INDIAN RIVER COUNTY RESOLUTION DECLARING
STATE OF LOCAL EMERGENCY
WHEREAS, the National Hurricane Center recognizes the danger to coastal
residents of Florida from Hurricane Wilma, by posting a Hurricane Warning from

WHEREAS, Indian River County has residents and businesses still recovering from
the cumulative impact of Hurricane Frances and Hurricane Jeanne, which made
landfall in our county in 2004; and
WHEREAS, Hurricane Wilma could produce in excess of 6 inches of rainfall in
Indian River County; and
WHEREAS, Hurricane Wilma's extreme weather conditions pose an immediate
danger to the lives and property of the vulnerable residents of Indian River County;
and
WHEREAS, Chapter 252.38, Florida Statutes, provides authority for a political
subdivision such as Indian River County to declare a State of Local Emergency and
to waive the procedures and formalities otherwise required of political subdivisions
by law pertaining to:
1. Performance of public work and taking whatever action is necessary
to ensure the health, safety, and welfare of the community.
2. Entering into contracts.
3. Incurring obligations.
4. Employment of permanent and temporary workers.
5. Utilization of volunteer workers.
6. Rental of equipment.
7. Acquisition and distribution,with orwithout compensation of supplies,
materials and facilities.
8. Appropriation and expenditure of public funds.
WHEREAS, the Board of County Commissioners of Indian River County on October
20, 2005 by Resolution 2005- %' ' , delegated to County Administrator Joseph A. Baird
the authority to proclaim and declare a State of Local Emergency in Indian River County.

NOW THEREFORE, BE IT RESOLVED that:
1. Hurricane Wilma poses a serious threat to the lives and property of residents
of Indian River County and that a State of Local Emergency is hereby
proclaimed and declared, effective immediately, for all of Indian River
County, including, all unincorporated and incorporated areas. The State of
Local Emergency will be in effect for seven (7)days, unless further extended
by the Board of County Commissioners.
2. Indian River County hereby exercises its authority and waives the procedures
and formalities required by law of a political subdivision, as provided in
Chapter 252.38, Florida Statutes.

RESOLUTION 2005-176
INDIAN RIVER COUNTY RESOLUTION AUTHORIZING
COUNTY ADMINISTRATOR TO DECLARE A LOCAL EMERGENCY
WHEREAS, should an emergency situation be beyond the capabilities of Indian River
County to respond, the Indian River County Board of County Commissioners would then declare a
local emergency and request assistance from the state to save lives, protect property, public health
and safety; and,
WHEREAS, a Local Emergency may need to be declared when the Board of County
Commissioners are not available; and,
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River
County, Florida, this 20th day of October, 2005, that
1. The Board of County Commissioners hereby grants its authority, in
their absence, to the County Administrator, Joseph A. Baird, to
proclaim and declare a State of Local Emergency.
2. This Resolution shall be effective for the fiscal year of 2005-06.
The resolution was moved for adoption by Commissioner Bowden and the motion was
seconded by Commissioner Neuberger , and, upon being put to a vote, the vote was as
follows:

Vice-Chairman Arthur R. Neuberger Aye
Commissioner Wesley S. Davis Aye
Commissioner Gary C. Wheeler Absent
Commissioner Sandra L. Bowden Aye
The Chairman thereupon declared the resolution duly passed and adopted this 20th day of
October, 2005.
