HomeMy WebLinkAbout2008-094E RESOLUTION 2008-094 A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, ESTABLISHING THE STATE ROAD 60 INTEREST SHARE FEE AMOUNT FOR SEGMENT ONE OF THE PROJECT FROM 66TH AVE TO 82ND AVENUE AND SEGMENT TWO FROM 82ND AVENUE TO 1- 95. WHEREAS, the Board of County Commissioners enacted the State Road 60 Interest Share Fee Ordinance in 2007; and WHEREAS, the ordinance established a fee to be paid by developers whose project caused a traffic impact to two sections of State Road 60: segment one between 66th Avenue and 82nd Street; and segment two between 82nd Avenue and 1-95; and WHEREAS, when the ordinance was enacted, the amount of the interest share fee was based on the estimated cost of constructing the improvements to State Road 60 of $38,000,000 for segment one and $30,000,000 for segment two; and WHEREAS, construction bids were recently opened for segment one and the construction cost has dropped to $23,833,362 which is significantly less than the original estimate and the Board finds it necessary to change the amount of the segment one interest share fee because the cost of construction of the improvements to State Road 60 were greatly reduced; and WHEREAS, estimates for the cost of constructing segment two from 82nd Avenue to 1-95 have been reduced from $30,000,000 to $15,400,000 which is a significant reduction and the Board finds it necessary to change the amount of the segment two interest share fee because the cost of construction of the improvements to segment two of State Road 60 were greatly reduced; and WHEREAS, simultaneously to approval of this resolution, the Board amended the State Road 60 Interest Share Fee Ordinance so that the fee is established by resolution rather than ordinance, NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: 1. The above recitals are affirmed in their entirety. 2. A State Road 60 Interest Share Fee in the amount of $4,054.00 per new Trip for the Segment One Improvements and $8,274.00 per RESOLUTION 2008- 094 new Trip for the Segment Two Improvements is hereby imposed on New Development within the State Road 60 Radius of Influence. 3. The effective date of this new fee is July 8, A, 2008. This resolution was moved for adoption by Commissioner Joseph E. Flesgher and the motion was seconded by Commissioner Wesley S. Davis , and upon being put to a vote, the vote was as follows: Chairman Sandra L. Bowden Aye Vice Chairman Wesley S. Davis Aye Commissioner Joseph E. Flescher Aye Commissioner Peter D.
