RESOLUTION 2007-004 A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA; ENDORSING BY THE RIVER, INC. AS A SPONSORING AGENCY UNDER THE FLORIDA COMMUNITY CONTRIBUTION TAX CREDIT PROGRAM; AND FINDING THAT THE PROPOSED BY THE RIVER ASSISTED LIVING FACILITY IS CONSISTENT WITH THE INDIAN RIVER COUNTY COMPREHENSIVE PLAN AND THE INDIAN RIVER COUNTY LAND DEVELOPMENT REGULATIONS. WHEREAS, the State, under Section 220.183, Florida Statutes, authorized the Community Contribution Tax Credit Program, which allows any Florida corporation to receive a credit against any corporate income/franchise tax, sales tax, or insurance premium tax due for a taxable year of 50 percent of the value of a donation (not to exceed a $200,000 credit in any one year) for contributions to a State approved community development project; and WHEREAS, the State, under Section 220.03(1)(t), Florida Statutes, defines an eligible community development project to include but not be limited to activity undertaken by an eligible sponsor, which is designed to construct, improve, or substantially rehabilitate housing that is affordable to low income or very low income households; and WHEREAS, By The River, Inc., a non-profit organization incorporated in the state of Florida, proposes to construct a low income assisted living community within Unincorporated Indian River County and meets the criteria as a sponsoring organization under Section 220.183(2)(c), Florida Statutes; and WHEREAS, on February 18, 2003, By The River, Inc. assisted living community, described in attachment A, received conceptual planned development approval from Indian River County as part of an overall 78.22 acre Kashi Church Foundation conceptual planned development project; and WHEREAS, as part of the conceptual planned development approval, the County determined that the assisted living community project is consistent with both the overall intent of the County's Comprehensive Plan and Land Development Regulations; and 1 RESOLUTION 2007-004 WHEREAS, By The River, Inc. is the sponsoring organization applying for approval of the Assisted Living Community as a State approved Community Development Project. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, THAT: The Board of County Commissioners endorses By The River, Inc. as a sponsoring agency under the Florida Community Contribution Tax Credit Program and finds that the Assisted Living Community project, as described in Attachment A, and preliminarily approved On February 18, 2003 as part of the Kashi Church Foundation conceptual planned development project is consistent with the Indian River County Comprehensive Plan and Indian River County Land Development Regulations. November 2006 THE COMMUNITY CONTRIBUTION TAX CREDIT PROGRAM Organization Sponsor Proposal Submitted to Executive Office of the Governor Office of Tourism, Trade and Economic Development The Capitol Suite 2001 Tallahassee, Florida 32399-0001 Sponsor Criteria: "Sponsor a project to construct housing for low-income persons." "A non-profit corporation affiliated with cornmunity development." Type of contribution sought and intended use: By the River will be seeking donor tax credits for charitable contributions to construct housing for low-income persons. DEVELOPMENT DESCRIPTION Specific location: The Applicant, By the River, Inc., will be located in Indian River County on 11045 Roseland Road in Sebastian, Florida, 32958. The South end of the site is bordered by state protected wetlands with a wide variety of natural Florida flora and fauna. The St. Sebastian River borders the West side of the property, which is a natural habitat for manatees and dolphins and widely enjoyed by bird watchers, canoe riders and pleasure boaters. Live oaks and pine trees are part of the overall diverse vegetation. Description of the facility: These four, ten unit, single story homes with a central common area will be located on 6.57 acres of land as part of a 78 acre Planned Development that includes in its plan a Kindergarten thru 811' grade 200 student school campus that will have room available for other functions and uses, an international conference and retreat center with monthly workshops, a cafe and guest cottages and a residential area. Each unit in By the River will have ample space for basic activities—sleeping, lounging (TV), reading/writing, cooking and personal hygiene (shower with handicapped access for 100% of the units), has been planned. In addition, cable connection for television and telephone links will also be available for each apartment. Municipal water and sewer are available along Roseland Road for connections to the facility, as are electrical and telecommunication services. The project's ability to proceed is evident, as all due diligence procedures have been completed. Environmental Phase I & II survey's have been fulfilled. All zoning requirements, archeological and topographical surveys have also been completed. The buildings are being designed to comply with applicable Florida Hurricane Code. Fire protective services are available from the City of Sebastian Fire House on Barber Street, less than two miles away. November 2006 Green House Project: By the River will be configured and operated as a Green House Project model, which was developed by the Robert Wood Johnson Foundation and is a project of the NCB Development Corporation. Within these four, ten -unit buildings, we also plan to dedicate ten of those units to providing increased levels of care to those suffering from Alzheimer's and other age related dementia illnesses. In the Green House model, universal workers will provide direct care services including food preparation, assistance in activities of daily living, housekeeping, and medications management, all increasing the continuity of care and quality of life for residents. The, Green House Project is unique in it's concept of keeping housing unites limited to 10 beds or less, thus providing a more home -like atmosphere. This design set-up also creates a sense of safety, security and order and conveys the importance of the individual's self-esteem. All of these elements fit perfectly with By the River's mission to foster freedom and dignity. National Demonstration Model The Coming Horne Program, administrated by the Department of Elder Affairs and funded by the Robert Wood John on Foundation, has made By the River, Inc. a feaiured demonstration project. This program, which is part of the nations largest healthcare related foundation, • initiated by The Honorable Governor Jeb Bush, encourages local communities to take a greater degree of responsibility for supporting the housing needs of their senior citizens who are living below the poverty line. Now, more than ever, it is imperative that every community in the country begins to take responsibility for the growing challenges regarding the elder population. This project will serve as a beacon to other communities who are willing to step up and take care of their seniors. Number of units: 40 zero bedroom units. Target groups: Frail elderly. Rents: Indian River County Median Income=$53,250. 