RESOLUTION NO. 2005- 040;,
A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS
OF INDIAN RIVER COUNTY, FLORIDA, AUTHORIZING AN
APPLICATION FOR A PUBLIC LIBRARY CONSTRUCTION GRANT
FOR THE JOINT USE LIBRARY AT THE MUELLER CAMPUS OF
INDIAN RIVER COMMUNITY COLLEGE
WHEREAS, the Indian River County Board of County Commissioners took actions
during 1984, 1985, and 1986 to consolidate the establishment of a countywide public
library. system known as the Indian River County Library System; and
WHEREAS on January 4, 2005, and on January 18, 2005, at duly advertised
regular meetings, the Indian River County Board of County Commissioners authorized a
full service joint use public/community college branch library as part of the Indian River
County Library System and located at the Mueller Campus of the Indian River Community
College of approximately 30,000 square feet on five (5) acres of high visibility, high public
access buildable land at the Mueller Campus ("Library"), together with sufficient parking
for Library users (the Library and parking hereinafter collectively referenced as "Library
Facility"); and
WHEREAS, in furtherance of the decisions of the Indian River County Board of
County Commissioners at the January 4, 2005 and January 18, 2005 meetings, a
Funding Agreement and Memorandum Of Understanding ("Agreement') was prepared and
executed as of January 25, 2005 (the "Effective Date"), by and among Indian River
County, a political subdivision of the State of Florida; Indian River County Clerk of the
Circuit Court, a constitutional officer pursuant to Article V, section 16, of the Florida
Constitution; Indian River Community College Foundation, Inc. a Florida not-for-profit
corporation; and The District Board of Trustees of Indian River Community College, a
political subdivision of the State of Florida ; and
WHEREAS, in connection with the Library, the Indian River County Board of County
Commissioners is applying for a Public Library Construction Grant from the Florida
Department of State Division of Library and Information Services; and
WHEREAS, the Public Library Construction Grant application requires a Resolution
from the Indian River County Board of County Commissioners,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that:
1. The Public Library Construction Grant application for the Library, in substantially
the form attached to this Resolution and made a part hereof by this reference, is
hereby authorized for submission to the Florida Department of State Division of
Library and Information Services.

2. The name or position title of the person authorized to sign the Public Library
Construction Grant application is Thomas S. Lowther, Chairman, Indian River
County Board of County Commissioners.
3. The name or position title of the person authorized to provide the required
certifications in connection with the Public Library Construction Grant application
is the County Administrator, or his designee.
4. The required match of a dollar for dollar of the $500,000 Public Library
Construction Grant application request for the Library will be available and
unencumbered at the time of grant award to Indian River County.
5. Upon completion of the Library project, sufficient funds will be available to operate
the Library Facility.
6. Funding is sufficient and will be available in order that the Library project will
result in a completed Library building.
7. The Library building will be used exclusively for the full service joint use
public/community college branch library as part of the County Library System
public library purpose for which the Library was constructed.
8. It will submit proposed changes in use of the Library to the Florida Department of
State Division of Library and Information Services for approval if such proposed
changes in use occur within 20 years of the completion of the Library construction
project.
This Resolution was moved for adoption by Commissioner
Neuberger and the motion was seconded by Commissioner
Bowden , and, upon being put to a vote, the vote was as follows:

follow such procedures as will be required by the Department of State, Division of Library and Information
Services;that all funds received for the project will be expended solely for the purposes for which granted
and any such funds not so expended,including funds lost or diverted to other purposes, shall be paid to the
Department of State, Division of Library and Information Services; and that the current annual
appropriation for library service is$ 4, 065 , 245 -00
