RESOLUTION NO, 2008- 029
A RESOLUTION OF INDIAN RIVER COUNTY CERTIFYING
"AS -BUILT" COSTS FOR CERTAIN PAVING AND DRAINAGE
IMPROVEMENTS TO 31St & 32°d AVENUE SW FROM 10TH
STREET SW TO 13TH STREET SW, DESIGNATED AS PROJECT
NO, 0420, AND OTHER CONSTRUCTION NECESSITATED BY
SUCH PROJECT; PROVIDING FOR FORMAL COMPLETION
DATE, AND DATE FOR PAYMENT WITHOUT PENALTY AND
INTEREST.
WHEREAS, the Board of County Commissioners of Indian River County determined
that the improvements described herein specially benefited the property located within the
boundaries as described in this title, designated as Project No. 0420, are in the public interest and
promote the public welfare of the county; and
WHEREAS, on May 3, 2005 the Board held a public hearing in the Commission
Chambers at which time the owners of the property to be assessed were afforded an opportunity to
appear before the Board to be heard as to the propriety and advisability of making such
improvements; and
WHEREAS, after such public hearing was held the County Commission adopted
Resolution No. 2005-049 which confirmed the special assessment cost of the project to the property
specially benefited by the project in the amounts listed in an attachment to that resolution; and
WHEREAS, the Director of Public Works has certified the actual "As -Built" cost
now that the project has been completed is $.433275558 per square foot, which is greater to
$.432285192 per square foot in the confirming Resolution No. 2005-049.

RESOLUTION NO, 2008- 029
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that:
1. Resolution No. 2005-049 is modified as follows: The completion date for Project No.
0420 is declared to be February 8, 2007 and the last day that payment maybe made avoiding interest
and penalty charges is ninety (90) days after passage of this resolution.
2. Payments bearing interest at the rate of 8.25% per annum may be made in 5 equal
installments, the first to be made twelve (12) months from the due date and the subsequent payments
to be due yearly from the due date. The due date is ninety (90) days after the passage of this
resolution.
3. The assessment roll for said project listed in Resolution No. 2005-049 shall be asset forth
in attached Exhibit "A" to this resolution.
4. The assessments as shown in attached Exhibit "A" shall stand confirmed and remain legal,
valid, and binding first liens against the property against which such assessments are made until
paid.
5. The assessments shown in Exhibit "A", attached to Resolution No. 2005-049 were
recorded by the County on the public records of Indian River County, and the lien shall constitute
prima facie evidence of its validity.

WHEREAS, the Board of County Commissioners of Indian River County adopted
Resolution No. 2005-032 providing for certain paving and drainage improvements to 31St AVENUE
SW, FROM n, STREET SW TO 10th STREET SW AND 32nd AVENUE SW FROM 13TH
STREET SW TO 11TH STREET SW IN GROVENOR ESTATES SUBDIVISION'.
WHEREAS, said resolution described the manner in which the special assessments are
to be made and how the special assessments are to be paid; and
WHEREAS; the resolution was published as required by Section 206.06, Indian River
County Code; and
WHEREAS; the Board of County Commissioners of Indian River. County passed
Resolution No. 2005-033, on March 15, 2005, which due to an error in advertising was Amended
and Restated on April 19, 2005 which set a time and place for a public hearing at which the owners
of the properties to be assessed and other. interested persons would have the chance.to be heard as to
any and all complaints as to said project and said special assessments, and for the Board to act as
required by Section 206.07, Indian River County Code; and

Vero Beach Press Journal Newspaper on April 19., 2005 and April 26, 2005, (twice, one week apart,

WIMREAS, notice of the time and place of the public hearing was published in the
Vero Beach Press Journal Newspaper on April 19, 2005 and Apri126, 2005, (twice, one week apart,
and the last being at least one week prior to the hearing), as required by Section 206.06, Indian River
County Code; and
WHEREAS, the land owners of record were mailed notices at least ten days prior to the
hearing, as required by Section 206.06, Indian River County Code; and.
WHEREAS, the Board of County Commissioners of Indian River County on Tuesday,
May 3, 2005, 9:05 A.M. conducted the public hearing with regard to the special assessments,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
CON USSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows:
1. The foregoing recitals are affirmed and ratified in their entirety.
2. The Board finds that the properties assessed by this resolution will receive special
benefits equal to or greater than the cost of the assessment.
31 The special assessments shown on the attached assessment roll are hereby confirmed
and approved, and shall remain legal, valid, and binding fust liens against the properties
assessed until paid in full.
4. The County will record,the-special assessments and this resolution, which describes the
properties assessed and the amounts of the special assessments, on the public records,
which shall constitute prima facie evidence of the validity of the special assessments..