80% or 32 of the units will have rents that do not exceed 60% of the area medium income limits. In Indian River County rents at 51-80% of the Medium Income, which is classified as `Low', for an Efficiency is $746 a month. 20% or 8 units will have rents that do not exceed 30% of the area medium income. In Indian River County rents at 30% of the Medium Income, which is classified as `Extremely Low', for a Efficiency is $280 a month. • By the River will keep all units at the above set aside rates for 50 years. New Construction: Yes. 3 By the River, Inc. November 2006 Tenant Services: • Tenant Services provided on site by the Applicant, By the River, Inc., at no additional cost to the residents: • Emergency call system connected to 24-hour monitored emergency service desk. • Exercise class twice a week: Yoga and Fitness classes • Education Programs: By the River will provide educational programs for the residents as well as others in the local community. These programs may include: 1. Financial Counseling 2. Bereavement Counseling 3. Song and Dance Classes • Day Service Program: The proposed day service program leverages the facility and staff and provides day services that include organized activities including arts and crafts, exercise, relaxation techniques and some life coaching applications. • Scheduled events such as birthday parties, music, potlucks, card games, bingo, etc. • . Free blood pressure screening twice a month. • By the River is in the process of developing a program called Compassion Works©: it will be a service -driven, community-based project that encourages its residents to participate in service projects of their own. Compassion Works° is a custom - developed program to empower the elderly by providing opportunities to serve others. Providing simple service projects goes a long way to improving the self-worth and dignity of seniors. This innovative program is designed to keep the residents Moving and speak directly to the commitment to enhance the dignity of seniors. Having a way for residents to get involved and help others is a great way to ensure they feel good about themselves. By providing effective compassionate service outlets this organization will be able to improve the, quality of life for all involved. Studies have shown that seniors who bring their life experience and talents to bear on compassionate service projects live happier, healthier and longer lives. This project will also emphasize inter -generational. programs that bring the youth of the community together with the elders to exchange the vitality of the youth with the wisdom of the elders. On site Tenant Services will be provided by an outside provider at no additional cost to the tenant: • Transportation stops weekdays provided by the Indian River County Council on Aging and rides by appointment to doctors. • By the River will be partnering with the national organization, The Boys and Girls Club of America. The intention is to provide a mechanism to implement inter- generational programs. Boys and Girls Club programs and services promote and enhance the development of boys and girls by instilling a sense of competence, usefulness, belonging and influence. Working with the Boys and Girls Club of America will bring young people together with the residents to help bridge the generational gap. 4 By the River, Inc. Amenities: November 2006 40 - The goal of By the River is to meet the physical, emotional, recreational, social religious and/or other similar needs of the frail elderly. To this end, incorporated in the plans are many amenities that compile the living and lifestyle of By the River's development. Physical & Recreational amenities: outdoor recreation, including walks through nature trails, river view seating and a common area with indoor activities including community TV- video/lounge area, movies, chess/card games, bingo, and a computer/library room. Also included in Kashi Foundation's overall development site plan is a 200 -student school campus facility where lecture halls and classrooms will be available to By the River for specific activities and events. Social amenities: local shopping, group movies to the theater, group dining, special events (celebrations), and opportunities for family visits. Religious/Spiritual amenities: By the River will be located next to an interfaith spiritual center with access to shrines for each major religion of the world and opportunities to pray or meditate as well as participate in a multitude of religious holiday celebrations. November 2006 Low Income: Residents will be selected on a first come first serve basis as well as referrals from local hospitals and social service agencies. By the River, Inc. will not discriminate against residents based on race, religion or ethnicity. The housing is affordable because the rental amounts correspond with those established by the Florida Housing Finance Corporation to ensure affordability. The income requirements as stated above are in line with the safe harbor requirements as set forth in Revenue Procedure 96-32, 1996-1 C.B. 717. Community Need: The housing is affordable to a significant segment of the elderly persons in the community. The community is the geographic region of Indian River County. By keeping 100% of the units' set-aside for low-income members of the community this project is ensuring affordability among a large section of the population. In the future, when By the River, Inc. is ready to open, a policy will be established where a reserve fund for maintaining residents who have trouble paying their regular charges is available. This policy will include a resolve to allow residents to remain in place for a period of time to permit them to find alternative housing. Mission Statement: The purpose of By the River is to provide affordable, long-term care services in a financial self-supporting manner for elderly persons of diversity in a sacred conununity atmosphere. We will provide care regardless of sex, color, creed, or nationality of the individual. We secure the freedom of our residents to make independent decisions about care, to enjoy dignity and privacy and to celebrate their faith according to their own traditions. We empower our staff members with the training and support they need to provide meticulous care with heart and compassion to our residents. Articles of Incorporation: Purposes: The purpose or purposes of the corporation are: relief of the poor and distressed and the underprivileged through providing low income housing for the elderly and promotion of health of the elderly, including but not limited to: A. Providing low-income housing for the elderly. B. Meeting the special housing requirements of the elderly. C. Providing a home for aged. D. Relief of the poor and elderly. E. Relief of the distressed of the elderly. F. Promoting health of the elderly. G. Participation in government housing programs, which will benefit the elderly. 6
