RESOLUTION NO. 2005- 121
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF INDIAN RIVER COUNTY DELEGATING TO THE COUNTY
ADMINISTRATOR OR DESIGNEE THE AUTHORITY TO EXECUTE
STANDARD CONTRACTS FOR CONSTRUCTION OF REQUIRED
IMPROVEMENTS AND STANDARD WARRANTY AND
MAINTENANCE AGREEMENTS ISSUED UNDER SECTION 913.10
OF THE CODE OF INDIAN RIVER COUNTY.
WHEREAS, pursuant to sections 913.10(1) and 913.10(2), respectively, of The
Code of Indian River County, the Indian River County Board of County Commissioners
(Board) routinely executes standard contracts for construction of required
improvements and standard warranty and maintenance agreements (collectively
referenced as "subdivision agreements") from developers in connection with the
completion and/or maintenance of required subdivision or planned development
improvements; and
WHEREAS, it is in the best interests of the County and the public to be able to
provide the "subdivision agreements" in an expeditious manner; and
WHEREAS, the execution of these "subdivision agreements" is administrative in
nature and does not require the attention of the Board;
WHEREAS, The Code of Indian River County section 101.05.1.q. allows the
Board to authorize the County Administrator, or his designee, to perform other duties on
behalf of the Board;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY that:
The Board hereby delegates the authority to the County Administrator, or
designee, to execute "subdivision agreements" that are in the County's standard form
pursuant to section 913.10 of The Code of Indian River County, with the approval
signature of the County Attorney, or designee.
The resolution was moved for adoption by Commissioner Wheel er ,
and the motion was seconded by Commissioner Davi s and, upon
being put to a vote, the vote was as follows:

Vice Chairman Arthur R. Neuberger Aye
Commissioner Wesley S. Davis Aye
Commissioner Gary C. Wheeler Aye
Commissioner Sandra L. Bowden Absent
RESOLUTION NO. 2005- 121
The Chairman thereupon declared this resolution duly passed and adopted this
9th day of August, 2005.
