RESOLUTION OF THE INDIAN RIVER COUNTY BOARD
OF COUNTY COMMISSIONERS REQUESTING FEDERAL
DISASTER REIMBURSEMENT FOR DEBRIS REMOVAL
FROM PRIVATE ROADWAYS FOR HURRICANE
FRANCES AND HURRICANE JEANNE.
WHEREAS, Indian .River County suffered catastrophic losses due to the direct
effects of initially, Hurricane Frances, and subsequently , Hurricane Jeanne, and
. WHEREAS, Hurricane Frances and Hurricane Jeanne were each officially
recognized and declared disasters by the local, state, and federal government agencies
having appropriate legal authority to do so; and
WHEREAS, the direct impact of two hurricanes on a single community within a
period of three weeks is historically unprecedented; and
WHEREAS, the magnitude of two combined disasters has generated massive
amounts of hurricane -generated debris throughout unincorporated Indian River County
on both public and private property;
WHEREAS, the combined effects of Hurricane Frances and Hurricane Jeanne
has caused the removal of hurricane -generated debris throughout unincorporated
Indian River County on both public and private property to be in the public interest as
necessary to eliminate immediate threats to life, public health, and safety of all of the
residents of the County;
WHEREAS, Section 206.224 of Title 44 of the Code of Federal Regulations
allows assistance to be provided for the removal of debris and wreckage from publicly
and privately owned lands and waters, when it is determined that the removal of such
debris is in the public interest;
WHEREAS, pursuant to Section 206.224 of Title 44 of the Code of Federal
Regulations, removal of debris and wreckage from publicly and privately owned lands
and waters is in the. public interest when it is necessary to eliminate immediate threats
to life, public health, and safety; eliminate immediate threats of significant damage to
improved public or private property; or ensure economic recovery of the affected
community to the benefit of the community -at -large;
WHEREAS, many of the residents of Indian River County live .in private
communities on private streets where Federal Emergency Management Agency
reimbursement would not normally be granted; and

WHEREAS, refusal to provide reimbursement for debris removal for this large
area of Indian River County would negatively affect the community at -large and place a
great strain on those affected citizens, as well as on Indian River County.
NOW, THEREFORE, BE IT RESOLVED BY THE INDIAN RIVER COUNTY
BOARD OF COUNTY COMMISSIONERS, THAT:
1. The Board of County Commissioners hereby petitions the Federal Emergency
Management Agency to reimburse expenses incurred by Indian River County related to:
removing hurricane -generated debris from private roadways as a result of Hurricane
Frances and Hurricane Jeanne.
This Resolution was moved for adoption by Commissioner
Adams and the motion was seconded by Commissioner
Lowther , and, upon being put to a vote, the vote was as follows:
