A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA, OPPOSING SENATE BILL 494 AND
HOUSE BILL 755 (2009 LEGISLATIVE SESSION).
WHEREAS, Senate Bill 494 and House Bill 755 impose requirements for
automatic lawn sprinkler systems to have rain or soil -moisture devices or switches; and
WHEREAS, licensed irrigation contractors will be required to inspect for
such devices and switches, and to install them before completing any other service to
the system; and
WHEREAS, local governments will be required to adopt ordinance to
enforce, impose fines, and set up contractor reporting systems,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA THAT:
1. Senate Bill 494 and House Bill 755 are unfunded mandates that
shift enforcement duties to local governments at a time when those local governments
are cutting budgets and lack the manpower to implement enforcement.
2. Water conservation is a good intent, but these bills will result in
financial penalties to our neighbors, undermining respect for the law.
3. The subject matter of these bills should focus on education, not
regulation, and be left to the discretion and option of local governments.
RESOLUTION NO. 2009-015
4. The Board of County Commissioners of Indian River County,
Florida opposes Senate Bill 494 and House Bill 755.
5. The Clerk to the Board is directed to mail certified copies of this
resolution to the Indian River County local legislative delegation.
This resolution was moved for adoption by Commissioner Solari, and the
motion was seconded by Commissioner Flescher, and, upon being put to a vote, the
vote was as follows:

The Chairman thereupon declared the resolution duly passed and adopted
this 3rd day of March, 2009.
