HomeMy WebLinkAbout2008-172RESOLUTION NO. 2008- 172 A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, APPROVING THE PREFERRED ALIGNMENT FOR IMPROVEMENTS TO 27TH AVENUE (C.R. 607) BETWEEN 17TH STREET SW AND 5TH STREET SW; APPROVING THE PREFERRED POND SITE FOR THE FUTURE IMPROVEMENTS TO 27TH AVENUE (C.R. 607) IN THE AREA OF THE INTERSECTION WITH OSLO ROAD (C.R. 606); DETERMINING THE NECESSITY OF ACQUIRING CERTAIN REAL PROPERTY FOR IMPROVEMENTS TO OSLO ROAD (C.R. 606), AND FOR IMPROVEMENTS TO 27TH AVENUE (C.R. 607); AND AUTHORIZING THE COUNTY ATTORNEY TO ACQUIRE PROPERTY BY PURCHASE OR EMINENT DOMAIN WHEREAS, Indian River County (the "County") is a political subdivision of the State of Florida; and WHEREAS, Indian River County is one of the fastest growing counties within the State of Florida; and WHEREAS, the continued growth in Indian River County has greatly increased the vehicular traffic within the County roadway network; and WHEREAS, portions of Oslo Road (C.R. 606) and portions of 27" Avenue (C.R. 607) are unable to adequately accommodate expected future vehicular traffic, management of access, drainage, water retention, and are in need of improvement; and WHEREAS, improvementsto Oslo Road (C.R. 606) between Old Dixie Highway and 43rd Avenue, and 27`" Avenue (C.R. 607) between 17'" Street SW and 5`" Street SW are included in the County's 2020 Comprehensive Plan Capital Improvements Element, as adopted by Ordinance 2007-034 and in the County's County's 2020 Comprehensive Plan Transportation Element, as adopted by Ordinance 2006-030; and WHEREAS, County staff and its consultants have presented a preferred alignment for the 27`" Avenue (C.R. 607) roadway improvement project; and WHEREAS, County staff and its consultants have presented the preferred pond siting for the 27" Avenue (C.R. 607) roadway improvement project in the area of the intersection with Oslo Road (C.R. 606); and WHEREAS, the County does not have the interests in real property necessary to provide for such improvements; and WHEREAS, it is in the public interest and for the benefit of the public to improve Oslo Road (C.R. 606) and 27'" Avenue (C.R. 607); and RESOLUTION NO. 2008-172 WHEREAS, the acquisition of the real property described herein is necessary to construct and maintain improvements to Oslo Road (C.R. 606), and to construct and maintain improvements to 27'h Avenue (C.R. 607); and WHEREAS, the estate and interest in the real property described herein is necessary to adequately accommodate the planned improvements, expansions, and/or alterations to Oslo Road (C.R. 606) and 27th Avenue(C.R. 607); and WHEREAS, pursuant to Chapters 127, 73 and 74, Florida Statutes, the County is authorized to exercise the power of eminent domain: NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, as follows: 1. After due consideration of many factors, including but not limited to the availability of alternate routes, costs, environmental factors, long-range area planning, and safety considerations, the preferred alignment for 27" Avenue (C.R. 607) as described in the 27" Avenue Route Study Between 17th Street SW and 5th Street SW prepared by Kimley-Horn and Associates, Inc. and dated August 2008, which is hereby incorporated by reference into this Resolution, is hereby ratified and approved. 2. After due consideration of many factors, including but not limited to the availability of alternate routes, costs, environmental factors, long-range area planning, and safety considerations, the preferred pond site for the 27th Avenue (C.R. 607) roadway improvement project in the area of the intersection with Oslo Road (C.R. 606) as described in the Pond Siting Report prepared by Kimley-Horn and Associates, Inc. and dated June 2007, which is hereby incorporated by reference into this Resolution, is hereby ratified and approved. 3. The Board of County Commissioners hereby finds that the recitals above are true and correct, and that acquiring fee simple title to the real property described in Composite Exhibit "A" as Parcel Nos. 45A, 45B and 60 is necessary for the public purpose of improving Oslo Road (C.R. 606) and 27th Avenue. 4. The County's attorneys are authorized and directed to institute such negotiations, eminent domain proceedings pursuant to Chapters 73 and 74, Florida Statutes, and other collateral proceedings, so as to allow the County to take title and possession in fee simple of Parcel Nos. 45A, 45B and 60. RESOLUTION NO. 2008-172 5. This resolution shall take effect immediately upon its adoption. The resolution was moved for adoption by Commissioner Peter D.
