HomeMy WebLinkAbout2003-138f • 1 RESOLUTION 2003-138 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, ABANDONMENT, VACATION AND DISCONTINUANCE OF A PORTION OF 14T11 STREET ADJACENT TO LOT 32, BLOCK M, ROCKRIDGE SUBDIVISION, UNIT 5 AND RESERVING A DRAINAGE, CANAL MAINTENANCE ACCESS, AND UTILITY EASEMENT OVER THE ENTIRE RIGHT-OF-WAY, SAID LAND LYING IN INDIAN RIVER COUNTY, FLORIDA WHEREAS, on August 27, 2002, Indian River County received a duly executed and documented petition from Dennis Bayles of Vero Beach, requesting that the County close, vacate, abandon, discontinue, renounce and disclaim any right, title and interest of the County and the public in and to a portion of 14th Street adjacent to Lot 32, Block M, Rockridge Subdivision, Unit 5, as shown on the plat of the Rockridge Subdivision, as recorded in Plat Book 5, Page 2 of the public records of Indian River County, Florida , said lands now lying in Indian River County, Florida; and WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to consider said petition was duly published; and WHEREAS, after consideration of the petition, supporting documents staff investigation and report, and testimony of all those interested and present, the board finds that the subject right-of-way is not a state or federal highway, nor located within any municipality, nor is said right-of-way necessary for continuity of the County's street and thoroughfare network, nor access to any given private property. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that 1. All right, title and interest of the County and the public in and to that certain 24' x 56.55' right-of-way being known more particularly as: Commencing at the Southwest corner of Lot 32, Block M, Rockridge Subdivision Unit 5, according to the plat thereof, as recorded in Plat Book 5, Page 2, of the public records of Indian River County, Florida; thence S89°37'00' E along the south line of said Lot 32, the same being the north right of way line of 14th Street as shown on said plat of Rockridge Subdivision a distance of 19.35 feet to the point of beginning; thence continue S89°37 00"E along the said north right of way line of 14th Street and the easterly extension thereof, a distance of 56.47 feet; thence SOO°12'05"W a distance of 24.00 feet to a point, said point being 24 feet south of, as measured perpendicular to, the said north right of way line of 14th Street„ thence N89°37'00"W and parallel with said right of way a distance of 56.55 feet; thence N00°23'00"E a distance of 24.00 feet to the point of beginning; containing 1,356 square feet more or less. (see Exhibit "A", attached) 2. The closing, vacation, abandonment, of this public right-of-way is in the best interests of the public. 3. Notice of the adopting of this resolution shall be forthwith published once within thirty (30) days from the date of adoption hereof; and 4. The Clerk is hereby directed to record this resolution together with the proofs of publication required by Florida Statutes 336.10 in the Official Record Books of Indian River County without undue delay. 5. The right-of-way shall revert to Lot 32. 6. That the Lot 32 property owner be required to remove any boat or R/V stored in the right of way area being abandoned within 24 hours after being notified by the County. The foregoing resolution was offered by Commissioner Adams who moved its adoption.
