HomeMy WebLinkAbout2005-007RESOLUTION NO. 2005- 007 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, ESTABLISHING A LANDSCAPE INSPECTION FEE RELATING TO CANOPY TREE REQUIREMENTS ON SINGLE-FAMILY LOTS IN CONJUNCTION WITH HOME CONSTRUCTION, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners has the authority to establish fees pursuant to Florida Statutes Chapter 125; and WHEREAS, on December 7, 2004, the Board adopted Ordinance 2004-041, which amended County landscape regulations to require that two canopy trees be planted or preserved on single-family lots in conjunction with home construction; and WHEREAS, establishment of a new landscape inspection fee is necessary to offset County costs to inspect newly developed single-family lots for compliance with canopy tree requirements prior to County issuance of Certificates of Occupancy; and WHEREAS, the Board of County Commissioners desires to properly assess the costs of implementing its regulations; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida that the attached landscape inspection fee schedule (see Exhibit "A") is hereby adopted. The effective date of the fee contained in the schedule is March 14, 2005. Exhibit "A" is attached hereto and incorporated as part of this resolution. PASSED AND ADOPTED on this 18th day of January , 2005. The foregoing resolution was offered by Commissioner Bowden and the motion was seconded by Commissioner Wheel er , and upon being put to a vote, the vote was as follows: Chairman Thomas S. LANDSCAPE INSPECTION FEE .$45.00 B. PAYMENT OF FEE The landscape inspection fee shall be due and payable to Indian River County as part of a complete application for a single-family home "residential combination new construction" building permit. C. INSPECTIONS Code enforcement officer(s) of the County Environmental Planning and Code Enforcement Section shall conduct landscape inspections of single-family lots in conjunction with Certificate of Occupancy issuance requests. D. ALLOCATION OF COLLECTED INSPECTION FEES Landscape inspection fees collected by the County shall be allocated to offset code enforcement staff costs in conducting inspections and enforcing canopy tree requirements on single-family lots.
