A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY,
FLORIDA, OPPOSING SENATE BILL 630 (2009
LEGISLATIVE SESSION).
WHEREAS, Senate Bill 630 introduced by Senator Bennett will prohibit
counties and municipalities from imposing or collecting impact fees for any purpose
from October 1, 2009 through September 30, 2012; and
WHEREAS, the State Legislature should focus on state issues and leave
local issues to local government; and
WHEREAS, impact fees are a uniquely local issue, involving the allocation
of the costs of growth between existing local taxpayers and new residents; and
WHEREAS, a prohibition on impact fee collection could jeopardize
economic development activity by removing a funding source to satisfy State imposed
concurrency requirements, as well as jeopardizing the repayment of loans made to fund
capital projects; and
WHEREAS, Senate Bill 630 is a direct attack on the local home rule
concepts embodied in the 1968 amendments to the Florida State Constitution,
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The Board of County Commissioners of Indian River County,
Florida opposes Senate Bill 630.

2. The Clerk to the Board is directed to forward copies of this
resolution to the Legislative Delegation.
The resolution was moved for adoption by Commissioner Solari, and the
motion was seconded by Commissioner O'Bryan, and, upon being put to a vote, the
vote was as follows:

The Chairman thereupon declared the resolution duly passed and adopted
this 17th day of February, 2009.
