RESOLUTION NO. 2003- 103
A RESOLUTION OF INDIAN RIVER COUNTY,
FLORIDA, DELEGATING TO THE COMMUNITY
D EVELOPMENT DIRECTOR OR HIS DESIGNEE
AUTHORITY TO EXECUTE RELEASES
P ERTAINING TO ACCESSORY DOCK
AGREEMENTS WHERE A CERTIFICATE OF
OCCUPANCY HAS BEEN ISSUED FOR A
P RINCIPAL RESIDENCE.
WHEREAS, current land development regulations allow property owners to
construct and use an accessory dock prior to construction of a principal residence
provided, however, that the property owner enter into an accessory dock agreement;
and
WHEREAS, one of the conditions in the accessory dock agreement is that use of
the dock facility must cease within three years of the issuance of the dock building
permit unless a certificate of occupancy is issued for the principal residence; and
WHEREAS, when a certificate of occupancy has been issued for the principal
residence, a release of the recorded accessory dock agreement is an administrative
function that can be delegated by authority of the Board of County to the Community
Development Director or his designee;

RESOLUTION NO 2003- 103
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that
the Indian River County Community Development Director or his designee is hereby
delegated authority to execute any and all Releases pertaining to accessory dock
agreements where a certificate of occupancy has been issued for a principal residence.
The resolution was moved for adoption by Commissioner Neuberger and the
motion was seconded by Commissioner Gi nn
