agreement without further notice to grantee, its successors
and assigns, and grantee, its successors and assigns shall forfeit all
right, title and interest in and to the Property described herein.

This conveyance is subject to easements, restrictions, limitations and w
conditions of record if any now exist, but any such interests that may

AND the said grantor does hereby fully warrant the title to said land,
and will defend the same against the lawful claims of all persons
whomsoever.
